WAEREAS, Public Health has requested the Ciry Conncil to hold public hearings to consider
the advisabiliry and necessity of ordering the repair or wrecking and removal of a two-story, wood
frame duplex located on properry hereinafter referred to as the "Subject Properry" and commonly
known as 1107 Burns Avenue. This property is legally described as follows, to wit:
Lot 11, McGuire & Hoyts subdivision of L,ots 14 and 15, Block 30, Suburban Hills
Addition to the City of St. Paul, Ramsey County, Minnesota.
WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
information obtained by Public Health on or before August 27, 1997, the following are the now
known interested or responsible parties for the Subject Properry: Marjorie Hathaway, 790 I.ower
Colonial Rd., Mendota Heights, M1V 55118; 7ames Swartwood, P.O. Box 17255, Mpls., MN
55417; TCF Mortgage Corp., 801 Marquette Avenue, Minneapolis, MN 55402-3G75
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
August 18, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property hy September 17, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property deciaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WEIEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing Officer of the Ciry Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have heen served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
puipose of the public hearings; and
WHEREAS a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on lltesday, November 4, 1997 to hear testunony and evidence, and after receiving
tesumony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance wiffi all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within €i€te�s after the

WFIEREAS, a hearing was held before the Saint Paul City CouncIl on Wednesday,
November 12, 1997 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RFSOLVED, that based upon the testimony and evidence presented at the above
referenced pubiic hearings, the Samt Paul Ciry Council hereby adopts the following Findings and
Order conceming the S�bject Properiy at 1107 Burns Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. . That an Qrder to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Publ]c Aealth has posted a piacard on the Subject Property which deciares it to
be a mzisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Ck�apter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabilitaung this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the altemative by demolishing and removing ffie
structure in accordance with all applicable codes and ordinances. The reliabilitation or
demolition and removal of the structure must be completed within �i#���s after the
date of the Council Hearing. ��

3. In ihe event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property bp the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The legal description of this property is:

Saint Paul Public Health has declazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Tnasmuch as this Order to Abate has not been complied with the miisance condition remains
unabated, the community continues to suffer the blighting influence of this properry. It is
the recommendation of Public Health that the City Council pass a resolution orderittg the
responsible parties to either repair, or demolish and remove this buildin� in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

Gerry Strathman, Legislative Hearing Officer, cailed the meeting to order at 10:00 a.m.
404 Erie Street
Chuck Votet, Public Hea[tfi, reported that this property is owned by ihe City and County
Employee Credit Uniott. No decision has been made as to how they will proceed with this
building. Real Estate ta2ces are unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the properry owner repair or remove this structttre within fifteen (15) days, otherwise
Public Heaith is authorized to demolish and assess the cost to the properry taxes.
Gerry Strathman, Legislative Hearing officer recommended approval.
96 Robie Street West
Chuck Votel, Public Health, reported that this property is owned by Mid America Bank.
Mr. V otel advised that the bank is undecided as to how they will proceed with this building.
Real Estate taxes are unpaid in the amouat of $1,382. Code Enforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $ I0,000. Mr. Votel stated that Public Health has
received many complaints from Itivervi�w Crime Prevention and neighborhood associations
with respect to this property. Pnblic Healtk submitted orders tkat the properiy owner repair or
remove this structure within fifteen (15) days, otherwise Public Hea[th is authorized to demolish
and assess the cost to the properiy ta�ces.

Robert Anderson, the current owner, stated that he has a signed purchase agreement.
Closing is scheduled for November 19�'. The new owner, Yee Lee, advised that she and her
husband intend to rehabilitate the inside of the building during the winter months and complete
the outside work in the spring. Chuck Votel, Public Health, stated that the Real Estate taxes are
paid.

December 2nd Legislative Hearing.

by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Tnasmuch as this Order to Abate has not been complied with the miisance condition remains
unabated, the community continues to suffer the blighting influence of this properry. It is
the recommendation of Public Health that the City Council pass a resolution orderittg the

Chuck Votet, Public Hea[tfi, reported that this property is owned by ihe City and County
Employee Credit Uniott. No decision has been made as to how they will proceed with this
building. Real Estate ta2ces are unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the properry owner repair or remove this structttre within fifteen (15) days, otherwise
Public Heaith is authorized to demolish and assess the cost to the properry taxes.

Chuck Votel, Public Health, reported that this property is owned by Mid America Bank.
Mr. V otel advised that the bank is undecided as to how they will proceed with this building.
Real Estate taxes are unpaid in the amouat of $1,382. Code Enforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $ I0,000. Mr. Votel stated that Public Health has
received many complaints from Itivervi�w Crime Prevention and neighborhood associations
with respect to this property. Pnblic Healtk submitted orders tkat the properiy owner repair or
remove this structure within fifteen (15) days, otherwise Public Hea[th is authorized to demolish
and assess the cost to the properiy ta�ces.

paid.

WAEREAS, Public Health has requested the Ciry Conncil to hold public hearings to consider
the advisabiliry and necessity of ordering the repair or wrecking and removal of a two-story, wood
frame duplex located on properry hereinafter referred to as the "Subject Properry" and commonly
known as 1107 Burns Avenue. This property is legally described as follows, to wit:

Addition to the City of St. Paul, Ramsey County, Minnesota.
WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
information obtained by Public Health on or before August 27, 1997, the following are the now
known interested or responsible parties for the Subject Properry: Marjorie Hathaway, 790 I.ower
Colonial Rd., Mendota Heights, M1V 55118; 7ames Swartwood, P.O. Box 17255, Mpls., MN
55417; TCF Mortgage Corp., 801 Marquette Avenue, Minneapolis, MN 55402-3G75
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
August 18, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property hy September 17, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property deciaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WEIEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing Officer of the Ciry Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have heen served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
puipose of the public hearings; and
WHEREAS a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on lltesday, November 4, 1997 to hear testunony and evidence, and after receiving
tesumony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance wiffi all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.

WFIEREAS, a hearing was held before the Saint Paul City CouncIl on Wednesday,
November 12, 1997 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RFSOLVED, that based upon the testimony and evidence presented at the above
referenced pubiic hearings, the Samt Paul Ciry Council hereby adopts the following Findings and
Order conceming the S�bject Properiy at 1107 Burns Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. . That an Qrder to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Publ]c Aealth has posted a piacard on the Subject Property which deciares it to
be a mzisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Ck�apter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabilitaung this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the altemative by demolishing and removing ffie
structure in accordance with all applicable codes and ordinances. The reliabilitation or
demolition and removal of the structure must be completed within �i#���s after the
date of the Council Hearing. ��

1 2. If the above corrective acuon is not completed within this period of tune the Public Health,

3. In ihe event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property bp the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.
