WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a one-story,
concrere block structure located on properry hereinafter referred to as the "Subject Property" and
commonly known as 1421 York Avenue. This property is legallp described as follows, to wit:
Parcel 1: Lot 13, EXCBPT the West 100 feet thereof, Block 2, Fairchild's
Rearrangement of Lots 8 to 15 inclusive, Block 1 of Cruickshank's Garden Lots to St.
Paul, TOGETHER with that part of the West ll2 of the adjoining alley, vacated,
lying between the extensions across said alley of the North and South lines of said Lot
13.
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before August 25, 1997, the foliowing are the now
known interested or responsible parties for the Subject Property: William B. Hartman Jr., 15081
SOth Street South, Afton, MN 55001; Raymond D. Smestad, 491 East Sidney Street, St. Paui, MN
55107
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
August 12, 1497; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 11, 1997; and
WAEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Public Health requested that
the Ciry Clerk schedule public hearings before the Legislative Hearing Officer of the City Council
and the Saint Paul City Council; and

WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the tune, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, October 21, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfaze and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the CouncIl Hearing; and
R�IEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday,
November 5, 1997 and the testimony and evidence including the action taken by the L.egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1421 York Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Aousing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notificauon requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifreen (15) days after the
date of the Council Hearing.

1 2. If the above correcuve action is not completed within this period of time the Public Health,
2 Code Enforcement Program is hereby authorized to take whatever steps are necessary to
3 demolish and remove this structure, fill the site and charge the costs incuned against the
4 Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive Code.

3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fistures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Saint Paui Pubiic Health has declared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ozdering the
responsible parties to either repair, or demolish and remove this buildin� in a Yimely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

STAFF PRESENT: Chuck Votel and Guy VJiliits.
Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
10 4 E. Seventh Street
William Bernie, owner of Bernie Pipe Bending and Coil Fabrication, advised he has been
in business at that location 35 years. Mr. Bernie stated that some of the pipe laying in the
driveway was for a customer.
Guy Willits, Public Health, reported the order mailed October 9'� was to remove
discarded furniture, vehicle parts, scrap wood, building materials, household items, rubble, lazge
metal items, pipes and junk, Mr. Willits also presented Gerry Strathman, Legislative Hearing
Officer, with photographs taken October 8u - others taken October I Su showing that everything
had been removed.
Mr. Strathman reminded Mr. Bernie that he is not allowed to have exterior storage in that
azea and recommended denying the appeal.
2. 1160 Conway Street
Lennis Baas, owner, appeazed, stating that he had complied with two previous orders to
clean his property.
Chuck Votel, Public Health, presented Gerry Sh�athman, Legislative Hearing Officer,
with photographs taken October 17`". After reminding Mr. Bass that motors and stacks of wood
ate not to be stored out in the open in a residential azea, Mr. Strathman recommended denying
the appeal.
3. I 840 Minnehaha Avenue East
Gerry Strathman, Legislative Hearing Officer, reported that this is a HUD properry.
Sophie Hallauer had indicated during a telephone conversarion that HUD intends to market the
property and requested an extension of six months to repair or demolish the building. Mr.
Strathman stated that the program supervisor at Public Health indicated that they aze unwilling to
support this request in view of the fact that the building is not suitable for rehabilitation.
Mr. Strathman recommended approving the order to remove or repair within 15 days.

4. 951 Margaret Street
Chuck Votei, Public Health, reported that this building has been vacant since April, 1997,
and that four Summary Abatement notices have been issued.
Larry Zielke, representing Banker's Trust Company of California, National Associarion -
now the fee owner, appeared. Mr. Zielke stated that this property was initiaily sold by the
Veteran's Administration on a Contract for Deed, subsequent to a prior foreclosure. The paper
was purchased by Banker's Trust Company and is serviced by Nation's Bank Mortgage
Corporation of Kentucky. The Contract for Deed was canceled recently. On October 1�` the
Ramsey County District Court approved a petition for a proceeding, subsequent to the transfer of
the certificate of tiUe to Banker's Trust. Banker's Trust is requesting six months to find a buyer
to bring the properry up to code compliance.
Mr. Strathman stated that if Banker's Trust obtains a code compliance inspection and
posts a$2,000 Bond by Noon, Wednesday, November 5�', he would recommend allowing six
months for rehabilitation and added that after the six-month period, if the rehabilitation is at least
50% complete, they can request an additional six months.
5. 1421 York Avenue
Chuck Votel, Public Health, reported that they received a letter from a son of the owner
requesting that the ciry proceed with demolishing and assess the cost to taxes. IvSr. Votel stated
Pubiic Health estimates the cost to repair to be more than the building is worth.
Gerry Strathman recommended approval.
6. 694 Snns Avenue
Russell Hamilton, owner, appeazed. Mr. Hamiiton stated that he made an attempt to buy
this property in January from the original owner, Thomas D. Cazlstrom. Pvlr. Hamilton indicated
that Mr. Cazistrom could not produce a title. Lany Williams (Contract for Deed Holder)
abandoned the property and it was sold around August 20` Mr. Hamilton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting tnne to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspecrion
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the buiiding.
The hearing adjourned at 10:52 a.m.

Saint Paui Pubiic Health has declared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ozdering the
responsible parties to either repair, or demolish and remove this buildin� in a Yimely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.

William Bernie, owner of Bernie Pipe Bending and Coil Fabrication, advised he has been
in business at that location 35 years. Mr. Bernie stated that some of the pipe laying in the
driveway was for a customer.
Guy Willits, Public Health, reported the order mailed October 9'� was to remove
discarded furniture, vehicle parts, scrap wood, building materials, household items, rubble, lazge
metal items, pipes and junk, Mr. Willits also presented Gerry Strathman, Legislative Hearing
Officer, with photographs taken October 8u - others taken October I Su showing that everything
had been removed.
Mr. Strathman reminded Mr. Bernie that he is not allowed to have exterior storage in that
azea and recommended denying the appeal.
2. 1160 Conway Street
Lennis Baas, owner, appeazed, stating that he had complied with two previous orders to
clean his property.
Chuck Votel, Public Health, presented Gerry Sh�athman, Legislative Hearing Officer,
with photographs taken October 17`". After reminding Mr. Bass that motors and stacks of wood
ate not to be stored out in the open in a residential azea, Mr. Strathman recommended denying
the appeal.
3. I 840 Minnehaha Avenue East
Gerry Strathman, Legislative Hearing Officer, reported that this is a HUD properry.
Sophie Hallauer had indicated during a telephone conversarion that HUD intends to market the
property and requested an extension of six months to repair or demolish the building. Mr.
Strathman stated that the program supervisor at Public Health indicated that they aze unwilling to
support this request in view of the fact that the building is not suitable for rehabilitation.
Mr. Strathman recommended approving the order to remove or repair within 15 days.

4. 951 Margaret Street
Chuck Votei, Public Health, reported that this building has been vacant since April, 1997,
and that four Summary Abatement notices have been issued.
Larry Zielke, representing Banker's Trust Company of California, National Associarion -
now the fee owner, appeared. Mr. Zielke stated that this property was initiaily sold by the
Veteran's Administration on a Contract for Deed, subsequent to a prior foreclosure. The paper
was purchased by Banker's Trust Company and is serviced by Nation's Bank Mortgage
Corporation of Kentucky. The Contract for Deed was canceled recently. On October 1�` the
Ramsey County District Court approved a petition for a proceeding, subsequent to the transfer of
the certificate of tiUe to Banker's Trust. Banker's Trust is requesting six months to find a buyer
to bring the properry up to code compliance.
Mr. Strathman stated that if Banker's Trust obtains a code compliance inspection and
posts a$2,000 Bond by Noon, Wednesday, November 5�', he would recommend allowing six
months for rehabilitation and added that after the six-month period, if the rehabilitation is at least
50% complete, they can request an additional six months.
5. 1421 York Avenue
Chuck Votel, Public Health, reported that they received a letter from a son of the owner
requesting that the ciry proceed with demolishing and assess the cost to taxes. IvSr. Votel stated
Pubiic Health estimates the cost to repair to be more than the building is worth.
Gerry Strathman recommended approval.
6. 694 Snns Avenue
Russell Hamilton, owner, appeazed. Mr. Hamiiton stated that he made an attempt to buy
this property in January from the original owner, Thomas D. Cazlstrom. Pvlr. Hamilton indicated
that Mr. Cazistrom could not produce a title. Lany Williams (Contract for Deed Holder)
abandoned the property and it was sold around August 20` Mr. Hamilton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting tnne to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspecrion
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the buiiding.

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before August 25, 1997, the foliowing are the now

WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the

WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the tune, date, place and
purpose of the public hearings; and

Council on Tuesday, October 21, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfaze and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the CouncIl Hearing; and
R�IEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday,
November 5, 1997 and the testimony and evidence including the action taken by the L.egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1421 York Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Aousing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notificauon requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifreen (15) days after the
date of the Council Hearing.

1 2. If the above correcuve action is not completed within this period of time the Public Health,
2 Code Enforcement Program is hereby authorized to take whatever steps are necessary to
3 demolish and remove this structure, fill the site and charge the costs incuned against the
4 Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive Code.

3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fistures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

this property in January from the original owner, Thomas D. Cazlstrom. Pvlr. Hamilton indicated
that Mr. Cazistrom could not produce a title. Lany Williams (Contract for Deed Holder)
abandoned the property and it was sold around August 20` Mr. Hamilton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting tnne to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspecrion
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the buiiding.
