1 WHEREAS, Public Health has requested the City Council to hold public hearings to consider

10 information obtained by Public Healffi on or before August 25, 1997, the following are the now

15 WHEREAS, Public Heaith has served in accordance with the provisions of Chapter 45 of the
16 5aint Paul I.egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
17 August 12, 1997; and

19 WHEREAS, this order informed the then lrnown interested or responsible parties that the
20 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

22 WHEREAS, this order informed the interested or responsible parties that they must repair or
23 demolish the structure located on the Subject Property by September 11, 1997; and

25 WHEREAS, the enforcement officer has posted a placard on the Subject Propeny declaring
26 this building(s) to constitute a nuisance condition; subject to demolition; and
27
28 WHEREAS, this nuisance condition has not been corrected and Public Health requested that
29 the City Clerk schedule public hearings before the I,egislative Hearing Officer of the City Council
30 and the Saint Paul City Council; and

32 WHEREAS, the interested and responsible parties have been served notice in accordance
33 with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
34 purpose of the public hearings; and

36 WFIEREAS, a hearing was held before the Legislauve Hearing Officer of the Saint Paul City
37 Council on Tuesday, October 21, 1997 to hear testimony and evidence, and after receiving
38 testimony and evidence, made the recommendation to approve the request to order the interested or
39 responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
40 safery and welfare and remove its blighting influence on the community by rehabilitating this
41 structure in accordance with all applicable codes and ordinances, or in the alternative by
42 demolishing and removing the structure in accordance with all applicable codes and ordinances.

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday,
November 5, 1997 and the testimony and evidence including the action taken by the I,egislative
Hearing Officer was considered by the Council; now therefore
BE IT RFSOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Pau1 City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 951 Margaret Street:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
L.egislative Code, Chapter 45.
2. That the costs of demoliuon and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,0�0.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Properry which declares it to
be a nuisance condition subject to demolition.
7. That ttiis building has been routinely monitored by the VacandNuisance Buildings
Code Enforcement Program.
8. ThaC the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Properry safe
and not detrimental to the public peace, healTh, safety and welfare and remove its blighting
influence on the community by rehabilitating tlus structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within ��'°°��� after the

2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter AS of the Saint Paul Legislarive Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Saint Paul Public Health has declazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this properiy. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

STAFF PRESENT: Chuck Votel and Guy Willits.
Gerry Strathman, Legislarive Hearing Officer, called the meeting to order at 10:00 am.
1094 E. Seventh Street
William Bernie, owner of Bernie Pipe Bending and Coil Fabrica6on, advised he has been
in business at that location 35 years. Mr. Bernie stated that some of the pipe laying in the
driveway was for a customer.
Guy Wiliits, Public Health, reported the order mailed October 9`� was to remove
discarded furniture, vehicle parts, scrap wood, building materials, househoid items, rubble, large
metal items, pipes and junk. Mr. Willits also presented Gerry Strathman, Legislative Hearing
Officer, with photographs taken October 8`" - others taken October 15�' showing that everything
had been removed.
Mr. Strathman reminded Mr. Bernie that he is not allowed to have exterior storage in that
azea and recommended denying the appeal.
2. 1160 Conway Street
Lennis Baas, owner, appeared, stating that he had complied with two previous orders to
clean his property.
Chuck Votel, Public Health, presented Gerry Strathman, Legislative Hearing Officer,
with photographs taken October 17�'. After reminding Mr. Bass that motors and stacks of wood
aze not to be stored out in the open in a residential area, Mr. Strathman recommended denying
the appeal.
1840 Minnehaha Avenue East
Cserry Strathman, Legislative Hearing O�cer, reporied that this is a HL1D properry.
Sophie Hallauer had indicated during a telephone conversation that HUD intends to market the
properry and requested an ea�tension of six months to repair or demolish the building. Mr.
Strathman stated that the program supervisor at Public Health indicated that they are unwiiling to
support this request in view of the fact that the building is not suitable for rehabilitation.
Mr. Strathman recommended approving the order to xemove or repair within 15 days.

4. 951 Mar�aret Street
Chuck Votel, Public Health, reported that this building has been vacant since April, 1997,
and that four Summary Abatement notices have been issued.
Larry Zielke, representing Banker's Trust Company of California, National Association -
now the fee owner, appeazed. Mr. Zielke stated that this property was initially sold by the
Veteran's Administration on a Contract for Deed, subsequent to a prior foreclosure. The paper
was purchased by Banker's Trust Company and is serviced by 23ation's Bank Mortgage
Corporation of Kentucky. The Contract for Deed was canceled recenfly. On October ln the
Ramsey County District Court approved a petition for a proceeding, subsequent to the transfer of
the certificate of title to Banker's Trust. Banker's Trust is requesting six months to find a buyer
to bring the property up to code compliance.
Mr. Strathman stated that if Banker's Trust obtains a code compliance inspection and
posts a$2,000 Bond by Noon, Wednesday, November 5`�, he would recommend allowing six
months for rehabilitation and added that after the six-month period, if the rehabilitation is at least
50% complete, they can request an additional six months.
5. 1421 York Avenue
Chuck Votel, Pubiic Health, reported that they received a letter from a son of the owner
requesting that the city proceed with demolishing and assess the cost to taYes. Ivir. Votei stated
Public Heaith estimates the cost to repair to be more than the building is worth.
Gerry Strathman recommended approval.
6. 694 Sims Avenue
Russeil Hamilton, owner, appeared. Mr. Aamilton stated thai he made an attempt to buy
this properiy in January from the original owner, Thomas D. Carlsirom. Mr. Hamilton indicated
that Mr. Carlstzom could not produce a tifle. Larry Wiliiams (Contract for Deed Holder)
abandoned the property and it was sold around August 20 Mr. Hanulton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting time to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspection
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the building.

Saint Paul Public Health has declazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this properiy. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and

Gerry Strathman, Legislarive Hearing Officer, called the meeting to order at 10:00 am.
1094 E. Seventh Street
William Bernie, owner of Bernie Pipe Bending and Coil Fabrica6on, advised he has been
in business at that location 35 years. Mr. Bernie stated that some of the pipe laying in the
driveway was for a customer.
Guy Wiliits, Public Health, reported the order mailed October 9`� was to remove
discarded furniture, vehicle parts, scrap wood, building materials, househoid items, rubble, large
metal items, pipes and junk. Mr. Willits also presented Gerry Strathman, Legislative Hearing
Officer, with photographs taken October 8`" - others taken October 15�' showing that everything
had been removed.
Mr. Strathman reminded Mr. Bernie that he is not allowed to have exterior storage in that
azea and recommended denying the appeal.
2. 1160 Conway Street
Lennis Baas, owner, appeared, stating that he had complied with two previous orders to
clean his property.
Chuck Votel, Public Health, presented Gerry Strathman, Legislative Hearing Officer,
with photographs taken October 17�'. After reminding Mr. Bass that motors and stacks of wood
aze not to be stored out in the open in a residential area, Mr. Strathman recommended denying
the appeal.
1840 Minnehaha Avenue East
Cserry Strathman, Legislative Hearing O�cer, reporied that this is a HL1D properry.
Sophie Hallauer had indicated during a telephone conversation that HUD intends to market the
properry and requested an ea�tension of six months to repair or demolish the building. Mr.
Strathman stated that the program supervisor at Public Health indicated that they are unwiiling to
support this request in view of the fact that the building is not suitable for rehabilitation.
Mr. Strathman recommended approving the order to xemove or repair within 15 days.

4. 951 Mar�aret Street
Chuck Votel, Public Health, reported that this building has been vacant since April, 1997,
and that four Summary Abatement notices have been issued.
Larry Zielke, representing Banker's Trust Company of California, National Association -
now the fee owner, appeazed. Mr. Zielke stated that this property was initially sold by the
Veteran's Administration on a Contract for Deed, subsequent to a prior foreclosure. The paper
was purchased by Banker's Trust Company and is serviced by 23ation's Bank Mortgage
Corporation of Kentucky. The Contract for Deed was canceled recenfly. On October ln the
Ramsey County District Court approved a petition for a proceeding, subsequent to the transfer of
the certificate of title to Banker's Trust. Banker's Trust is requesting six months to find a buyer
to bring the property up to code compliance.
Mr. Strathman stated that if Banker's Trust obtains a code compliance inspection and
posts a$2,000 Bond by Noon, Wednesday, November 5`�, he would recommend allowing six
months for rehabilitation and added that after the six-month period, if the rehabilitation is at least
50% complete, they can request an additional six months.
5. 1421 York Avenue
Chuck Votel, Pubiic Health, reported that they received a letter from a son of the owner
requesting that the city proceed with demolishing and assess the cost to taYes. Ivir. Votei stated
Public Heaith estimates the cost to repair to be more than the building is worth.
Gerry Strathman recommended approval.
6. 694 Sims Avenue
Russeil Hamilton, owner, appeared. Mr. Aamilton stated thai he made an attempt to buy
this properiy in January from the original owner, Thomas D. Carlsirom. Mr. Hamilton indicated
that Mr. Carlstzom could not produce a tifle. Larry Wiliiams (Contract for Deed Holder)
abandoned the property and it was sold around August 20 Mr. Hanulton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting time to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspection
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the building.

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday,
November 5, 1997 and the testimony and evidence including the action taken by the I,egislative
Hearing Officer was considered by the Council; now therefore
BE IT RFSOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Pau1 City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 951 Margaret Street:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
L.egislative Code, Chapter 45.
2. That the costs of demoliuon and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,0�0.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Properry which declares it to
be a nuisance condition subject to demolition.
7. That ttiis building has been routinely monitored by the VacandNuisance Buildings
Code Enforcement Program.
8. ThaC the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Properry safe
and not detrimental to the public peace, healTh, safety and welfare and remove its blighting
influence on the community by rehabilitating tlus structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within ��'°°��� after the

2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter AS of the Saint Paul Legislarive Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Chuck Votel, Pubiic Health, reported that they received a letter from a son of the owner
requesting that the city proceed with demolishing and assess the cost to taYes. Ivir. Votei stated
Public Heaith estimates the cost to repair to be more than the building is worth.
Gerry Strathman recommended approval.

Russeil Hamilton, owner, appeared. Mr. Aamilton stated thai he made an attempt to buy
this properiy in January from the original owner, Thomas D. Carlsirom. Mr. Hamilton indicated
that Mr. Carlstzom could not produce a tifle. Larry Wiliiams (Contract for Deed Holder)
abandoned the property and it was sold around August 20 Mr. Hanulton indicated that he
wasn't aware of everything that was going on with the property before he closed, however, he
feels the house has a very solid structure and is requesting time to rehabilitate it.
Gerry Strathman advised Mr. Hamilton if he would obtain a code compliance inspection
and post a$2,000 bond by Noon, Wednesday, November 5�', he will recommend allowing six
months to rehabilitate the building.
