WHEREAS, the Council of the City of Saint Paul, hy Board File No. 29016, approved Januazy 9,
1909, did vacate certain public rights-of-way, including those avenues and alleys described as:

accompanying Utility Fasement Certificate of Intended Non-Use, filed volunrarily on behalf of
Continental Cablevision, made a part hereof by this reference and filed in the office of the City Clerk
of Saint Paul, the City, for itself and on behalf of Continental Cablevision d oes hereb waive�he-rig�
to the utility easements in the vacated azea descri d abav$; —
BE IT F[IRTHER RESOLVED, that, pursuant to Section 130.06 and with the accompanying Utility
Easement Certificate of Intended Non-Use filed voluntarily on behalf of the Department of Public
Works, made a pan hereof by this reference and filed in the office of the Ciry Clerk of Saint Paul, the
Ciry, for itself and on behalf of the Department of Public Works, does hereby waive the right to the
utility easements in the vacated area described above with the following exception:
The Deparknent of Public Works shall retain a 30 foot wide utility easement for sewer
purposes over, under and across that part of Charles Avenue lying between Wheeler Sueet and
Aldine Street and centered on the centerline of the said Charles Avenue.
