WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
frame structure with a detached, one-stall, wood frame garage located on property hereinafter referred
to as the "Subject Properry" and commonly known as 906 York Avenue. This property is legally
described as follows, to wit:
The West 1/2 of L,ot 10, and all of Lot 11, Charles Weide's Rearrangement of Block 6
of Nelson's Addition to the City of St. Paul
WHEREAS, based upon the records in the Ramsey Counry Recorder's Office and informa6on
obtained by Public Health on or before 7uly 30 1997, the following are the now known interested or
responsible parties for the Subjeci Properry: Rueben Dalbec, 1023 Minnehaha Avenue West, St. Paul,
MN 55104; Dayton's Bluff Community Care Center, 324 Johnson Parkway, St. Paul, MN 55106, Re:
Genevieve Dalbec; Housing and Redevelopment Authority, 25 West Fourth Street, Ste. 1200, St. Paul,
MN 55102; Minnesota Housing Finance Agency, 4Q0 Sibley Street 5te. 3Q0, St. Paul, MN 55101
WHEREAS, Public Health has served in accardance with the provisions of Chapter 45 of the
Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated July
23, 1997; and
WHEREAS, this order informed the then known interested ar responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ox responsible parties that they must repair or
demolish the structure located on the Subject Properry by Aua st 22, 1997; and
WFiEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Aealth requested that the
City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the
Saint Paul City Council; and
WHEREAS, the interested and responslble parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Leaisiauve Code, of the tnne, date, place and purpose
of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties
to make the Subject Property safe and not detrimental to the public peace, health, safery and welfare
and remove its blighting influence on the communiry by rehabilitating this structure in accordance with
ali applicable codes and ordinances, or in the alternauve by demolishing and removing the structure in
accordance with all applicable codes and ordinances. 'The rehabilitation or demolition of the structure
to be completed within fifteen (15) days after the date of the Council Hearing; and
WF3EREAS, a hearing was held before the Saint Paul City Council on VJednesday, October 22,
1997 and the testimony and evidence including the action taken by the I.egislative Hearing O�cer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the foliowing Findings and Order
concerning the Subject Properry at 906 York Avenue:
i. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislafive Code, Chagtex 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the ihen known responsibie
parties to correct the deficiencies or to demolish and remave the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Properry which deciares it to be
a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings Code
Enforcement Program.
8. That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORAER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the communiry by rehabilitating this structure and correcting all deficiencies as prescribed
in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ardinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15� days after the date of the Council
Hearing.

2. If the above conective action is not completed within this period of time the Public Health, Code
Enforcement Program is hereby authorized to take whatever steps are necessary to demolish and
remove this structure, fill the site and charge the costs incurred against the Subject Property
pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all personai
property or fixtures of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If a11
personal properry is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul I.egislative Code.

parties and responsible parties known to the Enforcement Officer were given an order to
repaix or remove the building at 906 York Avenue by August 22, 1997, and have failed to
comply with those orders.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
719 Case Avenue
Guy Wiilits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that ihey had switched trash companies and it was a
few days before everything was picked up.
Gerry Suathman stated that he feit the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Wiliits and Chuck Votel concurred that this was not cieared by the regular
crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.

No one appeared. Gerry Strathman recoinmended approvai.

Neil Schwartz, owner, appeared and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time conswning, due to the fact that there had been trolley
lines running through the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherburne Avenue (Laid over from September 2'�)
James Geske, attomey for Countrywide Home Loans, Inc. appeared, stating that Countrywide
has been the owaer for nine days and is waiting for insttuctions from Fannie Mae with respect to
this property. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They are asking for a short eartension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended fo approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fast (Laid over from September 16�'')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the buiiding, subject to the conditions ihat a$2,000 bond be posted and that all necessary permits
are obtained by noon, October 22° ,:
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie fanuly
dwelling before seIling it.
Gerry Suathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

; � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparnnent
upstairs with her family and use the other as a large office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the buildiag would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire departxnent
inspection of July I 8`" was still valid. Gerry Strathman advised tl�at if that is the case, she wiil
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary gemuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 Jackson Pr
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the buiiding. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
'� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as lazge as a two-caz gazage with no windows, Mr. Votel infozmed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22° , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.
10. 78 Magnolia Avenue West

The West 1/2 of Lot 10, and all of Lot 11, Charles Weide's Rearrangement of

Saint Paul Public Health has deciazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s}.
Inasmuch as this Order to Abate has not been compiied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demoiition and removal, and
to assess the costs incuned against the real estate as a special assessment to be collected in

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
719 Case Avenue
Guy Wiilits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that ihey had switched trash companies and it was a
few days before everything was picked up.
Gerry Suathman stated that he feit the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Wiliits and Chuck Votel concurred that this was not cieared by the regular
crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.

Neil Schwartz, owner, appeared and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time conswning, due to the fact that there had been trolley
lines running through the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherburne Avenue (Laid over from September 2'�)
James Geske, attomey for Countrywide Home Loans, Inc. appeared, stating that Countrywide
has been the owaer for nine days and is waiting for insttuctions from Fannie Mae with respect to
this property. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They are asking for a short eartension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended fo approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fast (Laid over from September 16�'')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the buiiding, subject to the conditions ihat a$2,000 bond be posted and that all necessary permits
are obtained by noon, October 22° ,:
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie fanuly
dwelling before seIling it.
Gerry Suathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

; � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparnnent
upstairs with her family and use the other as a large office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the buildiag would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire departxnent
inspection of July I 8`" was still valid. Gerry Strathman advised tl�at if that is the case, she wiil
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary gemuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 Jackson Pr
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the buiiding. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
'� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as lazge as a two-caz gazage with no windows, Mr. Votel infozmed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22° , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.

WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
frame structure with a detached, one-stall, wood frame garage located on property hereinafter referred
to as the "Subject Properry" and commonly known as 906 York Avenue. This property is legally

WHEREAS, based upon the records in the Ramsey Counry Recorder's Office and informa6on
obtained by Public Health on or before 7uly 30 1997, the following are the now known interested or

MN 55104; Dayton's Bluff Community Care Center, 324 Johnson Parkway, St. Paul, MN 55106, Re:

WHEREAS, Public Health has served in accardance with the provisions of Chapter 45 of the

building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Aealth requested that the
City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the
Saint Paul City Council; and
WHEREAS, the interested and responslble parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Leaisiauve Code, of the tnne, date, place and purpose
of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties
to make the Subject Property safe and not detrimental to the public peace, health, safery and welfare
and remove its blighting influence on the communiry by rehabilitating this structure in accordance with
ali applicable codes and ordinances, or in the alternauve by demolishing and removing the structure in
accordance with all applicable codes and ordinances. 'The rehabilitation or demolition of the structure
to be completed within fifteen (15) days after the date of the Council Hearing; and
WF3EREAS, a hearing was held before the Saint Paul City Council on VJednesday, October 22,
1997 and the testimony and evidence including the action taken by the I.egislative Hearing O�cer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the foliowing Findings and Order
concerning the Subject Properry at 906 York Avenue:
i. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislafive Code, Chagtex 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the ihen known responsibie
parties to correct the deficiencies or to demolish and remave the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Properry which deciares it to be
a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings Code
Enforcement Program.
8. That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORAER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the communiry by rehabilitating this structure and correcting all deficiencies as prescribed
in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ardinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15� days after the date of the Council
Hearing.

2. If the above conective action is not completed within this period of time the Public Health, Code
Enforcement Program is hereby authorized to take whatever steps are necessary to demolish and
remove this structure, fill the site and charge the costs incurred against the Subject Property
pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all personai
property or fixtures of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If a11
personal properry is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Biock 6 of Nelson's Addition to the City of St. Faul.
Saint Paul Public Health has deciazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s}.
Inasmuch as this Order to Abate has not been compiied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demoiition and removal, and
to assess the costs incuned against the real estate as a special assessment to be collected in
the same mam�er as taxes.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
719 Case Avenue
Guy Wiilits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that ihey had switched trash companies and it was a
few days before everything was picked up.
Gerry Suathman stated that he feit the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Wiliits and Chuck Votel concurred that this was not cieared by the regular
crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.

Neil Schwartz, owner, appeared and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time conswning, due to the fact that there had been trolley
lines running through the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherburne Avenue (Laid over from September 2'�)
James Geske, attomey for Countrywide Home Loans, Inc. appeared, stating that Countrywide
has been the owaer for nine days and is waiting for insttuctions from Fannie Mae with respect to
this property. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They are asking for a short eartension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended fo approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fast (Laid over from September 16�'')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the buiiding, subject to the conditions ihat a$2,000 bond be posted and that all necessary permits
are obtained by noon, October 22° ,:
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie fanuly
dwelling before seIling it.
Gerry Suathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

; � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparnnent
upstairs with her family and use the other as a large office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the buildiag would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire departxnent
inspection of July I 8`" was still valid. Gerry Strathman advised tl�at if that is the case, she wiil
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary gemuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 Jackson Pr
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the buiiding. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
'� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as lazge as a two-caz gazage with no windows, Mr. Votel infozmed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22° , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.
10. 78 Magnolia Avenue West
