1 VJHEREAS, Public Health has requested the Ciry Council to hold public hearings to consider
2 the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
3 frame dwelling located on properry hereinafter referred to as the "Subject Property" and commonly
A laiown as 1561 Jackson Street. This properry is legally described as follows, to wit:

8 WHEREAS, based upon the records in the Ramsey Counry Recorder's Office and
9 information obtained by Public Health on or before Apri17, 1997, the following are the now known
10 interested or responsible parties for the Subject Progerty: Thomas 7. Hoff, 64 Garfield Street, St.
11 Paul, MN 55102

13 WHEREAS, Public Health has served in accordance with the prov3sions of Chapter 45 of the
14 Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
15 Apxi14, 1997; and

17 WHEREAS, this order informed the then known interested or responsible parties that the
18 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
19
20 WAEREAS, this order informed the interested or responsibie parties that they must repair or
21 demolish the structure located on the Subject Property by May 5, 1997; and
22
23 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
24 this building(s) to constitute a nuisance condition; subject to demolition; and
as
26 WHEREAS, this nuisance condition has not been corrected and Pubiic Health requested that
27 the City Clerk schedule public hearings before the Legislative Hearing O�cer of the City Council
28 and the Saint Paul Ciry Council; and

30 WHBREAS, the interested and responsible parties have been served notice in accordance
31 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tnne, date, place and
32 purpose of the public hearings; and

34 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul Ciry
35 Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testimony
36 and evidence, made the recommendation to agprove the request to order the interested or responsible
37 parties to make the Subject Property safe and not detrimental to the public peace, health, safery and
38 welfare and remove its blighting influence on the community by rehabilitating this structure in
39 accordance with all applicable codes and ordinances, or in the alternative by demolishing and
40 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
41 demolition of the structure to be completed within fifteen (15) days after the date of the Council
42 Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October
22, 1947 and the testimony and evidence including the action taken by the Izgislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 1561 3ackson Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Heaith has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantiNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilied.
ORDER
The Saint Paui City Council hereby makes the following order:
1. The above referenced 'anterested or responsible parties shall make the Subject Property safe
and not deuimentai to the public peace, health, safery and welPare and remove its blighting
influence on the communiry by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all appiicable codes and ordinances. The rehabilitation or
demoliuon and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Public Aealth,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incuned against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this tune period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

the recommendation of Public Health that ihe City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Fiealth to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

STAFF PRESENT: Chuck Votel, Guy Willits, Roxanna Flink, Cathy Ries and Dick Lippert
Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleared by the regular
crew and that there were probiems.
Mr. Strathman recommended that the assessment be deleted.
2. 613 Minnehaha Avenue East
No one appeared. Gerry Strathman recoinmended approval.
3. 694 Sims Avenue
No one appeazed. Gerry Strathman recommended approval.
4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repau was compiete. Dick Lippert,
Public Health, confumed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more tnne consuming, due to the fact that there had been trolley
lines running through ffie azea.
Mr. Strathman recommended that the matter be closed.

S. 1451 Sherburne Avenue (Laid over from September 2°�)
James Geske, attomey for Coun�vide Home Loans, Inc. appeared, stating that Countrywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this properiy has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regazding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fa�r (Laid over from September 16`")
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which wouid require pernuts.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a r
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this buiiding by converting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22nd , he be given 180
days to rehabilitate the building.

� 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparhnent
upstairs with her family and use the other as a lazge office area. She indicated that the dowastairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspection of July 18�' was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary permits by noon, October 22°�, she be given six months to
rehabilitate the building.
9. J561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16`� states that the building
is a gutted shell about as lazge as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standazds with azchitectural drawings and specifications would
be necessazy.
If the $2,000 bond is posted by noon, October 22°d , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilif�tion.
10. 78 Magnolia Avenue West
No one appeazed. Gerry Strathman recommended that the order be approved.
11. 906 York Avenue
No one appeared. Gerry StraUunan recommended that the order be approved.

the recommendation of Public Health that ihe City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Fiealth to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

STAFF PRESENT: Chuck Votel, Guy Willits, Roxanna Flink, Cathy Ries and Dick Lippert
Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleared by the regular
crew and that there were probiems.
Mr. Strathman recommended that the assessment be deleted.
2. 613 Minnehaha Avenue East
No one appeared. Gerry Strathman recoinmended approval.
3. 694 Sims Avenue
No one appeazed. Gerry Strathman recommended approval.
4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repau was compiete. Dick Lippert,
Public Health, confumed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more tnne consuming, due to the fact that there had been trolley
lines running through ffie azea.
Mr. Strathman recommended that the matter be closed.

S. 1451 Sherburne Avenue (Laid over from September 2°�)
James Geske, attomey for Coun�vide Home Loans, Inc. appeared, stating that Countrywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this properiy has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regazding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fa�r (Laid over from September 16`")
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which wouid require pernuts.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a r
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this buiiding by converting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22nd , he be given 180
days to rehabilitate the building.

� 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparhnent
upstairs with her family and use the other as a lazge office area. She indicated that the dowastairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspection of July 18�' was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary permits by noon, October 22°�, she be given six months to
rehabilitate the building.
9. J561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16`� states that the building
is a gutted shell about as lazge as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standazds with azchitectural drawings and specifications would
be necessazy.
If the $2,000 bond is posted by noon, October 22°d , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilif�tion.
10. 78 Magnolia Avenue West
No one appeazed. Gerry Strathman recommended that the order be approved.
11. 906 York Avenue
No one appeared. Gerry StraUunan recommended that the order be approved.

13 WHEREAS, Public Health has served in accordance with the prov3sions of Chapter 45 of the
14 Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated

17 WHEREAS, this order informed the then known interested or responsible parties that the
18 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

20 WAEREAS, this order informed the interested or responsibie parties that they must repair or
21 demolish the structure located on the Subject Property by May 5, 1997; and

23 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
24 this building(s) to constitute a nuisance condition; subject to demolition; and
as
26 WHEREAS, this nuisance condition has not been corrected and Pubiic Health requested that
27 the City Clerk schedule public hearings before the Legislative Hearing O�cer of the City Council
28 and the Saint Paul Ciry Council; and

30 WHBREAS, the interested and responsible parties have been served notice in accordance
31 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tnne, date, place and
32 purpose of the public hearings; and

34 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul Ciry
35 Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testimony
36 and evidence, made the recommendation to agprove the request to order the interested or responsible
37 parties to make the Subject Property safe and not detrimental to the public peace, health, safery and
38 welfare and remove its blighting influence on the community by rehabilitating this structure in
39 accordance with all applicable codes and ordinances, or in the alternative by demolishing and
40 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
41 demolition of the structure to be completed within fifteen (15) days after the date of the Council
42 Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October
22, 1947 and the testimony and evidence including the action taken by the Izgislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 1561 3ackson Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Heaith has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantiNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilied.
ORDER
The Saint Paui City Council hereby makes the following order:
1. The above referenced 'anterested or responsible parties shall make the Subject Property safe
and not deuimentai to the public peace, health, safery and welPare and remove its blighting
influence on the communiry by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all appiicable codes and ordinances. The rehabilitation or
demoliuon and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Public Aealth,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incuned against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this tune period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

� MINUTES OP LEGISLATIVE HEARING

STAFF PRESENT: Chuck Votel, Guy Willits, Roxanna Flink, Cathy Ries and Dick Lippert
Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing gazbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleared by the regular
crew and that there were probiems.
Mr. Strathman recommended that the assessment be deleted.
2. 613 Minnehaha Avenue East
No one appeared. Gerry Strathman recoinmended approval.
3. 694 Sims Avenue
No one appeazed. Gerry Strathman recommended approval.
4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repau was compiete. Dick Lippert,
Public Health, confumed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more tnne consuming, due to the fact that there had been trolley
lines running through ffie azea.
Mr. Strathman recommended that the matter be closed.

S. 1451 Sherburne Avenue (Laid over from September 2°�)
James Geske, attomey for Coun�vide Home Loans, Inc. appeared, stating that Countrywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the properry themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this properiy has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regazding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue Fa�r (Laid over from September 16`")
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there aze some needed repairs which wouid require pernuts.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a r
6. 800 Como Avenue
Burton Murdock, owner, appeazed, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this buiiding by converting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22nd , he be given 180
days to rehabilitate the building.

� 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one aparhnent
upstairs with her family and use the other as a lazge office area. She indicated that the dowastairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspection of July 18�' was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary permits by noon, October 22°�, she be given six months to
rehabilitate the building.
9. J561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16`� states that the building
is a gutted shell about as lazge as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standazds with azchitectural drawings and specifications would
be necessazy.
If the $2,000 bond is posted by noon, October 22°d , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilif�tion.
10. 78 Magnolia Avenue West
No one appeazed. Gerry Strathman recommended that the order be approved.
11. 906 York Avenue
No one appeared. Gerry StraUunan recommended that the order be approved.
