RTHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a two-story,
concrete brick and wood frame commercial structure with an attached, oversized, brick and wood

WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul L.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
3uly 31, 1997; and
WHEREAS, this order informed the then laiown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuani to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 2, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condiuon; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council
and the Saint Paul City Council; and
WHBREAS, the interested and responsibte parties have been senred notice in accordance
with the provisions of Chapter 45 of the Saint Paul L.egislative Code, of the time, date, place and

VJHEREAS, a hearing was held before the L.egislafive Hearing Officer of the Saint Paul Ciry
Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the S�bject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this siructure in
accordance with all applicable codes and ordinances, or in the alternative by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or

BE IT RESOLVED that based upon the testimony and evidence presented at the aboe��
referenced public hearings, the Saint Paul Ciry Council hereby adopts the following Findings and
Order concerning the Subject Properry at 203 Forbes Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this build"ang(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properiy.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s�.
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Properiy which declazes it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resoluuon and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:

1. The above referenced interested or respons3ble parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabIlitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed wi ' after the
date of the Council Aearing. � S iX ��l rro r.�s
2. If the above conective action is not completed within this period of time the Publ'ac Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incuned against the
Subject Property pursuantto the provisions of Chapter 45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If ail personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
It is fiurther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Pau1 Legislative Code.

Gerry Strathman, Legislative Heariug Officer, called the meeting to order at 10:00 am.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overtlowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everyihing was picked up.
Getry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
crew and that there were problems.
Mr. 5trathman recommended that the assessment be deleted.

No one appeared. Gerry Strathman recoYnmended approval.

4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more �tensive, and therefore more time consuming, due to the fact that there had been trolley
lines running through the azea.
Mr. Strathman recommended that the matter be closed.

� 5. 1451 Sherburne Avenue (Laid over from September 2"�)
James Geske, attomey for Countrywide Home Loans, Iac. appeared, stating that Counhywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking piace there. Beth Itandall
from a local non-pmfit housing group in the community scated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue East (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Reaitor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
� Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated 7u1y 16�'
which indicates there are some needed repairs which wouid require permits.
Gerry Stratluuan recommended that ths City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a
6. 800 Como Avenue
Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate tivs building by converting it back into a single fanuly
dwelling before selling it.
Gerry Strathman recommended that if Mr. Mwdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"° , he be given 180
days to rehabilitate the building.

, � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her family and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt aiso stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspeetion of July 18'" was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary pernuts by noon, October 22" she be given six months to
rehabilitate the building.
9. 1561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the properry was purchased in May, 1995.
� Chuck Votei, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22n , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.

BE IT RESOLVED that based upon the testimony and evidence presented at the aboe��
referenced public hearings, the Saint Paul Ciry Council hereby adopts the following Findings and
Order concerning the Subject Properry at 203 Forbes Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this build"ang(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properiy.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s�.
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Properiy which declazes it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resoluuon and that the notification requirements of Chapter 45 have been fulfilled.

1. The above referenced interested or respons3ble parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabIlitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed wi ' after the

2. If the above conective action is not completed within this period of time the Publ'ac Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incuned against the
Subject Property pursuantto the provisions of Chapter 45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsible parties by the end of this time period.
If ail personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
It is fiurther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Pau1 Legislative Code.

Gerry Strathman, Legislative Heariug Officer, called the meeting to order at 10:00 am.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overtlowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everyihing was picked up.
Getry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
crew and that there were problems.
Mr. 5trathman recommended that the assessment be deleted.

4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more �tensive, and therefore more time consuming, due to the fact that there had been trolley
lines running through the azea.
Mr. Strathman recommended that the matter be closed.

� 5. 1451 Sherburne Avenue (Laid over from September 2"�)
James Geske, attomey for Countrywide Home Loans, Iac. appeared, stating that Counhywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking piace there. Beth Itandall
from a local non-pmfit housing group in the community scated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue East (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Reaitor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
� Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated 7u1y 16�'
which indicates there are some needed repairs which wouid require permits.
Gerry Stratluuan recommended that ths City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a
6. 800 Como Avenue
Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate tivs building by converting it back into a single fanuly
dwelling before selling it.
Gerry Strathman recommended that if Mr. Mwdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"° , he be given 180
days to rehabilitate the building.

Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her family and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt aiso stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspeetion of July 18'" was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary pernuts by noon, October 22" she be given six months to
rehabilitate the building.
9. 1561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the properry was purchased in May, 1995.
� Chuck Votei, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22n , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.

2. If the above conective action is not completed within this period of time the Publ'ac Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to

In the event the building is to be demolished and removed by the Ciry of Saint Paul, all

Gerry Strathman, Legislative Heariug Officer, called the meeting to order at 10:00 am.
1. 719 Case Avenue
Guy Willits, Public Health, presented a video showing overtlowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everyihing was picked up.
Getry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
crew and that there were problems.
Mr. 5trathman recommended that the assessment be deleted.

4. 662 Burr Street
Neil Schwartz, owner, appeazed and stated that the sewer repair was compiete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more �tensive, and therefore more time consuming, due to the fact that there had been trolley
lines running through the azea.
Mr. Strathman recommended that the matter be closed.

� 5. 1451 Sherburne Avenue (Laid over from September 2"�)
James Geske, attomey for Countrywide Home Loans, Iac. appeared, stating that Counhywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
this property. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking piace there. Beth Itandall
from a local non-pmfit housing group in the community scated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 Minnehaha Avenue East (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, Jr., the owner, stated that most of the repairs have been
made and that Sunset Reaitor, Ken Lazson, had sold for the property for $29,085 just before it
was condemned.
� Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated 7u1y 16�'
which indicates there are some needed repairs which wouid require permits.
Gerry Stratluuan recommended that ths City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary permits
aze obtained by noon, October 22"a
6. 800 Como Avenue
Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate tivs building by converting it back into a single fanuly
dwelling before selling it.
Gerry Strathman recommended that if Mr. Mwdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"° , he be given 180
days to rehabilitate the building.

, � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her family and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt aiso stated that the rear portion of the building would be used for storage
purposes only.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspeetion of July 18'" was still valid. Gerry Strathman advised that if that is the case, she will
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary pernuts by noon, October 22" she be given six months to
rehabilitate the building.
9. 1561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the properry was purchased in May, 1995.
� Chuck Votei, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-caz garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22n , Mr. Strathman recommended giving the
owner 180 days to complete the rehabilifation.
10. 78 Magnolia Avenue Wecr
