1 WFiEREAS, Public Health has requested the City Council to hold public hearings to consider

9 WEiEREAS, based upon the records in the Ramsey County Recorder's Office and
10 information obtained by Public Health on or before July 30, 1997, the following are the now known
11 interested or responsible parties for the Subject Property: Burton A. & Diane A. Murdock, 2082
12 East Kenwood Drive, St. Paul, MN 55117-2234; Westem State Bank, 663 University Avenue, St.

15 WHEREAS, Public Health has served in accordance w9th the provisions of Chapter 45 of the
16 Saint Pau1 I,egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
1? July 22, 1997; and

19 WHEREAS, this order informed the then known interested or responsible part3es that the
20 structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and

22 WF3EREAS, this order informed the interested or responsible parties that they must repair or
23 demolish the structure located on the Subject Property by August 21, 1997; and
24
25 WHEREAS, the enforcement officer has posted a placard on the Sub}ect Property declaring
26 this building(s) to constitute a nuisance condition; subject to demolition; and
27
28 WHEREAS, this nuisance condition has not been corrected and Public Health requested that
29 the Ciry Clerk schedule public hearings before the I.egislauve Hearing Officer of the City Council
30 and the Saint Paul Ciry Council; and

32 WHEREAS, the interested and responsible parties have been served notice in accordance
33 with the provisions of Chapter 45 of the Saint Paul L,egislative Code, of the time, date, place and
34 purpose of the public hearings; and

36 WHEREAS, a hearing was held before she L,egislative Hearing Officer of the Saint Paul City
37 Council on Tuesday, October 7, 1997 to hear testimony and evidence, and after receiving testunony
38 and evidence, made the recommendation to approve the request to order the 9nterested or responsible
39 parties to make the 5ubject Property safe and not detrunental Yo the public peace, health, safery and
40 welfare and remove its blighting influence on the communiry by rehabilitating this structure in
41 accordance with al1 apglicable codes and ordinances, or in the alternative by demolishing and
42 removing the stnxcture iri accordance with a11 applicable codes and ordinances. The rehabilitation or
43 demolition of the structure to be completed within fifteen (15) days after the date of the Council
44 Hearing; and

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, October
22, 1997 and the testimony and evidence including the action taken by the Legislauve Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at ffie above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 800 Como Avenue:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
L.egislaUve Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated ta exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That 1'ublic Health has posted a placazd on the Subject Properry which declares it to
be a nuisance condiuon subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8, That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the followir�g order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demalishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed withi ��� after the

2. If the above conective action is not completed within this period of time the Public Iiealth,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paui Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind w}uch interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
4. It is further ordered, that a copy of this resolution be maIled to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Gerry Strathman, Legislative Fiearing Officer, called the meeting to order at 10:40 am.
719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
� crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.
2. (13 Minnehaha Avenue Fast
No one appeared. Gerry Strathman recoinmended approval.

No one appeared. Gerry Strathman recommended approval.
4. 662 Burr Sueet
Neil Schwattz, owner, appeazed and stated that the sewer repair was complete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time consutning, due to the fact that there had been trolley
lines running tiuough the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherbume Avenue (Laid over from September 2°�}
James Creske, attorney for Countrywide Home Loans, Inc. appeared, stating that Coun�ywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
tlus pmperry. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time Yo make
that determination.
Several neighbors spoke indicating that tlus properry has been an eyesore for yeazs, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 MSnnehaha Avenue Fast (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, 3r., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the properiy for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16�'
which indicates there are some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the build'ang, subject to the condiGons that a$2,000 bond be posted and that all necessazy pernuts
are obtained by noon, October 22"a h

Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

, � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeazed, advising that she intends to occupy one apartment
upstairs with her fanuly and use the other as a lazge office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes oniy.
Ms. Pratt stated that she had spoken with Phil Owens and understood tHat the fire department
inspection of July 18`" was still valid. Gerry Stratbman advised that if that is the case, she will
not have to have another inspecrion done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessazy pernuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 3ackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeazed, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Aealth, noted that the code compliance of May 16�`` states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22nd , Mr. Sizathman recommended giving the
owner 180 days to complete the rehabilif�tion.

Saint Paul Public Health has deciazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Pubiic Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by conecting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the

manner, and failing that, authorize Public Heaith to proceed to demolition and removai, and

Gerry Strathman, Legislative Fiearing Officer, called the meeting to order at 10:40 am.
719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
� crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.
2. (13 Minnehaha Avenue Fast
No one appeared. Gerry Strathman recoinmended approval.

No one appeared. Gerry Strathman recommended approval.
4. 662 Burr Sueet
Neil Schwattz, owner, appeazed and stated that the sewer repair was complete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time consutning, due to the fact that there had been trolley
lines running tiuough the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherbume Avenue (Laid over from September 2°�}
James Creske, attorney for Countrywide Home Loans, Inc. appeared, stating that Coun�ywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
tlus pmperry. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time Yo make
that determination.
Several neighbors spoke indicating that tlus properry has been an eyesore for yeazs, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 MSnnehaha Avenue Fast (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, 3r., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the properiy for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16�'
which indicates there are some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the build'ang, subject to the condiGons that a$2,000 bond be posted and that all necessazy pernuts
are obtained by noon, October 22"a h

Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

, � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeazed, advising that she intends to occupy one apartment
upstairs with her fanuly and use the other as a lazge office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes oniy.
Ms. Pratt stated that she had spoken with Phil Owens and understood tHat the fire department
inspection of July 18`" was still valid. Gerry Stratbman advised that if that is the case, she will
not have to have another inspecrion done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessazy pernuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 3ackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeazed, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Aealth, noted that the code compliance of May 16�`` states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22nd , Mr. Sizathman recommended giving the
owner 180 days to complete the rehabilif�tion.

40 welfare and remove its blighting influence on the communiry by rehabilitating this structure in

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, October
22, 1997 and the testimony and evidence including the action taken by the Legislauve Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at ffie above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 800 Como Avenue:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
L.egislaUve Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated ta exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That 1'ublic Health has posted a placazd on the Subject Properry which declares it to
be a nuisance condiuon subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8, That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the followir�g order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demalishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed withi ��� after the

2. If the above conective action is not completed within this period of time the Public Iiealth,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paui Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind w}uch interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
4. It is further ordered, that a copy of this resolution be maIled to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Saint Paul Public Health has deciazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Pubiic Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by conecting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Heaith to proceed to demolition and removai, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

STAFF PRESENT: Chuck Votel, Guy VJillits, Roxanna Flink, Cathy Ries and Dick Lippert
Gerry Strathman, Legislative Fiearing Officer, called the meeting to order at 10:40 am.
719 Case Avenue
Guy Willits, Public Health, presented a video showing overflowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeared and stated that they had switched trash companies and it was a
few days before everything was picked up.
Gerry Strathman stated that he felt the assessment of $207.00 was excessive for the amount of
cleanup required. Mr. Willits and Chuck Votel concurred that this was not cleazed by the regular
� crew and that there were problems.
Mr. Strathman recommended that the assessment be deleted.

4. 662 Burr Sueet
Neil Schwattz, owner, appeazed and stated that the sewer repair was complete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time consutning, due to the fact that there had been trolley
lines running tiuough the area.
Mr. Strathman recommended that the matter be closed.

5. 1451 Sherbume Avenue (Laid over from September 2°�}
James Creske, attorney for Countrywide Home Loans, Inc. appeared, stating that Coun�ywide
has been the owner for nine days and is waiting for instructions from Fannie Mae with respect to
tlus pmperry. Mr. Geske added that, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time Yo make
that determination.
Several neighbors spoke indicating that tlus properry has been an eyesore for yeazs, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randall
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Strathman recommended to approve the order to repair or remove within 15 days.
5. 613 MSnnehaha Avenue Fast (Laid over from September 16�')
Tim Nelson, a friend of Clarence Leaf, 3r., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the properiy for $29,085 just before it
was condemned.
Mr. Nelson acknowledged the fact that he has a copy of an inspection report dated July 16�'
which indicates there are some needed repairs which would require permits.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the build'ang, subject to the condiGons that a$2,000 bond be posted and that all necessazy pernuts
are obtained by noon, October 22"a h

Burton Murdock, owner, appeared, and advised he has owned this property since 1959 and
stated that he intends to rehabilitate this building by converting it back into a singie family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays the vacant building fee, posts a
$2,000 bond and obtains a code compliance inspection by noon, October 22"d , he be given 180
days to rehabilitate the building.

, � 8. 203 Forbes Avenue
Clodetta Pratt, the new owner, appeazed, advising that she intends to occupy one apartment
upstairs with her fanuly and use the other as a lazge office azea. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
purposes oniy.
Ms. Pratt stated that she had spoken with Phil Owens and understood tHat the fire department
inspection of July 18`" was still valid. Gerry Stratbman advised that if that is the case, she will
not have to have another inspecrion done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessazy pernuts by noon, October 22n she be given six months to
rehabilitate the building.
9. 1561 3ackson Street
Gerry Strathman advised that he has had a number of telephone conversations with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeazed, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Aealth, noted that the code compliance of May 16�`` states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22nd , Mr. Sizathman recommended giving the
owner 180 days to complete the rehabilif�tion.

No one appeazed. Gerry Strathman recommended that the order be approved.
