Dear Mr. Kester:
Pursuant to your request, we have scheduled a public hearing
concerning your license application for a Taxicab Driver's License
before the Saint Paul City Council. The hearing is scheduled to
begin at 4:30 p.m., Wednesday, October 22, 1997, and will be held
in the City Council Chambers, Third Floor, Saint Paul City Hall and
Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing based on your
statements during our telephone conversation that you do not
contest the facts concerning your multiple traffic violations, but
have asked to be allowed to address the City Council to argue
against the recommendation for denial of your license application.

Dear Mr. Kester:
The Office of License, Inspections and Environmental Protection is
recommending denial of your application for a taxicab driver's
license because you do not meet the qualifications for licensing,
as set forth below:
Saint Paul Legislative Code §376.16(e(5)b.
requires that new applicaats for a taxicab
driver's license have no more thaa four(4)
moving violatioas withia the last three (3)
years, aad no moze thaa two (2) moviag
violatioas ia the last year. Your driver's
license record ahows that you have eight
moviag violations ia the last four years, six
of which are within the last two years. They
are: 2/7/97 - driving after withdrawal;
lU/30{96 - driving after withdrawal;
SO/18/96 - speed; 8j14//96 - fail to obey
siga; 8/14/96 - driviag after withdrawal;
10/11/95 - fail to obey siga; 4J3/95 - follow
too close; 2/3/95 - speed.
Chapter 364 of the Minnesota Statutes requires that the City inform
you of certain matters.
First, the grounds and reasons for the denial of the license. The
basis £or denial of your taxicab driver's license is set forth
above.
Second, you are entitled to have any complaints or grievances
concerning this decision processed and adjudicated in accordance
with the procedures set forth in §310,05 of the Saint Paul
Legislative Code, which procedures are substantially similar to
those required by the state administrative procedures act, Minn.

Stat. §§14.57-14.69. Section 310.05 entitles you to a hearing
before an administrative law judge or the City Council, based upon
whether you contest the facts alleged above.
If you wish to contest the facts stated above, you are entitled to
a hearing be£ore an administrative law judge, who will make
findings o� fact, conclusions and recommendations concerning your
license application, and will present those findings and
recommendation to the City Council for a final determination.
If you do not wish to contest the facts, but wish to continue the
application process, you may admit the facts stated above and have
a hearing be£ore the City Council, who would make a final
determination on the application.
Third, the earliest date on which you may reapply for a taxi
driver's license will be one year from the date your current
license is denied by the City of Saint Paul. At that time,
however, you would still be required to meet al1 of the
requirements of the ordinance for a taxicab driver's license.
Fourth, if you reapply, the City of Saint Paul will consider all
competent evidence of rehabilitation that you wish to present.
Examples of the type of evidence that wi11 be considered are set
forth in Minn. Stat. §364.03.
If you wish to have a hearing on this matter before either an
administrative law judge or the City Council, you must contact me
in writing by Monday, September 15, 1997. If I do not hear from
you, I will assume that you are withdrawing your application for a
taxicab driver's license at this time. If you have any questions,
please feel free to contact me at 266-8710.

Dear Mr. Kester:
Pursuant to your request, we have scheduled a public hearing
concerning your license application for a Taxicab Driver's License
before the Saint Paul City Council. The hearing is scheduled to
begin at 4:30 p.m., Wednesday, October 22, 1997, and will be held
in the City Council Chambers, Third Floor, Saint Paul City Hall and
Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing based on your
statements during our telephone conversation that you do not
contest the facts concerning your multiple traffic violations, but
have asked to be allowed to address the City Council to argue
against the recommendation for denial of your license application.

Dear Mr. Kester:
The Office of License, Inspections and Environmental Protection is
recommending denial of your application for a taxicab driver's
license because you do not meet the qualifications for licensing,
as set forth below:
Saint Paul Legislative Code §376.16(e(5)b.
requires that new applicaats for a taxicab
driver's license have no more thaa four(4)
moving violatioas withia the last three (3)
years, aad no moze thaa two (2) moviag
violatioas ia the last year. Your driver's
license record ahows that you have eight
moviag violations ia the last four years, six
of which are within the last two years. They
are: 2/7/97 - driving after withdrawal;
lU/30{96 - driving after withdrawal;
SO/18/96 - speed; 8j14//96 - fail to obey
siga; 8/14/96 - driviag after withdrawal;
10/11/95 - fail to obey siga; 4J3/95 - follow
too close; 2/3/95 - speed.
Chapter 364 of the Minnesota Statutes requires that the City inform
you of certain matters.
First, the grounds and reasons for the denial of the license. The
basis £or denial of your taxicab driver's license is set forth
above.
Second, you are entitled to have any complaints or grievances
concerning this decision processed and adjudicated in accordance
with the procedures set forth in §310,05 of the Saint Paul
Legislative Code, which procedures are substantially similar to
those required by the state administrative procedures act, Minn.

Stat. §§14.57-14.69. Section 310.05 entitles you to a hearing
before an administrative law judge or the City Council, based upon
whether you contest the facts alleged above.
If you wish to contest the facts stated above, you are entitled to
a hearing be£ore an administrative law judge, who will make
findings o� fact, conclusions and recommendations concerning your
license application, and will present those findings and
recommendation to the City Council for a final determination.
If you do not wish to contest the facts, but wish to continue the
application process, you may admit the facts stated above and have
a hearing be£ore the City Council, who would make a final
determination on the application.
Third, the earliest date on which you may reapply for a taxi
driver's license will be one year from the date your current
license is denied by the City of Saint Paul. At that time,
however, you would still be required to meet al1 of the
requirements of the ordinance for a taxicab driver's license.
Fourth, if you reapply, the City of Saint Paul will consider all
competent evidence of rehabilitation that you wish to present.
Examples of the type of evidence that wi11 be considered are set
forth in Minn. Stat. §364.03.
If you wish to have a hearing on this matter before either an
administrative law judge or the City Council, you must contact me
in writing by Monday, September 15, 1997. If I do not hear from
you, I will assume that you are withdrawing your application for a
taxicab driver's license at this time. If you have any questions,
please feel free to contact me at 266-8710.

arguments as may have been presented to the Council at the pnblic hearing. The facts were not

Dear Mr. Kester:
The Office of License, Inspections and Environmental Protection is
recommending denial of your application for a taxicab driver's
license because you do not meet the qualifications for licensing,
as set forth below:
Saint Paul Legislative Code §376.16(e(5)b.
requires that new applicaats for a taxicab
driver's license have no more thaa four(4)
moving violatioas withia the last three (3)
years, aad no moze thaa two (2) moviag
violatioas ia the last year. Your driver's
license record ahows that you have eight
moviag violations ia the last four years, six
of which are within the last two years. They
are: 2/7/97 - driving after withdrawal;
lU/30{96 - driving after withdrawal;
SO/18/96 - speed; 8j14//96 - fail to obey
siga; 8/14/96 - driviag after withdrawal;
10/11/95 - fail to obey siga; 4J3/95 - follow
too close; 2/3/95 - speed.
Chapter 364 of the Minnesota Statutes requires that the City inform
you of certain matters.
First, the grounds and reasons for the denial of the license. The
basis £or denial of your taxicab driver's license is set forth
above.
Second, you are entitled to have any complaints or grievances
concerning this decision processed and adjudicated in accordance
with the procedures set forth in §310,05 of the Saint Paul
Legislative Code, which procedures are substantially similar to
those required by the state administrative procedures act, Minn.

Stat. §§14.57-14.69. Section 310.05 entitles you to a hearing
before an administrative law judge or the City Council, based upon
whether you contest the facts alleged above.
If you wish to contest the facts stated above, you are entitled to
a hearing be£ore an administrative law judge, who will make
findings o� fact, conclusions and recommendations concerning your
license application, and will present those findings and
recommendation to the City Council for a final determination.
If you do not wish to contest the facts, but wish to continue the
application process, you may admit the facts stated above and have
a hearing be£ore the City Council, who would make a final
determination on the application.
Third, the earliest date on which you may reapply for a taxi
driver's license will be one year from the date your current
license is denied by the City of Saint Paul. At that time,
however, you would still be required to meet al1 of the
requirements of the ordinance for a taxicab driver's license.
Fourth, if you reapply, the City of Saint Paul will consider all
competent evidence of rehabilitation that you wish to present.
Examples of the type of evidence that wi11 be considered are set
forth in Minn. Stat. §364.03.
If you wish to have a hearing on this matter before either an
administrative law judge or the City Council, you must contact me
in writing by Monday, September 15, 1997. If I do not hear from
you, I will assume that you are withdrawing your application for a
taxicab driver's license at this time. If you have any questions,
