RESOLVED, that upon the petition of David J. Erickson, per Finance Department File
Number 2-1997, public properties herinafter described are hereby vacated and discontinued as
public property; and, subject to the herein stated exceptions, the easements within those public
properties are hereby released.
The vacated are is described as follows:
That part of Victoria Street iying within the following described line:
From the southeast corner of Lot 6, Biock 5, The Strand Addition; thence
northerly along the east line of the said Lot 6 a distance of 36.00 feet to the point
of beginning; thence easterly alon� a line perpendicular to the said east line a
distance of 1.50 feet; thence northerly alon� a line paraile] to the said east line a
distance of 50.00 feet; thence westeriy along a line perpendicu]ar to the said east
line a distance of Z.00 feet; thence southerly alon� said east line a distance of 1.50
feet to the point of be�inning.
This vacation shall be sub}ect to the terms and conditions of Chapter 130, codified March 1,
1981, of the Saint Paul L.egislative Code as amended, and to the following conditions:
1. That this vacation shail be only temporary. Upon demolition of the encroaching
building, the above described property shall reveR to public right-of-way.
2. That�the petitioner's, their successors and assigns shall pay $500.00 as an
administrative fee for this vacation which is due and payable within 60 days of the
effective date of this resolution.
3. That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States
Power Company, District Energy St. Paul, Incorporated, MCI Metro, Continental
Cablevision, the Water Utility, and the Department of Public Works, made a part
hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City,
for itself and on behalf of these corporations and departments does hererby waive the
right to the utility easements in the vacated area described above for the lifetime of the
encroaching structure, such easements to be reinstated following demolition of the said
structure.

harmless the City of Saint Paul, its officers, and employees from all suiu, actions, or
claims of any character brought as a result of injuries or damages received or sustained
by any person, persons, or properry on account of this vacation or petitioner's use of
this property, inciuding but not limited to a claim brought because of any act of
omission, neglect, or misconduct of said petitioner or because of any claims or liability
arising from any violation of any law or regulation made in accordance with the law,
wheflier by the petitioner or any oP their agents or employees
4. That the petitioner's their successors, and assigns, shall within 60 days of the effective
date of this resolution, file with the City Clerk an acceptance in writing of the
conditions of this resolution and shall within the period(s) specified in the terms and
conditions of this resolution, comp(y in all respects with these terms and conditions.
