1 BE IT RESOLVED, that, upon the petition of Port Authority of Saint Paul, as documented in
2 Finance Departrnent File Number 18-97, public properties hereinafter described are hereby vacated
3 and discontinued as public propeny: and, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.

That the petitioner's, their successors and assigns shall pay $500.00 as an admimstrative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That a permanent utility easement shall be retained within the vacated area to protect the
interest of Northern States Power Company..
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company Electric, District Energy St. Paul, Incorporated, MCI Telecommunications
Corporation, Continental Cablevision, The Water Utility, and The Department of Public
Works, made a part hereof by this reference and filed in the office of the City Clerk of Saint
Paul, the City, for itself and on behalf of these corporations and departments, waive the right
to the utility easements in the vacated area described above.
That the petitioner's their successors, and assigns agree to indemnify, defend and save
harniless the City of Saint Paul, its officers, and employees from all suits, actions, or clanns of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or properry on account of this vacation or petitioner's use of this property, including
but not limited to a clann brought because of any act of omission, neglect, or misconduct of
said peutioner or because of any claims or liability arising from any violauon of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents ar
employees

YOUR PETITIONER, the Port Authority of the City of Saint Paul respectfully states and
alleges that we ar� the fee own�rs af record af the reai estate are abutting Olive Street, Pine
Street, Van Ingen Street, Williams Street, Olmstead Street and Pennsylvania Avenue bounded by
the attached legal description and survey.
The proposed vacation is required for the development of Williams Hill Business Park.
Your Petitioner herein requests that there be no assessment of compensation to Petirioner
on account of the value of the accrual; and that in lieu of a bond, and by acceptance of the terms
of the vacation, the Port Authority agrees to fully indemnify, defend and save baruiless the City of
Saint Paul and thg $oard af �ater Coum�issianers, its officers, agents, employees and servants
from all suits, actions or claims which may arise from any injuries or d2mages received or
sustained by a break in any service pipe, water main, or connection in said vacated azeas, arising
out of or resulting from any action ar negligence of the Petitioner, its employees, agents or
business invitees. Yom� Petitianer �erem fm�tl�er requests that the provisions of the Saint Paul
legislarive Code, Chaptel' 130, pertaining to the reservation of easements be waived upon
presentation to and approval by the City Council of Saint Paul.
We request Certificates of Intended Non-Use over the vacated area for electrical, gas,
water, sanitary sewer, storni s�wer, U_S_ PJest, -Cable television, and any other parties interest.
WI�REFORE, your Petitioner respectfully requests yow Honorable Body to vacate the

3 and discontinued as public propeny: and, subject to the herein stated exceptions, the easements within

for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That a permanent utility easement shall be retained within the vacated area to protect the
interest of Northern States Power Company..
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company Electric, District Energy St. Paul, Incorporated, MCI Telecommunications
Corporation, Continental Cablevision, The Water Utility, and The Department of Public
Works, made a part hereof by this reference and filed in the office of the City Clerk of Saint
Paul, the City, for itself and on behalf of these corporations and departments, waive the right
to the utility easements in the vacated area described above.
That the petitioner's their successors, and assigns agree to indemnify, defend and save
harniless the City of Saint Paul, its officers, and employees from all suits, actions, or clanns of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or properry on account of this vacation or petitioner's use of this property, including
but not limited to a clann brought because of any act of omission, neglect, or misconduct of
said peutioner or because of any claims or liability arising from any violauon of any law or

YOUR PETITIONER, the Port Authority of the City of Saint Paul respectfully states and
alleges that we ar� the fee own�rs af record af the reai estate are abutting Olive Street, Pine
Street, Van Ingen Street, Williams Street, Olmstead Street and Pennsylvania Avenue bounded by
the attached legal description and survey.
The proposed vacation is required for the development of Williams Hill Business Park.
Your Petitioner herein requests that there be no assessment of compensation to Petirioner
on account of the value of the accrual; and that in lieu of a bond, and by acceptance of the terms
of the vacation, the Port Authority agrees to fully indemnify, defend and save baruiless the City of
Saint Paul and thg $oard af �ater Coum�issianers, its officers, agents, employees and servants
from all suits, actions or claims which may arise from any injuries or d2mages received or
sustained by a break in any service pipe, water main, or connection in said vacated azeas, arising
out of or resulting from any action ar negligence of the Petitioner, its employees, agents or
business invitees. Yom� Petitianer �erem fm�tl�er requests that the provisions of the Saint Paul
legislarive Code, Chaptel' 130, pertaining to the reservation of easements be waived upon
presentation to and approval by the City Council of Saint Paul.
We request Certificates of Intended Non-Use over the vacated area for electrical, gas,
water, sanitary sewer, storni s�wer, U_S_ PJest, -Cable television, and any other parties interest.
WI�REFORE, your Petitioner respectfully requests yow Honorable Body to vacate the

voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company Electric, District Energy St. Paul, Incorporated, MCI Telecommunications

Works, made a part hereof by this reference and filed in the office of the City Clerk of Saint

YOUR PETITIONER, the Port Authority of the City of Saint Paul respectfully states and
alleges that we ar� the fee own�rs af record af the reai estate are abutting Olive Street, Pine
Street, Van Ingen Street, Williams Street, Olmstead Street and Pennsylvania Avenue bounded by
the attached legal description and survey.
The proposed vacation is required for the development of Williams Hill Business Park.
Your Petitioner herein requests that there be no assessment of compensation to Petirioner
on account of the value of the accrual; and that in lieu of a bond, and by acceptance of the terms
of the vacation, the Port Authority agrees to fully indemnify, defend and save baruiless the City of
Saint Paul and thg $oard af �ater Coum�issianers, its officers, agents, employees and servants
from all suits, actions or claims which may arise from any injuries or d2mages received or
sustained by a break in any service pipe, water main, or connection in said vacated azeas, arising
out of or resulting from any action ar negligence of the Petitioner, its employees, agents or
business invitees. Yom� Petitianer �erem fm�tl�er requests that the provisions of the Saint Paul
legislarive Code, Chaptel' 130, pertaining to the reservation of easements be waived upon
presentation to and approval by the City Council of Saint Paul.
We request Certificates of Intended Non-Use over the vacated area for electrical, gas,
water, sanitary sewer, storni s�wer, U_S_ PJest, -Cable television, and any other parties interest.

The Water Utility has no objection to the attached vacation petition subject to the following
condition:
1. The Water Utility requests you hold final approvai for the vacation until the Water
Utility notifies the Real Estate Division that anangements have been completed
with the Port Authority of Saint Paul for abandonment of water mains within the
vacated area.

The Department of PUblic Works has completed a review o£ the above referenced vacation
proposal and has no objections subject to the following comments and requirements:
1. We understand that
a) the approximately 100 ft. o£ Pine St. north of University will be
deleted £rom this vacation request and submitted at a later date as a separate
petition; and
b) Williams east of Olive adjacent to Lot 1, Blk 5, Patterson's
add. will be added to the vacation request.
2. The property shall be replatted and new streets dedicated.
3. Public Works Street Engineering shall issue ordinance permits for the relocation
and/or construction of utilities.
