The rehabilitation or demolition of the struciure to be completed within fifteen (15) days after the date of the Council Hearing; and WEiEREAS, a hearing was held before the Saint Pau1 City Council on Wednesday, February 5, 1497 and the testimony and evidence inciuding the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paui City Councfl hereby adopts the following Findings and Order concerning the Subje�t Property at 670 Sitns Avenue: i. That the Subject Property comprises a nuisance condition as defined in Saint Paul I,egislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estunated to exceed three thousand dollars ($3,000.00}. 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Properry. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies ar to demolish and remove the building(s). 5. That the de�ciencies causing this mzisance condition have not been conected. 6. That Public Health has posted a placard on the Subject Ptoperry which declares it to be a rnzisance condition subject to demolition. '7. That this building has been routinely monitored by the VacandNuisance Buildings Code Enforcement Frogram. 8. There had been two summary abatement notices issued against the property. The City & County Credit L3nion began foreclosure proceedings on ihe property, however they retumed a Certificate of Redemprion which canceled the foreclosure acdon. It was staff's opinion that the estimated cost to repair the building would exceed the value of the property. The cost for demolition was approximately $10,000. Thomas Iattery, property owner appeared and stated that it was tus intention to sell the praperty as soon as possible. Ae had not been aware that the foreclosure proceeding had been canceled until very recently. He received disability payme�s due to an iajury and did not have the financial resouress to repair ffie building. Gerry Strathman, Legislative Hearing Officer, recomme�led approval of the ortter for demolition. He advised Mr. Lattery that this matter would be heard before the City Council on February 5 and that he wouid have untii approximately February 20 to sell the properry. Mr. Votel stated that the owner would need a truth in housing inspection or code compliance inspection report do� before markering the property. He atso advised that the owner would have to present a letter to any potential buyer that the property had been declared a nuisance by the city. He stat� that the mortgage foreciosure sate was completed on January 16th with a redemption date of Februazy 1A. At that time, they planned to convey the properry to HUD for sale. He requested additional time to take possession and convey the property to HUD. Thomas Iattery, property owner appeared and stated that it was tus intention to sell the praperty as soon as possible.
