The rehabilitation or demolition of the strucnue to be completed within fifteen (15) days after the date of the Council Hearing; and WIiEREAS, a hearing was held before the Saint Pau1 Ciry Council on Wednesday, February 5, 1997 and the testimony and evidence including the action taken by the Legislative Iiearing Officer was considered by the Council; now therefora BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saiut Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 787 Buffalo Street: 1. 2. 3. 4. 5. 6. 7. 8. That the Subject Property comprises a nuisance condition as defined in Saint Paui Legislative Code, Chapter 45. That the costs of demolition and removal of this buIlding(s) is estimated to exceed three thousand dollazs ($3,00(}.00). That there now exists and has existed muluple Housing or Building code violadons at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). Thatthe deficiencies causing this nuisance condition have not been corrected. That Public Healih has posted a placard on the Subject Properiy which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by the VacantlNuisance Buildings Code Enforcement Program. The above referenced interested or responsible parkies shall make the Subject Properiy safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influznce on the community by rehabilitating this structure and conecting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s} in accordance with all applicabie codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the structure must be completed within �ifteen (15} days after the date of the Council Hearing. 2. If the above corrective action is not completed within this period of time the Public Health, Code Enforcement Program is hereby authorized ta take whatever steps are necessary to demolish and remove ttus structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, ail personal property or fiYtures of any kind which interfere with the demolition and removai shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of 5aint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul I,egislative Code. If the owner fa7s to compty with the resolution, Public Health is ordered to remove the building. Chuck Votel, Public Health, reviewed the staff report. The building was co� in July, 1996 and had been vacant since ihat time. There had beea two summary abatement no6ces issued against the property. The City & County Credit Union began foreclosure proceedings on the properry, however they returned a Certificate of Redemption which canceled the foreclosure acflon. It was stafr's opinion that the estimated cost to repair the building would exceed the value of the property. The cost far demolition was approximately $10,000. Thomas Lattery, property owner appeared and stated that it was his intendon to sell the properry as soon as possible. He had �t been aware that the foreciosure proceeding had been canceled until very recently. He rereived disability payments due to an injury and did not have the financial resources to repair the building. Gerry Strathman, I.egisiative Hearing Officer, recommended approval of the order for demolition. He advised Mr. Lauery that ttris matter would be heard before the City Council on February 5 and that he would have until approximately February 20 to sell the properry. Mr. Votel stated that the owner wouid need a truth in housing inspecrion or code compliance inspection rtport do� before markering the property. He also advised that the owner woutd have to present a letter to any potential buyer that the progerty had been declazed a nuisance by We city. 2. Resolution ordering the owner to remove or repair the referenced building, located at 670 Sims Avenue. If the owner faiLs to camply with the resohrtion, Public Heaith is ordered to remove the bailding. Mr. Votel reviewed the staff report. This was a four-unit building which had been condemned ia July, 19�6 by Fire Prevention. The current properry owner cauld not be located. There were two summary abatemeats issued against the property. The estimated cost to repair the building was $45,000 and the estimated cost for demolition was approximately $14,200. Michael Oberle, atiomey representing Norwest Mortgage, appeared. He stated tl�at the mortgage foreclosure sale was completed on January 16th with a redempfion date of Februazy 20. At thai time, they pTanned to convey the properry to HUD for sale. He requested additional time to take possession and convey the property to HUD. He pointed oui that the mortgage compazry had been maintaining the ProPertY.
