Green Sheet # � Presented by Referred To RESOLUTION CITY OF SAINT PAUL, MINNESOTA Committee Date 1 WI�REAS Continental Cablevision of St. Paul, Inc. and CGSt. Paul, LLC (Applicants) submitted a 2 Federal Communications (FCC) Form 394 to the City of Saint Paul on July 16, 1997; and 3 WHEREAS, FCC Form 394 is an"Application for Franchise Authority Consent to Assignment 4 or Transfer of Control of Cable Television Fianchise" and the Applicants have requested that the 5 CiTy of Saint Paul approve a transfer of the cable television franchise from Continental 6 Cablevision of St. Paul, Inc. to CC-St. Paul, LLC; and 7 WHEREAS, on August 15, 1997 the City requested additional information from CC-St. Paul, 8 LLC regazding their qualificarions to operate and maintain a cable television system in Saint 9 Paul; and 10 WHEREAS, the City held a public hearing regarding the transfer request on September 3, 1997; 11 and 12 WI-IEREAS, the public hearing was continued until September 24 to allow CC-St. Paul, LLC 13 time to respond to the City's data request, and said response was originally due August 24 and 14 had been extended by the City at the Applicants' request until September 5; and 15 WHEREAS, the City did not receive the requested information on September 5 and granted 16 another extension of the deadline to CC-St. Paul, LLC until September 22; and 17 WHEREAS, said September 22 response was too late to allow City evaluation of the information 18 by the public hearing on September 24; and 19 WHEREAS, as of September 24, 1997, outstanding issues remain concerning the adequacy of 20 the Institutional Network; and 21 WHEREAS, as of September 24, 1997, outstanding questions remain concerning CC-St. Pau1 22 LLC's qualifications to operate and maintain a cable television system in Saint Paul; and 23 WHEREAS, the Appiicants have requested that any deadline for the Saint Paul City Council to 24 act on the transfer be extended through and including December 3, 1997; and 25 WIIEREAS, the Applicants have agreed that any action taken by the Saint Paul City Council on 26 or before December 3, 1997 will be deemed timely taken; and cl� _�\`1�- 1 WHEREAS, the Applicants have waived any rights they may have under federal or state law to 2 raise a claim or defense challenging the timeliness of any acfion taken on the transfer application 3 if such action is taken by the Saint Paul City Council on or before December 3, 1997; and WHEEREAS, absent an ea the City's Cable Communications Officer would recommend denying the transfer application at this time because of the outstanding issues, and the Council would consider this recommendation at this time; now THEREFORE, BE IT RESOLVED that the Saint Paul City Council agrees to the Applicants' request for an eatension of the deadline for City Council acfion on the transfer until and including December 3, 1997; and 10 BE IT FURTHER RESOLVED that should Continental Cablevision of St. Paul, Inc. or CGSt. 11 Paul, LLC challenge the tuneliness of the City's action if such acrion is taken on or before 12 December 3, 1997, the transfer application will be deemed denied as of September 24, 1997 for 13 the reasons indicated above.
