The vacated area is described as follows: That part of Palace Avenue as originally platted, which lies westerly of the westerly right-of- way line of Highway I-35E and easterly of a line extending in a north-south direction which intersects a point on the south line of Lot 6, Block 19, Ridgewood Pazk Addition, 16 feet east of the southwest corner of said Lot 6, all in Ramsey County, Minnesota. This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended, and to the following conditions: 1. That the petitioner, his successors and assigns, shall pay $500.00 as an administrative fee for this vacation which is due and payable within 60 days of the effecYive date of this resolution. 2. That the petitioner shall pay all costs and expenses for the regrading and reconsuvction of Palace Avenue to properly drain the remaining portion of street and to eliminate the appearance of a public thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal, all to the satisfaction of the Departrnent of Public Works. 3. That a permanent easement for access purposes be retained in favor of the City of Saint Paul's Department of Fire and Safety over and across the area to be vacated. 4.
