RESOLVED, that upon the petition of dohn Kratz, per Finance Deparnnent File Number 5-1997, public
properties hereinafter described are hereby vacated and discontinued as public property; and, subject to the
herein stated exceptions, the easements within those public properties are hereby released.
The vacated area is described as follows:
That part of Palace Avenue as originally platted, which lies westerly of the westerly right-of-
way line of Highway I-35E and easterly of a line extending in a north-south direction which
intersects a point on the south line of Lot 6, Block 19, Ridgewood Pazk Addition, 16 feet east
of the southwest corner of said Lot 6, all in Ramsey County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner, his successors and assigns, shall pay $500.00 as an administrative fee for this
vacation which is due and payable within 60 days of the effecYive date of this resolution.
2. That the petitioner shall pay all costs and expenses for the regrading and reconsuvction of Palace
Avenue to properly drain the remaining portion of street and to eliminate the appearance of a
public thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Departrnent of Public Works.
3. That a permanent easement for access purposes be retained in favor of the City of Saint Paul's
Department of Fire and Safety over and across the area to be vacated.
4. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers, and employees from a11 suits, actions, or claims of any
character brought as a result of injuries or damages received or sustained by any person, persons,
or property on account of this vacation or petitioner's use of this properiy, including but not
limited to a claim brought because of any act of omission, neglect, or misconduct of said petitioner
or because of any claims or liability arising from any violation of any law or regulauon made in
accordance with the law, whether by the petitioner or any of their agents or employees

The Department of Public Works has completed a review of the above referenced
vacation proposal. A small area of Palace drains to the proposed vacated
area. The petitioners should look at regrading to get the remainder of Palace
to drain towards Lexington. If this is not compatibLe with their development
proposal we should discuss an easement or some indemni£ication due to the
drainage of public property onto private. Therefore, the Department of Public
Works has no objections to the vacation subject to the following:

I, the undersigned, together with the 5tate of Mnnesota, Department of Transportation,
constituring a majority of the owners (or their legally designated representatives) of the abutting
properties, do hereby petition the Council of the City of St. Paul to vacate its interests in the
property legally described as follows:
That portion of Palace Avenue lying between the west right-of-way line
of Highway 35E and a north-south ]ine which irnersects a point on the
south line of Lot 6, Block 19, Ridgewood Park Addition, which is no less
than 16 feet (to be detemvned) east of the southwest corner of Lot 6,
Block 19, Ridgewood Park Addition.
I request this vacarion for the following reasons.
The property will be used as open space as part of a cluster development
of the adjonilng property to the north.
Copies of the proposed site plans for the development are already circulating through the various
City of St. Paul departments, with a Site Plan Review Committee scheduled for March 26, 1997.

RESOLVED, that upon the petition of dohn Kratz, per Finance Deparnnent File Number 5-1997, public
properties hereinafter described are hereby vacated and discontinued as public property; and, subject to the
herein stated exceptions, the easements within those public properties are hereby released.
The vacated area is described as follows:
That part of Palace Avenue as originally platted, which lies westerly of the westerly right-of-
way line of Highway I-35E and easterly of a line extending in a north-south direction which
intersects a point on the south line of Lot 6, Block 19, Ridgewood Pazk Addition, 16 feet east
of the southwest corner of said Lot 6, all in Ramsey County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner, his successors and assigns, shall pay $500.00 as an administrative fee for this
vacation which is due and payable within 60 days of the effecYive date of this resolution.
2. That the petitioner shall pay all costs and expenses for the regrading and reconsuvction of Palace
Avenue to properly drain the remaining portion of street and to eliminate the appearance of a
public thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Departrnent of Public Works.
3. That a permanent easement for access purposes be retained in favor of the City of Saint Paul's
Department of Fire and Safety over and across the area to be vacated.
4. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers, and employees from a11 suits, actions, or claims of any
character brought as a result of injuries or damages received or sustained by any person, persons,
or property on account of this vacation or petitioner's use of this properiy, including but not
limited to a claim brought because of any act of omission, neglect, or misconduct of said petitioner
or because of any claims or liability arising from any violation of any law or regulauon made in
accordance with the law, whether by the petitioner or any of their agents or employees

Vacation of part of Palace Avenue between
Lexinqton Parkway and I-35E
The Department of Public Works has completed a review of the above referenced
vacation proposal. A small area of Palace drains to the proposed vacated
area. The petitioners should look at regrading to get the remainder of Palace
to drain towards Lexington. If this is not compatibLe with their development
proposal we should discuss an easement or some indemni£ication due to the
drainage of public property onto private. Therefore, the Department of Public
Works has no objections to the vacation subject to the following:
The petitioner shall pay all costs and expenses for the regrading and
reconstruction of Palace Avenue to properly drain the remaining portion of
street and to eliminate the appearance of a public thoroughEare, including but
not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and
street sign removal, all to the satisfaction of the IIepartment o£ Public
Works.

constituring a majority of the owners (or their legally designated representatives) of the abutting

RESOLVED, that upon the petition of dohn Kratz, per Finance Deparnnent File Number 5-1997, public
properties hereinafter described are hereby vacated and discontinued as public property; and, subject to the
herein stated exceptions, the easements within those public properties are hereby released.
The vacated area is described as follows:
That part of Palace Avenue as originally platted, which lies westerly of the westerly right-of-
way line of Highway I-35E and easterly of a line extending in a north-south direction which
intersects a point on the south line of Lot 6, Block 19, Ridgewood Pazk Addition, 16 feet east
of the southwest corner of said Lot 6, all in Ramsey County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner, his successors and assigns, shall pay $500.00 as an administrative fee for this
vacation which is due and payable within 60 days of the effecYive date of this resolution.
2. That the petitioner shall pay all costs and expenses for the regrading and reconsuvction of Palace
Avenue to properly drain the remaining portion of street and to eliminate the appearance of a
public thoroughfare, including but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Departrnent of Public Works.
3. That a permanent easement for access purposes be retained in favor of the City of Saint Paul's
Department of Fire and Safety over and across the area to be vacated.
4. That the petitioner's their successors, and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers, and employees from a11 suits, actions, or claims of any
character brought as a result of injuries or damages received or sustained by any person, persons,
or property on account of this vacation or petitioner's use of this properiy, including but not
limited to a claim brought because of any act of omission, neglect, or misconduct of said petitioner
or because of any claims or liability arising from any violation of any law or regulauon made in
accordance with the law, whether by the petitioner or any of their agents or employees

Lexinqton Parkway and I-35E
The Department of Public Works has completed a review of the above referenced
vacation proposal. A small area of Palace drains to the proposed vacated
area. The petitioners should look at regrading to get the remainder of Palace
to drain towards Lexington. If this is not compatibLe with their development
proposal we should discuss an easement or some indemni£ication due to the
drainage of public property onto private. Therefore, the Department of Public
Works has no objections to the vacation subject to the following:

I, the undersigned, together with the 5tate of Mnnesota, Department of Transportation,
constituring a majority of the owners (or their legally designated representatives) of the abutting
properties, do hereby petition the Council of the City of St. Paul to vacate its interests in the
property legally described as follows:
That portion of Palace Avenue lying between the west right-of-way line
of Highway 35E and a north-south ]ine which irnersects a point on the
south line of Lot 6, Block 19, Ridgewood Park Addition, which is no less
than 16 feet (to be detemvned) east of the southwest corner of Lot 6,
Block 19, Ridgewood Park Addition.
I request this vacarion for the following reasons.
The property will be used as open space as part of a cluster development
of the adjonilng property to the north.
Copies of the proposed site plans for the development are already circulating through the various
City of St. Paul departments, with a Site Plan Review Committee scheduled for March 26, 1997.
