WHEREAS, Pubiic Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a two-story, wood
frame dwelling and garage slab located on property hereinafter referred to as the "Subject Property"
and commonly known as 1050 Iglehart Avenue. This property is legally described as follows, to
wit:
Lot 3, Block 2, A. B. Wilgus Addition to the City of St. Paul
WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Public Health on or before July 15, 1997, the following are the now lrnown
interested or responsible parties for the Subject Property: State of Minnesota Trust Exempt, 620B
Govemment Center West, 50 Kellogg Blvd. West, St. Paui, MN 55102; Pirst Trust, Attn: I,egal
Dept., 350 Robert Street North, Ste. 495, St. Paul, MN SS1Qi; Valley Paving Inc., 880Q 13ffi

WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul I,egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
3uly 10, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject ProperCy by August ll, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Pubiic Health requested that
the City Clerk schedule public hearings before the I,egislative Hearing Officer of the City Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsibie parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the L,egislative Hearing Officer of the Saint Paul City
Council on Tuesday, September 16, 1997 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Councfl Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday
September 24, 1997 and the testimony and evidence including tke action talcen by the Legislative
Hearing O�cer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Properry at 1050 Tglehart Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Lzgislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in trus
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested ar responsible parties shali make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on ffie commun3ry by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate 1Vuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with ali apglicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsibie parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the Ciry
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Faul L,egislative Code.
If the above conective acTion is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paui Legislative Code.

Inasmuch as this Order to Abate has not been complied with the nuisance condition remains

STAFF PRESENT: Don Juenemann and Reneta Weiss
Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
Vacant lot at SW corner of Londin Place and Londin Lane
Donald McCollough, owner of the boat pazked on this property, stated that he has used this
winter storage space for two years. Before pazking it there, he contacted the zoning office and
was informed that there would be no probiem. Mr. McCollough asked for permission to leave
the boat there this winter, with the understanding that he will find another pazking situation next
year.
Don Juenemann, Public Health, reported that the owner of the property is Thomas T.
Lingenfelier. He also informed Mr. Lingenfelter with respect to the parking ordinance and
request for paving residentiai parking spaces. Mr. Juenemann stated that the ordinance, which
was enacted in February, 1993, does allow the public five yeazs to comply.
Mr. Strathman recommends denying the appeal and allowing Mr. McColiough until May 1, 1998
to remove the boat from ihe property.
1050 Igiehart Avenue (Laid over from September 16' )
Reneta Weiss, Public Health reported that more Summary Abatements have been issued since
September 16u. The property is still owned by the State of Minnesota Trust ExemptlRamsey
County. HRA was informed of this hearing, however, has made no response. The properry
continues to be a nuisance.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to repair or
remove the building with fifteen (15) days.
275 Harrison Avenue (Laid over from I3ovember 12`" )
Reneta Weiss, Public Health, reported that she received a telephone cali last week from a
gentleman who is purchasing the properiy. December 15�' he posted a$2,000 performance bond
and ordered a code compliance inspection. He requests six-months to rehabilitate the building.
Gerry Strathman, Legislative Hearing Officer, recommends aliowing the new owner six-months
to rehabilitate.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
Vacant lot at SW corner of Londin Place and Londin Lane
Donald McCollough, owner of the boat pazked on this property, stated that he has used this
winter storage space for two years. Before pazking it there, he contacted the zoning office and
was informed that there would be no probiem. Mr. McCollough asked for permission to leave
the boat there this winter, with the understanding that he will find another pazking situation next
year.
Don Juenemann, Public Health, reported that the owner of the property is Thomas T.
Lingenfelier. He also informed Mr. Lingenfelter with respect to the parking ordinance and
request for paving residentiai parking spaces. Mr. Juenemann stated that the ordinance, which
was enacted in February, 1993, does allow the public five yeazs to comply.
Mr. Strathman recommends denying the appeal and allowing Mr. McColiough until May 1, 1998
to remove the boat from ihe property.

Reneta Weiss, Public Health reported that more Summary Abatements have been issued since
September 16u. The property is still owned by the State of Minnesota Trust ExemptlRamsey
County. HRA was informed of this hearing, however, has made no response. The properry
continues to be a nuisance.

Reneta Weiss, Public Health, reported that she received a telephone cali last week from a
gentleman who is purchasing the properiy. December 15�' he posted a$2,000 performance bond
and ordered a code compliance inspection. He requests six-months to rehabilitate the building.

to rehabilitate.

WHEREAS, the interested and responsibie parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the L,egislative Hearing Officer of the Saint Paul City
Council on Tuesday, September 16, 1997 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Councfl Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday
September 24, 1997 and the testimony and evidence including tke action talcen by the Legislative
Hearing O�cer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Properry at 1050 Tglehart Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Lzgislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in trus
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested ar responsible parties shali make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on ffie commun3ry by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate 1Vuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with ali apglicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properry by the responsibie parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the Ciry
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Faul L,egislative Code.
If the above conective acTion is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
