Please take notice that a hearing concerning the above-named
establishment has been scheduled for 4:30 p.m., Wednesday, February
5, 1997 in the City Council Chambers, Third Floor, Saint Pau1 City
Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the facts
contained in the report concerning the unlawful sale of cigarettes
have been admitted. You will have an opportunity at the Council
hearing to present oral andJor written remarks as to the penalty,

Dear Ms. Palmer:
I am writing in regards to the Notice of Violafion given to Tom Thumb Food Market #118, b2b
Iarpentuer Avenue West, St Paui, MN, 55117, on December 10,1496.
We acknowledge that on December 70, 1996, at approximately 4 pm, Cashiar ponald Monack,
sold a pack of cigazettes to a minor under the legai limit of 18 years of age.
Tom Thumb understands the importance of keeping cigazettes out of the hands of minors. We
provide all of our emptoyees with extensive training about the law and their responsibility to
only seil cigarettes to customers 18 years of age or oldex, who can produce identification proving
their age. We've outlined what the penalries are for selling cigazetfes to minors and how the
burden falls heavily on the individual who actually sells the cigarettes. After their training
our employees aze required to sign a notice stating that they understand our policies. Mr. Monak
was aware of our policies and has signed a statement to that effect (see enclosed certificate).
Tom T'humb's goal is to be a good corporate citizen and follow the regulafions and laws of the
State of Minnesota and the City of St Paul. We take these laws seriously and we realize how
these violations can adversely affect our reputation in the cpmmunity. We understand our
obligation co properly train our employees and enforce the letter of the ]aw in our sfores. I will
personally guazantee that Mr. Monak and the entire staff of this store witl receive additionai
training and I wiIl monitor this store to insure their adherence to the laws.
We aze willing to work with you in addressing this problem and would welcome any addi6onal
advice or guidelines you may offer to improve our own training to prevent these violations in
the future. Please respond, in writing, with the date and time that this case will be set before

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your cigarette license held at the above-named
premises. This recommendation is based on the following:
On December 10, 1996, you or aaother employee so2d
cigarettes to a miaor uader the age of 18 yeara ia the
licensed premises. This is aa offense under Mittn. Stat.
§609.685 aad 5aint Paul Legislative Code §324.07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Counci2.
You wi11 have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imposed.
If you do dispute the above facts, a hearing will be set before an
Administrative Law Judge. At that hearing both you and the City
will be able to appear and present witnesses, evidence and cross-
examine the other's witnesses. The Council will ultimately decided
the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, within 5 days, and we will take the necessary steps

provide all of our emptoyees with extensive training about the law and their responsibility to
only seil cigarettes to customers 18 years of age or oldex, who can produce identification proving
their age. We've outlined what the penalries are for selling cigazetfes to minors and how the
burden falls heavily on the individual who actually sells the cigarettes. After their training
our employees aze required to sign a notice stating that they understand our policies. Mr. Monak
was aware of our policies and has signed a statement to that effect (see enclosed certificate).
Tom T'humb's goal is to be a good corporate citizen and follow the regulafions and laws of the
State of Minnesota and the City of St Paul. We take these laws seriously and we realize how
these violations can adversely affect our reputation in the cpmmunity. We understand our
