TOPIC: Approval of Memorandum of Agreement with the International Brotherhood
of Painters and Allied Trades Local 61 to Establish i erms and Conditions
of Employment for 1997-98.
A. PERTINENT FACTS;
1. The Memorandum of Agreement is for a one-year period, May 1, 1997, through
April 30, 1998.
2. The language provisions of the previous contract remain unchanged, except for necessary
changes to Appendix C(salary) and Appendix p(benefits).
3. The District has i0 regular FTE in this bargaining unit.
4. Wage and benefits changes reflect prevailing wage.
5. This request is submitted by Susan Gutbrod, Negotiations/Labor Relations Assistant
Manager; Richard Kreyer, NegotiationslLabor Relations Manager; and William A. Larson,
Assistant Superintendent, Fiscal Affairs and Operations.
B. RECOMMENDATION:
That the Board of Education of Independent School District No. 625 approve and adopt the
Memorandum of Agreement concerning the terms and conditions of employment of those
employees in this school district for whom the International Brotherhood of Painters and Aflied
Trades Local 61 is the exclusive representative; duration of said agreement is for the period of
May 1, 1997 through April 30, 1998.

Ttus Memorandum of Ag�ement is by and between Independent School District No. 625
("DistricY'), Employer, and Intemationai Brotherhood of Painters and Allied Trades Local
61, exclusive representative for painters. The purpose of this agreement is to establish
terms and conditions of employment for the period May 1, 1997, through April 30, 1998.
PERTINENT FACTS:
The employment agreement with School District painters expires on April 30, 1997. The
terms and conditions in the 1995-97 contract, except for Appendices C and D, wfll remain
in force through April 30, 1998. Revised Appendices C and D are attached to this
Memorandum of Ageement and constitute the annual wage/benefit changes for this group
for the period May 1, 1997, through Apri130, 1998. The actual effective date for the wage
increase will be April 26, 1997, ttte first pay period closest to May 1, 1997 (see the
attached Appendices C and D for actual rates). All other ternas and conditions of
employment remain unchanged and in force through Apri130, 1998.

the cost of holidays, pension, and vacation for 1996; and less the cost of
health and life insnrance for the period May 1996 through April 1997

PREMNM PAY ASSIGNMIIVTS:
When performing the following types of work, the rate of pay shall be seventy-five cents
($.75) per hour over the basic hourly wage rate of any class of positions.
Sandblasfing, swing stage work, erected structural steel skeleton work, all
bridge work, all exterior work where safety belt or window jacks are used,
spray painting and when applying materials over 50°k creosote, and for
applicarion of all two-component epoxy materiats.

APPENDIX D
Effective Apri126 1997, the Employer shail forward the amounts designated in this
Appendix D for pazticipating empioyees covered by this Agnement and defined in Articles
123, 12.4, and 12.5 to depositories as d'srected hy the Union and agreed to by the
Employer:
(1) $1.68 per hour for all houcs worked from which all appropriate payroll
deductions have been made to a Union-designated Vacation Fund.
(2) $2.95 per hour for all hours worked to a Union-designated Iiealth and Welfare
Fund•

$4.00 per hour for all hours worked to a Union-designated Pension Fund.
$.15 per hour for all hours worked to a Union-designated A�renticeshig Fund.
The Employer shall make legally established non-aegoaated pension
contributions to PERA C� 4.48% of the applicable hourly rates noted in
Appendix C.

All contributions made in accordance with this Appendix D shall be deducted from and aze
not in addition to the amounu shown in Appendix C-1. The Appendix D amounts shall be
forwazded to depositories as directed by the Union and agreed to by the Employer.
The Employer shall establish Workers' Compensation and Unemployment Compensation
pmgrazns as required by Minnesota statutes.
Participating employees as defined in Articles 12.3, 12.4, and 12.5 covered by this
Agteement shall not be eligible for, govemed by or accumulate vacation, sick leave,
holiday, funeral leave, jury duty or insurance fringe benefits that are or may be established
by Personnel Rules, Council Ordinance or CouncIl Resolutions.
The Employer's fiinge benefu obligation to gaRicipating employees as defined in Articles
12.3, 12.4, and 12.5 is limited to the contributions and/or deductions established by this
Agreement. T'he actuai level of benefits provided to employees shall be the responsibility
of the Trustees of the various funds to wlrich the Employer has fonvazded contributions
and/or deductions.

Appendix D for pazticipating empioyees covered by this Agnement and defined in Articles
123, 12.4, and 12.5 to depositories as d'srected hy the Union and agreed to by the
Employer:
(1) $1.68 per hour for all houcs worked from which all appropriate payroll
deductions have been made to a Union-designated Vacation Fund.
(2) $2.95 per hour for all hours worked to a Union-designated Iiealth and Welfare
Fund•

61, exclusive representative for painters. The pur�wse of tlus agreement is to establish
terms and conditions of employment for the period May 1,1997, ttuough April 30, 1998.
PERTINENT FACTS:
The employment agreement with School District painters expires on April 30, 1997. The
terms and conditions in the 1995-97 contract, except for Appendices C and D, will remain
in force through April 30, 1998. Revised Appendices C and D are attached to this
Memorandum of Agreement and constitute the annual wage/benefit changes for this group
for the period May 1, 1997, through April 30, 1998. The actual effective date for the wage
increase will be April 26, 1997 the fust pay period closest to May 1, 1997 (see the
attached Appendices C and D for actual rates). All other terms and conditions of
employment remain unchanged and in force through Apri130, 1998.

A. PERTINENT FACTS;
1. The Memorandum of Agreement is for a one-year period, May 1, 1997, through
April 30, 1998.
2. The language provisions of the previous contract remain unchanged, except for necessary
changes to Appendix C(salary) and Appendix p(benefits).
3. The District has i0 regular FTE in this bargaining unit.
4. Wage and benefits changes reflect prevailing wage.

ff the Union elects to have the contributions listed in Appendix D increased or decreased,
the Empioyer may adjust the rates in Appendix C, Sections C-2 through G4 in such a way
that the total cost of the package (wage rate plus contributions) remains wnstant and dces
not exceed the amounts shown in Appendix C, section Gl.
PREMIUM PAY ASSIGNMENTS:
When perfortning the following types of work, the rate of pay shall be seventy-five cents
($.75) per hour over the basic hourly wage rate of any class of positions.
Sandblasting, swing stage work, erected sttuctural steel skeleton work, all
bridge work, all exterior work where safety belt or window jacks are used,
spray painting and when applying materials over 50°lo creosote, and for
application of all two-component epoxy materials.

APPENDIX D
,• Effective Apri126, 1997, the Employer shall forward the amounts designated in this
Appendix D for participating employees covered by this Ageement and defined in Articles
12.3,12.4, and 12.5 to depositories as directed by the Union and agreed to by the
Employer:
(i) $1.b8 per hout for all hours worked from which all appropriate payroll
deductions have been made to a Union-designated Vacation Fund.
(2) $2.95 per hour for all hours worked to a Union-designated �-Iealth and Welfare
Fund.
(3) $4.00 per hour for all hours worked to a Union-designated Pension Fund.
(4) $.15 per hour for all hours worked to a Union-designated A�nrenticeshi� Fund.
'I'he Employer shall make legally established non-negotiated pension
contributions to PERA @ 4.48% of the applicabie hourly rates noted in
Appendix C.

All contribudons made in accordance with this Appendix D shall be deducted from and are
not in addition to the amounts shown in Appendix C-1. The Appendix D amounts shall be
forwarded to depositories as directed by the Union and agreed to by the Employer.
The Employer shall establish Workers' Compensation and Unemployment Compensation
programs as required by Minnesota statutes.
Participating employees as defined in Articles 12.3, 12.4, and 12.5 covered by this
Agreement shall not be eligibie for, govemed by or accumulate vacation, sick leave,
holiday, funeral leave, jury duty or insurance fringe benefits that are or may be established
by Personnel Rules, Council Ordinance or Council Resolutions.
The Employer's fringe benefit obligation to participating employees as defined in Articles
12.3, 12.4, apd 12.5 is limited to the contributions and/or deductions established by this
AgreemenG The actual level of benefits provided to employees shall be tt�e responsibility
of the Trustees of the various funds to w}uch the Employer has fonvazded contributions
andlor dedactions.
