1 BE IT RESOLVED, that, upon the petition of Minnesota Mining and Manufacturing�is- as �
2 documented in Finance Department File Number 12-1997, public properties hereinafter described are
3 hereby vacated and discontinued as public properry.
4 The property to be vacated is described as follows:
5 Parcel 1. That part of Bush Avenue lying easterly of the west line of Mendota Street and
6 westerly of the west line of Forest Street; and

From the southeast corner of the said Lot 30; thence northerly along the east line of the
said Lot 30 a distance of 15 feet to th� point of beginning; thence southwesterly to a point
on the south line of the said Lot 301ying 15 feet westerly of the said southeast corner and
there terminating.
15 This vacation shall be subject to the terms and condition of Chapter 130, codified March l, 1981, of
16 the Saint Paul I,egislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That a permanent utiliry easement shall be retained on, over, under and across the vacated area
on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
Ciry to maintain and operate any sewer in or upon said easement and to enter upon said
easement or any portion thereof at any time and from time to time, for the purposes of future
construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof
and shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, materiai storage, fixture, or
any other objects that will prohibit normal access to utility facilities for maintenance
purposes will be permitted within the easement area.

b. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibi]iry of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.

interest of Northern States Power Company.
That a permanent utility easement shall be retained within the vacated area to protect the
interest of U.S. West Communication, Inc.
That a permanent utility easement shall be retained within the vacated area to protect the
interest of Continental Cablevision, Saint Paul, Inc.

1 7. That the petitioner shall pay all costs and expenses for any reconstruction of the Mendota-
2 Reaney and Bush-Forest intersections, including but not ]imited to costs for new curbs,
3 sidewalks, bou]evards, storm drains and street sign removal--al] to the satisfaction of the
4 Departrnent of Public Works--that may be necessary to properly eliminate the appearance of a
5 public thoroughfare.

That the petitioner shall submit, for Public Works approvat, a site plan showing the intended
use of the public right-of-way along with any proposed changes for the Mendota Reaney and
Bush-Forest intersections.
That the petitioner's their successors, and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

18 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
19 resolution and shall within the period(s) specified in the terms and conditions of this

21 BE IT FURTIiER RESOLVED, that the proper City officia]s are hereby authorized and directed to
22 prepare and execute a quit claim deed to convey to the petitioner the City's interest in Parcel 3.

We, the undersigned, constitukng a majority of the owners of the abuning propenies, do hereby petition the
Council of the City of Sz Pau1 ta vacate its interesu in the propenies [egally described as fallows:
1. That portion of Bush Avenue between Mendota Street and Forest Sueet
(Between Blocks 1 and 2 of E. M. MacKubins Addition)
2. That portion of Mendota Sheet between Bush Avenue and Reaney Avenue
(Between Block 2, Hills Addition and Block 2, E. M. MacKubins Addition)
3. The intersection of Bush Avenue and Mendota Street
We request this vacation for the fol[owing reasons:
The above streeu aze surrounded by the 3M St. Paul East Side campus. 3M has had a program of
continuous improvement of the facilities at this site as it has grown and evolved. 3M's ability to further
update and improve the facilities and address operarional issues in this azea is severely constrained by the
presence of the public streets. The older style of site plan design, lack of building setbacks, and constrained
trvck traffic maneuvering azea all contribute to operaaonal, safety, and building improvement problems.
V acation of these streets would allow 3M to address the following issues:
1. Truck maneuvering
2. Passenger vehicle tr�c flow and safety
3. Pedestrian safety
4. ADA improvements to Buildings 20 and 14
5. Improved visitor access to Buildings 2, 2�, 21 and 24
6. Improved access to and management of visitor pazking
7. Abiliry to create more of a"campus" feeling for the 3M SL Paul East Side site and allow greater
flexibility in landscape design
It is our intention (and indeed necessary) to retain a flow of trafiic through these streeis. These sh�eets now
function essentiaily as private roads that serve the 3M St. Paul East Side site; it is our observation that
almost all of [he traffic on these streets is �oin� to or coming from 3M. Vacadon of tl�e streets would allow
expansion of cer[ain areas, shifting of some functions, and possibly reducing those azeas that are larger than
needed. These improvements wili be part of a continuous pro�ram as priorities dictare. We do not,
however, have plans to build new structures within ihe existing ri�ht-of-way - vacation of the right-of-way
would primazily aIlow enhanced uti]ity, improved functionality, and grea[er safety of the existing facilities.

Subsequent to our application for the vacation of Bush and Mendota Streets, we
have learned that an additional triangle of property at the northwest corner of
Mendota and Reaney Streets was also dedicated to the City of St. Paul as right-of-
way. Copies of the application and plat map showing this triangular area aze
attached for reference. Linda Dickhut, with the St. Paul Public Works Department,
has determined that this triangle would no longer be needed by the City when the
requested portion of Mendota 5treet is vacated.
We therefore ask that 3M's application dated May 30, 1997 be amended to include
this triangie to the area previousiy requested- for vacation. I believe that the
documentation submitted with the original application, including the property owner
list and plot plan, covers this triangular parcel as well.

The Department ofPublic Works has completed a review of the above referenced vacation
proposal. Bush Avenue and Mendota Street aze improved streets within a 60 foot wide
right-of-way. The Ramsey County tax maps also show a 15 foot by 15 foot triangle taken from
Lot 30, Block 2, Hill's Addition, at the northwest corner of Reaney and Mendota. This was
opened per pocument #2129676 in the Ramsey County Recorder's Office. There is currentiy a
public sidewalk across this azea. This shouid probably be vacated too. Therefore, the
Department of Public Works has no objections to the vacation proposal subject to the following:
1. The petitioner shall pay all costs and expenses for any reconstruction of the Mendota/Reaney
and Bush/Forest intersections which may be necessary to properly eliminate.the appeatance of a

SUBJECT: Finance Department File Number 12-1997 (Bush and Mendota)
The Water Utility has a 6-inch water main, two fire hydrants, water services, and fire supply services
in that part of Parcel 1 and Parce12 proposed for vacation. To provide for continued access to our
facility, the Water Urility requires an easement be retained over the enfire portion of Pazcel 1, that
part of Bush Avenue lying easterly of the west line of Mendota Street and westerly of the west line
of Foxest Street, and Pazcel 2, that part of Mendota Street lying northerly of the north line of Reaney
Avenue and southerly of the south line of Bush Avenue.
Restrictions within the area aze as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
pemussion from the Water Utility.
2. No change from the existing grade or change in surfacing within the easement
area is pemutted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
dama�ed as a result of Water Utility operations, all removal, replacement or
modification costs shall be borne solely by the petirioner.
4. That the petitioner, its successars and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and� servants from all suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or ousiness invitee.

from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibi]iry of the

We request this vacation for the fol[owing reasons:
The above streeu aze surrounded by the 3M St. Paul East Side campus. 3M has had a program of
continuous improvement of the facilities at this site as it has grown and evolved. 3M's ability to further
update and improve the facilities and address operarional issues in this azea is severely constrained by the
presence of the public streets. The older style of site plan design, lack of building setbacks, and constrained
trvck traffic maneuvering azea all contribute to operaaonal, safety, and building improvement problems.
V acation of these streets would allow 3M to address the following issues:
1. Truck maneuvering
2. Passenger vehicle tr�c flow and safety
3. Pedestrian safety
4. ADA improvements to Buildings 20 and 14
5. Improved visitor access to Buildings 2, 2�, 21 and 24
6. Improved access to and management of visitor pazking
7. Abiliry to create more of a"campus" feeling for the 3M SL Paul East Side site and allow greater
flexibility in landscape design
It is our intention (and indeed necessary) to retain a flow of trafiic through these streeis. These sh�eets now
function essentiaily as private roads that serve the 3M St. Paul East Side site; it is our observation that
almost all of [he traffic on these streets is �oin� to or coming from 3M. Vacadon of tl�e streets would allow
expansion of cer[ain areas, shifting of some functions, and possibly reducing those azeas that are larger than
needed. These improvements wili be part of a continuous pro�ram as priorities dictare. We do not,
however, have plans to build new structures within ihe existing ri�ht-of-way - vacation of the right-of-way
would primazily aIlow enhanced uti]ity, improved functionality, and grea[er safety of the existing facilities.

Subsequent to our application for the vacation of Bush and Mendota Streets, we
have learned that an additional triangle of property at the northwest corner of
Mendota and Reaney Streets was also dedicated to the City of St. Paul as right-of-
way. Copies of the application and plat map showing this triangular area aze
attached for reference. Linda Dickhut, with the St. Paul Public Works Department,
has determined that this triangle would no longer be needed by the City when the
requested portion of Mendota 5treet is vacated.
We therefore ask that 3M's application dated May 30, 1997 be amended to include
this triangie to the area previousiy requested- for vacation. I believe that the
documentation submitted with the original application, including the property owner
list and plot plan, covers this triangular parcel as well.

The Department ofPublic Works has completed a review of the above referenced vacation
proposal. Bush Avenue and Mendota Street aze improved streets within a 60 foot wide
right-of-way. The Ramsey County tax maps also show a 15 foot by 15 foot triangle taken from
Lot 30, Block 2, Hill's Addition, at the northwest corner of Reaney and Mendota. This was
opened per pocument #2129676 in the Ramsey County Recorder's Office. There is currentiy a
public sidewalk across this azea. This shouid probably be vacated too. Therefore, the
Department of Public Works has no objections to the vacation proposal subject to the following:
1. The petitioner shall pay all costs and expenses for any reconstruction of the Mendota/Reaney
and Bush/Forest intersections which may be necessary to properly eliminate.the appeatance of a
public thoroughfaze, including but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Department of Public W orks.
2. The petitioner shall submit a site plan for Public Works approval sho��ing the intended use of
the pubiic right-of-way along with any proposed changes for the Mendota/Reaney and
Bush/Forest intersections.
3. A 40 foot wide permanent sewer easement, centered on the centerlines of Bush Avenue and
Mendota Street, as shown on the attached map, shail be retained on, over, under and across the
vacated area, on behalf of the City of Saint Paul, Department of Public Works, and shall be
subject to the foIlowing conditions:

SUBJECT: Finance Department File Number 12-1997 (Bush and Mendota)
The Water Utility has a 6-inch water main, two fire hydrants, water services, and fire supply services
in that part of Parcel 1 and Parce12 proposed for vacation. To provide for continued access to our
facility, the Water Urility requires an easement be retained over the enfire portion of Pazcel 1, that
part of Bush Avenue lying easterly of the west line of Mendota Street and westerly of the west line
of Foxest Street, and Pazcel 2, that part of Mendota Street lying northerly of the north line of Reaney
Avenue and southerly of the south line of Bush Avenue.
Restrictions within the area aze as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
pemussion from the Water Utility.
2. No change from the existing grade or change in surfacing within the easement
area is pemutted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
dama�ed as a result of Water Utility operations, all removal, replacement or
modification costs shall be borne solely by the petirioner.
4. That the petitioner, its successars and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and� servants from all suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or ousiness invitee.

for this vacation which is due and payable within 60 days of the effective date of this

That a permanent utiliry easement shall be retained on, over, under and across the vacated area
on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the
Ciry to maintain and operate any sewer in or upon said easement and to enter upon said
easement or any portion thereof at any time and from time to time, for the purposes of future

We, the undersigned, constitukng a majority of the owners of the abuning propenies, do hereby petition the
Council of the City of Sz Pau1 ta vacate its interesu in the propenies [egally described as fallows:
1. That portion of Bush Avenue between Mendota Street and Forest Sueet
(Between Blocks 1 and 2 of E. M. MacKubins Addition)
2. That portion of Mendota Sheet between Bush Avenue and Reaney Avenue
(Between Block 2, Hills Addition and Block 2, E. M. MacKubins Addition)
3. The intersection of Bush Avenue and Mendota Street
We request this vacation for the fol[owing reasons:
The above streeu aze surrounded by the 3M St. Paul East Side campus. 3M has had a program of
continuous improvement of the facilities at this site as it has grown and evolved. 3M's ability to further
update and improve the facilities and address operarional issues in this azea is severely constrained by the
presence of the public streets. The older style of site plan design, lack of building setbacks, and constrained
trvck traffic maneuvering azea all contribute to operaaonal, safety, and building improvement problems.
V acation of these streets would allow 3M to address the following issues:
1. Truck maneuvering
2. Passenger vehicle tr�c flow and safety
3. Pedestrian safety
4. ADA improvements to Buildings 20 and 14
5. Improved visitor access to Buildings 2, 2�, 21 and 24
6. Improved access to and management of visitor pazking
7. Abiliry to create more of a"campus" feeling for the 3M SL Paul East Side site and allow greater
flexibility in landscape design
It is our intention (and indeed necessary) to retain a flow of trafiic through these streeis. These sh�eets now
function essentiaily as private roads that serve the 3M St. Paul East Side site; it is our observation that
almost all of [he traffic on these streets is �oin� to or coming from 3M. Vacadon of tl�e streets would allow
expansion of cer[ain areas, shifting of some functions, and possibly reducing those azeas that are larger than
needed. These improvements wili be part of a continuous pro�ram as priorities dictare. We do not,
however, have plans to build new structures within ihe existing ri�ht-of-way - vacation of the right-of-way
would primazily aIlow enhanced uti]ity, improved functionality, and grea[er safety of the existing facilities.

Subsequent to our application for the vacation of Bush and Mendota Streets, we
have learned that an additional triangle of property at the northwest corner of
Mendota and Reaney Streets was also dedicated to the City of St. Paul as right-of-
way. Copies of the application and plat map showing this triangular area aze
attached for reference. Linda Dickhut, with the St. Paul Public Works Department,
has determined that this triangle would no longer be needed by the City when the
requested portion of Mendota 5treet is vacated.
We therefore ask that 3M's application dated May 30, 1997 be amended to include
this triangie to the area previousiy requested- for vacation. I believe that the
documentation submitted with the original application, including the property owner
list and plot plan, covers this triangular parcel as well.

The Department ofPublic Works has completed a review of the above referenced vacation
proposal. Bush Avenue and Mendota Street aze improved streets within a 60 foot wide
right-of-way. The Ramsey County tax maps also show a 15 foot by 15 foot triangle taken from
Lot 30, Block 2, Hill's Addition, at the northwest corner of Reaney and Mendota. This was
opened per pocument #2129676 in the Ramsey County Recorder's Office. There is currentiy a
public sidewalk across this azea. This shouid probably be vacated too. Therefore, the
Department of Public Works has no objections to the vacation proposal subject to the following:
1. The petitioner shall pay all costs and expenses for any reconstruction of the Mendota/Reaney
and Bush/Forest intersections which may be necessary to properly eliminate.the appeatance of a
public thoroughfaze, including but not limited to, costs for new curbs, sidewalks, boulevards,

in that part of Parcel 1 and Parce12 proposed for vacation. To provide for continued access to our
facility, the Water Urility requires an easement be retained over the enfire portion of Pazcel 1, that
part of Bush Avenue lying easterly of the west line of Mendota Street and westerly of the west line
of Foxest Street, and Pazcel 2, that part of Mendota Street lying northerly of the north line of Reaney
Avenue and southerly of the south line of Bush Avenue.
Restrictions within the area aze as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
pemussion from the Water Utility.
2. No change from the existing grade or change in surfacing within the easement
area is pemutted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
dama�ed as a result of Water Utility operations, all removal, replacement or
modification costs shall be borne solely by the petirioner.
4. That the petitioner, its successars and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and� servants from all suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or ousiness invitee.
