BE IT RESOLVED, that, upon the petition of the Housing and Redevelopment Authority of Saint
Paul , as documented in Finance Departmetn File Number 11-1995 , public properties hereinafter
described aze hereby vacated and discontinued as public property: and, subject to the herein stated
exceptions, the easements within those public propertries are hereby released.

That the petitioner's, their successors and assigns sha11 pay $500.00 as an admiiusuative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That the Housing and Redevelopment Authority shall dedicate to the Department of Public
Works an easement for alley purposes within 60 days of adoption of this resolution and that
said dedication shall be subject to approval of the proposed site plan by the Department of
Public Works.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, Diskrict Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
Continental Cablevision, The Water Utility, and The Department of Public Works, made a part
hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
itself and on behalf of these corporations and departments, waive the right to the utility
easements in the vacated area described above.
31 4. That the petitioner's their successors, and assigns agree to indemnify, defend and save
32 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
33 any chazacter brought as a result of injuries or damages received or sustained by any person,

I am requesting a date of September 1Q 1997 far a Public Hearing to approve the
attached Council Resolution. The purpose of the resolution is to vacate the portion of the
alley abutting Lots 1-3 & 28-30, Block 5 Holcombe's Addition, allowing the I�tA to sell
the subject property to a developer to construct a business. I have enclosed photocopies of
the Green Sheet, the Council Resolution and a map of the area to be vacated. Please let
me know if there is any additional information you might need.
The resolution is cunenfly being routed far signatures along with the responses u�om the
utilities and other pertinent information.

WHEREAS, Seiby Dale Partners, a partnership consistutg of Selby Area Community
Development Corporation and Baumeister & Associates, Inc., submitted a proposal calling for a
20,000 square foot office/retail facility on the southwest corners of the Site and a 5,000 square
foot bank/retail facility on the northeast corner; and
WHEREAS, at its meeting on July 27, 1994, the SUPC Board of Directors recommended that
Selby Dale Partners be designated tentative developers of the Site; and
WHEREAS, on August 10, 1994 the HRA Board designated the Selby Dale Partners as
tentative developer for a period of 180 days; and
WHEREAS, on January 24, 1995 the Summit University Planning Council approved a resolution
supporting an ea of tentative developer designation for the Selby Dale Partners; and
WHEREAS, on February 8, 1995, the HRA Board designated the Selby Dale Partners as the
tentative developers for an additional period of 180 days; and
WHEREAS, on 7uly 25, 1995 the Summit-Universiry Council recommended that the Selby Dale
Partners be designated as tentative developers for an additional 180 days, and approved
initiation of an application for the vacation of a portion of the alley within the development site;
and '
WHEREAS, in accordance with HRA Board policy, the Selby Dale Partners have submitted an
additional good faith deposit; and
WHEREAS, the Developer's site plan calls for the vacation of the easriwest alley which runs
parallel and adjacent to the HRA parcels located between Selby Avenue and Hague; and
WHEREAS, an easement for access from the alley through the proposed development will be
provided by the Selby Dale Partners; and

Partnets as developers fot the project, finalization of all required financing for the project and�
City approval of the final site plan; and
WHEREAS, it takes appror.imately three months to process an alley vacation and staff wishes to
ensure ihat the project is not deIayed by the process;
NOW, THEREFORE, BE TT RESOLVED, by the Board of Commissioners of the
Housing and Redevelopment Authority of the Ciry of Saint Pau1 as follows:
1. Selby Dale Partners are hereby approved as teniative developers of the HRA parcels on
the northeast and southwest corner of Selby and Dale and the northwest and southwest
corners of Aale and Hague, known as the SelbyiDale Redevelopment Site for a period
of 180 days to finalize all requued financing and documentation to proceed with the
proposal.
2. Tentative developer designation is conditioned upon Selby Dale Partners providing HRA
and the Summit-University Planning Council with mont}ily progress reports.
3. If the project does not go fonvard for any reasons othec than Selby Dale Partners'
inabiliry to obtain financing, all deposits will be retained to offset setvices and
administrative costs extended on the property.
4. That the appropriate HRA Officers are authorized to execute a Petition which will be
submitted to the City Clerk, for the vacation of the east-west alley, located between the
HRA narcels between Selbv and Ha�ue.

Vacation of part of alley in Block 5, Ho(combe's Addition
The Department of Public Works has completed a review of the above referenced
vacation proposal and has the following comments and requirements:
1. Because this proposal would dead-end the alley, the petitioner shali dedicate a
20 foot wide access easement through the proposed parking lot. Details of the access
easement need to be worked out.
a.) Does zoning permit commercial access to a residential alley?
b.) The easement must be a permanent easement.
c.) The property owner must assume all liability and maintenance
responsibilities within the easement boundaries,
d.) The easement location shali be subject to the approval of the Public
Works Traffic Engineering in conjunction with an approved site plan for the
parking lot..
2. The petitioner shall be responsible for all costs associated with the removal and
relocation of an NSP wood pole and street lighting feed cabinet.
3. The petitioner shail be responsibfe for the removal of the ailey entrance at Dale
Street, to the satisfaction of the Department of Public Works, including but not limited
to, the construction of new curbing, sidewalks, boulevards, drainage structures, and
signage, to remove all appearances of public right-of-way.

Paul , as documented in Finance Departmetn File Number 11-1995 , public properties hereinafter
described aze hereby vacated and discontinued as public property: and, subject to the herein stated
exceptions, the easements within those public propertries are hereby released.

That the petitioner's, their successors and assigns sha11 pay $500.00 as an admiiusuative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That the Housing and Redevelopment Authority shall dedicate to the Department of Public
Works an easement for alley purposes within 60 days of adoption of this resolution and that
said dedication shall be subject to approval of the proposed site plan by the Department of
Public Works.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, Diskrict Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
Continental Cablevision, The Water Utility, and The Department of Public Works, made a part
hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
itself and on behalf of these corporations and departments, waive the right to the utility
easements in the vacated area described above.
31 4. That the petitioner's their successors, and assigns agree to indemnify, defend and save
32 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
33 any chazacter brought as a result of injuries or damages received or sustained by any person,

WHEREAS, Seiby Dale Partners, a partnership consistutg of Selby Area Community
Development Corporation and Baumeister & Associates, Inc., submitted a proposal calling for a
20,000 square foot office/retail facility on the southwest corners of the Site and a 5,000 square
foot bank/retail facility on the northeast corner; and
WHEREAS, at its meeting on July 27, 1994, the SUPC Board of Directors recommended that
Selby Dale Partners be designated tentative developers of the Site; and
WHEREAS, on August 10, 1994 the HRA Board designated the Selby Dale Partners as
tentative developer for a period of 180 days; and
WHEREAS, on January 24, 1995 the Summit University Planning Council approved a resolution
supporting an ea of tentative developer designation for the Selby Dale Partners; and
WHEREAS, on February 8, 1995, the HRA Board designated the Selby Dale Partners as the
tentative developers for an additional period of 180 days; and
WHEREAS, on 7uly 25, 1995 the Summit-Universiry Council recommended that the Selby Dale
Partners be designated as tentative developers for an additional 180 days, and approved
initiation of an application for the vacation of a portion of the alley within the development site;
and '
WHEREAS, in accordance with HRA Board policy, the Selby Dale Partners have submitted an
additional good faith deposit; and
WHEREAS, the Developer's site plan calls for the vacation of the easriwest alley which runs
parallel and adjacent to the HRA parcels located between Selby Avenue and Hague; and
WHEREAS, an easement for access from the alley through the proposed development will be
provided by the Selby Dale Partners; and

Partnets as developers fot the project, finalization of all required financing for the project and�
City approval of the final site plan; and
WHEREAS, it takes appror.imately three months to process an alley vacation and staff wishes to
ensure ihat the project is not deIayed by the process;
NOW, THEREFORE, BE TT RESOLVED, by the Board of Commissioners of the
Housing and Redevelopment Authority of the Ciry of Saint Pau1 as follows:
1. Selby Dale Partners are hereby approved as teniative developers of the HRA parcels on
the northeast and southwest corner of Selby and Dale and the northwest and southwest
corners of Aale and Hague, known as the SelbyiDale Redevelopment Site for a period
of 180 days to finalize all requued financing and documentation to proceed with the
proposal.
2. Tentative developer designation is conditioned upon Selby Dale Partners providing HRA
and the Summit-University Planning Council with mont}ily progress reports.
3. If the project does not go fonvard for any reasons othec than Selby Dale Partners'
inabiliry to obtain financing, all deposits will be retained to offset setvices and
administrative costs extended on the property.
4. That the appropriate HRA Officers are authorized to execute a Petition which will be
submitted to the City Clerk, for the vacation of the east-west alley, located between the
HRA narcels between Selbv and Ha�ue.

development.

Vacation of part of alley in Block 5, Ho(combe's Addition
The Department of Public Works has completed a review of the above referenced
vacation proposal and has the following comments and requirements:
1. Because this proposal would dead-end the alley, the petitioner shali dedicate a
20 foot wide access easement through the proposed parking lot. Details of the access
easement need to be worked out.
a.) Does zoning permit commercial access to a residential alley?
b.) The easement must be a permanent easement.
c.) The property owner must assume all liability and maintenance
responsibilities within the easement boundaries,
d.) The easement location shali be subject to the approval of the Public
Works Traffic Engineering in conjunction with an approved site plan for the
parking lot..
2. The petitioner shall be responsible for all costs associated with the removal and
relocation of an NSP wood pole and street lighting feed cabinet.
3. The petitioner shail be responsibfe for the removal of the ailey entrance at Dale
Street, to the satisfaction of the Department of Public Works, including but not limited
to, the construction of new curbing, sidewalks, boulevards, drainage structures, and
signage, to remove all appearances of public right-of-way.

for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That the Housing and Redevelopment Authority shall dedicate to the Department of Public
Works an easement for alley purposes within 60 days of adoption of this resolution and that
said dedication shall be subject to approval of the proposed site plan by the Department of
Public Works.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, Diskrict Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
Continental Cablevision, The Water Utility, and The Department of Public Works, made a part
hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
itself and on behalf of these corporations and departments, waive the right to the utility
easements in the vacated area described above.

attached Council Resolution. The purpose of the resolution is to vacate the portion of the
alley abutting Lots 1-3 & 28-30, Block 5 Holcombe's Addition, allowing the I�tA to sell
the subject property to a developer to construct a business. I have enclosed photocopies of
the Green Sheet, the Council Resolution and a map of the area to be vacated. Please let

WHEREAS, Seiby Dale Partners, a partnership consistutg of Selby Area Community
Development Corporation and Baumeister & Associates, Inc., submitted a proposal calling for a
20,000 square foot office/retail facility on the southwest corners of the Site and a 5,000 square
foot bank/retail facility on the northeast corner; and
WHEREAS, at its meeting on July 27, 1994, the SUPC Board of Directors recommended that
Selby Dale Partners be designated tentative developers of the Site; and
WHEREAS, on August 10, 1994 the HRA Board designated the Selby Dale Partners as
tentative developer for a period of 180 days; and
WHEREAS, on January 24, 1995 the Summit University Planning Council approved a resolution
supporting an ea of tentative developer designation for the Selby Dale Partners; and
WHEREAS, on February 8, 1995, the HRA Board designated the Selby Dale Partners as the
tentative developers for an additional period of 180 days; and
WHEREAS, on 7uly 25, 1995 the Summit-Universiry Council recommended that the Selby Dale
Partners be designated as tentative developers for an additional 180 days, and approved
initiation of an application for the vacation of a portion of the alley within the development site;
and '
WHEREAS, in accordance with HRA Board policy, the Selby Dale Partners have submitted an
additional good faith deposit; and
WHEREAS, the Developer's site plan calls for the vacation of the easriwest alley which runs
parallel and adjacent to the HRA parcels located between Selby Avenue and Hague; and
WHEREAS, an easement for access from the alley through the proposed development will be
provided by the Selby Dale Partners; and

Partnets as developers fot the project, finalization of all required financing for the project and�
City approval of the final site plan; and
WHEREAS, it takes appror.imately three months to process an alley vacation and staff wishes to
ensure ihat the project is not deIayed by the process;
NOW, THEREFORE, BE TT RESOLVED, by the Board of Commissioners of the
Housing and Redevelopment Authority of the Ciry of Saint Pau1 as follows:
1. Selby Dale Partners are hereby approved as teniative developers of the HRA parcels on
the northeast and southwest corner of Selby and Dale and the northwest and southwest
corners of Aale and Hague, known as the SelbyiDale Redevelopment Site for a period
of 180 days to finalize all requued financing and documentation to proceed with the
proposal.
2. Tentative developer designation is conditioned upon Selby Dale Partners providing HRA
and the Summit-University Planning Council with mont}ily progress reports.
3. If the project does not go fonvard for any reasons othec than Selby Dale Partners'
inabiliry to obtain financing, all deposits will be retained to offset setvices and
administrative costs extended on the property.
4. That the appropriate HRA Officers are authorized to execute a Petition which will be
submitted to the City Clerk, for the vacation of the east-west alley, located between the
HRA narcels between Selbv and Ha�ue.

The Department of Public Works has completed a review of the above referenced
vacation proposal and has the following comments and requirements:
1. Because this proposal would dead-end the alley, the petitioner shali dedicate a
20 foot wide access easement through the proposed parking lot. Details of the access
easement need to be worked out.
a.) Does zoning permit commercial access to a residential alley?
b.) The easement must be a permanent easement.
c.) The property owner must assume all liability and maintenance
responsibilities within the easement boundaries,
d.) The easement location shali be subject to the approval of the Public
Works Traffic Engineering in conjunction with an approved site plan for the
parking lot..
2. The petitioner shall be responsible for all costs associated with the removal and
relocation of an NSP wood pole and street lighting feed cabinet.
3. The petitioner shail be responsibfe for the removal of the ailey entrance at Dale
Street, to the satisfaction of the Department of Public Works, including but not limited
to, the construction of new curbing, sidewalks, boulevards, drainage structures, and
signage, to remove all appearances of public right-of-way.
