WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
frame dwelling with an attached, wood starage shed located on property hereinafter referred to as
the "Subject Proper[y" and commonly known as 1451 Sherburne Avenue. This property is legally
described as follows, to wit:
Lot 18, Block 28, Syndicate No. 5 Addition
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before 7uly 8, 1997, the following are the now Iaiown
interested or responsible parties for the Subject Property: Daniel R. Watters, 3629 Clinton Avenue,
Mpls., MN 55409-1347; Federal National Mortgage Assoc., One South Wacker Drive, Clucago, TL
60606-4667, FMI# 1662756071; 7ames A. Geske, Leonard, O'Brien, Wilford et al, 800 Norwest
Center, St. Paul, MN 55101, I.D.#� 36399; Countrywide Home Loans Tnc., 6400 L,egacy Drive,
Plano, TX 75024, loan# 1272004
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Pau1 L.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
3une 27, 1997; and
WAEREAS, this order informed the then known interested ar responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by July 28, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WFiEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing Officer of the Ciry Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public heazings; and

WHEREAS, a hearing was held before the L,egislative Hearing O�cer of the Saint Paul City
Council on Tuesday, September 2, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance with ail applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WFiEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 10, 1997 and the testimony and evidence including the action taken by the I.egislative
Hearing O�cer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1451 Sherburne Avenue:
1. That the Subject Property comprises a nuisance condition as defined in 3aint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Aousing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantJNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the foliowing order:
i. The above referenced interested or responsible parties shall make the Subject Property safe
and not deuimental to the gublic peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this siructure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicabie codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure musY be completed within�i€Eee�-{�-5} days after the
date of the Council Hearing. �no������>

2. If the above corrective action is not completed within this period af time the Public Heaith,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapier 45 of the Saint Paul I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paui, all
personal property or fixtures of any kind which interfere with the demolition and removai
shall be zemoved from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ardered, that a copy of this resoluuon be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Chuck Votel reported there is a substantial medical assistance lien on the property. The deceased
owner's daughter has no interest in probating the estate to acquire the properry because the liens
aze substantiat enough that it is not worth their efforts to redeem it. The City has issued two
summary abatements and has boarded the building. The real estate taxes are unpaid. A code
compliance inspeciion was done in Mazch of 1997. The cost to repair is $20,000 and the cost to
demolish is $6,650.

Gerald Strathman asked was the medicallien from the State. Chuck Votel responded yes. Mr.
Strathman stated the $20,000 far repair is achievable and to go ahead with the demolition would
just create a vacant lot. Mr. Votel responded no one is assuming responsibility for taking caze of
the properry. The State could exercise their lien to gain control of the property, but Mr. Votel's
experience is they will not do that. The property needs new wiring, a new heating system,
probably a new plumbing system in addition to the normal weaz and tear associated with these
types of buildings. The $20,000 repair estimate may be optimistic.
Gerry Strathman recommended approvai of the Public Health order given the lack of a
responsible party.
701 Surrey Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votei reported the property has been condemned since 1995. The city has issued ten
suuimary abatement notices and one citation. The building was deciared to be a nuisance in
April 1996 and a code compliance inspecrion was done that month. A$2,000 bond was posted
and expires 3anuary 9, 1998. The cost to repair is $45,000 and the cost to demolish is $7,900.
Donald Ide, owner, appeared and stated there were 58 items on the list and all have been
completed except one or two. There was an inspecfion on August 29, 1997 with everyone
concerned with the property. Mr. Ide has put a substantial amount of money into this praperty,
but he has a lot of debt and no way of financing anything. The building is 95% completed.
Gerry Straflunan recommended the owner be given until the current bond expires on January 9,
1998 to complete the rehabilitation of the building.
9. 1451 Sherburne Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported the building was condemned in June of 1997. Counirs�wide Home Loans
is foreciosing on the mortgage. The Ciry has issued four sum.mary abatement notices and has
had to boazd it. Reai Estate taxes are paid. There has not been an application for a code

compliance inspection nor has a bond been posted. The cost to repair is $30,Q00 and the cost to
demolish is $4,600.
James Geske, attorney for Counhywide Home Loans, appeazed and stated Fannie Mae is the
investor on this account and has instructed Countrywide they wouid like a 30 day eatension to
__ allow Fannie Mae to make an assessment. Chuck Votel stated he is not opposed to this.
Gerry Strathman stated the house looks like it is in relatively good condition. Chuck Votel stated
the yard is now being maintained.
Gerry Strathman recommended laying over this matter to the October 7 Legislative Hearing with
the understanding that Countrywide will maintain the e�tterior of the building.
10. 452 Charles Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported the building has been vacant since Mazch of 1997. Fairbanks Capital just
got the properry as of September 4, 1997. They intent to rehabilitate the property and sell it.
There have been three summary abatements notices and the City has had to board the building.
The vacant building fees aze due and reai estate taYes are paid. The cost to repair is $30,000 and
the cost to demolish is about $6,500.
James Geske, attomey, stated this properiy was being sold as a contract to deed by TransAmerica
Financial Services. Fairbanks Capital has the property currenfly. Fairbanks would like
additional rime to make an assessment of the repairs.
Gerry Strathman recommended approval and amended the date for repair or removal to March 2,
1448 if the following are done by noon of September 10, 1997: a$2,000 bond is posted, a code
compliance inspection completed, and the vacant buiiding fee paid.
11. 1331 Bush Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported tius building has been vacant since Mazch of 1997. It is curtentiy in the
AIJD disposition. A code compliance inspection was done. The cost to repair is $25,000 and the
cost to demolish is about $7,750.
Gerry Strathman stated he has a memo &om Sophie Hallauer from HUD who says the property is
valued at $52,000. Mr. Strathman stated he is reluctant to demolish a building with that value.
Chuck Votel stated he is fine with giving HUD time to sell the properry. Also, the properry is
fixable.

12. 743 Englewood Avenue
Chuck Votel stated he did not receive a green card on this property.
_ �ecily Dewing, Public Works, appeared and stated iliere was a problem with the sewer service
and the manhole that sits on the property next to her house. The sewer problem was repaired.
The house that sits d'uectly behind 743 Englewood is also serviced by this manhole. The part
that was repaired services the two houses. The assessment was made entirely against 743
Englewood Avenue.
Debra Shambo, owner, appeared and stated there were rats in the yazd which came from the
manhole. The manhole was patched. The assessment should be shared by both households.
Cecily Dewing stated the assessment is $755.63.
Gerry Strathman asked why the assessment was against one property. Cecily Dewing responded
the problem was on Debra Shambds properry and this problem with two properties has not
occurred before.
Gerry Strathman recommended reducing the assessment by half plus the administration fees.
Gerry Strathman adjourned the meeting at 10:32.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.

Guy Willits, Pubiic Health, presented a video showing overflowing garbage containers and more
bags on the ground.
Calvin Burton, owner, appeazed and stated that ihey had switched trash companies and it was a
few days before everything was picked up.
Gerry Stratlunan stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup requ'ued. Mr. Wiliits and Chuck Votel concurred that this was not cieared by the regulaz
crew and that there were problems.
Mr. Stratiunan recommended that the assessment be deleted,

Neil Schwartz, owner, appeazed and stated that the sewer repair was complete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time consuming, due to the fact that there had been trolley
lines running through the azea.
Mr. St�atiunan recommended that the matter be closed.

� 5. 1451 Sherburne Avenue (Laid over from September 2nd)
James Geske, attomey for Countrywide Home Loans, Inc. appeazed, stating that Countrywide
has been the owner for nine days and is waiting for inshvctions from Fannie Mae with respect to
this properiy. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Sh�athman recoaunended to approve the order to repair or remove within 15 days.
5. bl3 Minnehaha Avenue E t(Laid over from September 16�')
Tim Nelson, a friend of Clazence Leaf, dr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the groperty for $29,085 just before it
was condemned.
� Mr. NeLson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there are some needed repairs which would require pernuts.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary pemuts
aze obtained by noon, October 22id . .

Burton Murdock, owner, appeared, and advised he has owned this property since 1954 and
stated that he intends to rehabilitate tivs building by cottverting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays ihe vacant building fee, posts a
$2,000 bond and obtaius a code compliance inspection by noon, October 22°� , he be given 180
days to rehabilitate the building.

Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her funily and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage

Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department

Gerry Strathman advised that he has had a number of telephone conversatiotts with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22`� , Mr. StratUman recommended giving the
owner 180 days to complete the rehabilifation.

WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
frame dwelling with an attached, wood starage shed located on property hereinafter referred to as
the "Subject Proper[y" and commonly known as 1451 Sherburne Avenue. This property is legally
described as follows, to wit:

with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public heazings; and

WHEREAS, a hearing was held before the L,egislative Hearing O�cer of the Saint Paul City
Council on Tuesday, September 2, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance with ail applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WFiEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 10, 1997 and the testimony and evidence including the action taken by the I.egislative
Hearing O�cer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1451 Sherburne Avenue:
1. That the Subject Property comprises a nuisance condition as defined in 3aint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Aousing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantJNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the foliowing order:
i. The above referenced interested or responsible parties shall make the Subject Property safe
and not deuimental to the gublic peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this siructure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicabie codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure musY be completed within�i€Eee�-{�-5} days after the

2. If the above corrective action is not completed within this period af time the Public Heaith,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapier 45 of the Saint Paul I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paui, all
personal property or fixtures of any kind which interfere with the demolition and removai
shall be zemoved from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ardered, that a copy of this resoluuon be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Chuck Votel reported there is a substantial medical assistance lien on the property. The deceased
owner's daughter has no interest in probating the estate to acquire the properry because the liens
aze substantiat enough that it is not worth their efforts to redeem it. The City has issued two
summary abatements and has boarded the building. The real estate taxes are unpaid. A code
compliance inspeciion was done in Mazch of 1997. The cost to repair is $20,000 and the cost to
demolish is $6,650.

Gerald Strathman asked was the medicallien from the State. Chuck Votel responded yes. Mr.
Strathman stated the $20,000 far repair is achievable and to go ahead with the demolition would
just create a vacant lot. Mr. Votel responded no one is assuming responsibility for taking caze of
the properry. The State could exercise their lien to gain control of the property, but Mr. Votel's
experience is they will not do that. The property needs new wiring, a new heating system,
probably a new plumbing system in addition to the normal weaz and tear associated with these
types of buildings. The $20,000 repair estimate may be optimistic.
Gerry Strathman recommended approvai of the Public Health order given the lack of a
responsible party.
701 Surrey Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votei reported the property has been condemned since 1995. The city has issued ten
suuimary abatement notices and one citation. The building was deciared to be a nuisance in
April 1996 and a code compliance inspecrion was done that month. A$2,000 bond was posted
and expires 3anuary 9, 1998. The cost to repair is $45,000 and the cost to demolish is $7,900.
Donald Ide, owner, appeared and stated there were 58 items on the list and all have been
completed except one or two. There was an inspecfion on August 29, 1997 with everyone
concerned with the property. Mr. Ide has put a substantial amount of money into this praperty,
but he has a lot of debt and no way of financing anything. The building is 95% completed.
Gerry Straflunan recommended the owner be given until the current bond expires on January 9,
1998 to complete the rehabilitation of the building.
9. 1451 Sherburne Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported the building was condemned in June of 1997. Counirs�wide Home Loans
is foreciosing on the mortgage. The Ciry has issued four sum.mary abatement notices and has
had to boazd it. Reai Estate taxes are paid. There has not been an application for a code

compliance inspection nor has a bond been posted. The cost to repair is $30,Q00 and the cost to
demolish is $4,600.
James Geske, attorney for Counhywide Home Loans, appeazed and stated Fannie Mae is the
investor on this account and has instructed Countrywide they wouid like a 30 day eatension to
__ allow Fannie Mae to make an assessment. Chuck Votel stated he is not opposed to this.
Gerry Strathman stated the house looks like it is in relatively good condition. Chuck Votel stated
the yard is now being maintained.
Gerry Strathman recommended laying over this matter to the October 7 Legislative Hearing with
the understanding that Countrywide will maintain the e�tterior of the building.
10. 452 Charles Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported the building has been vacant since Mazch of 1997. Fairbanks Capital just
got the properry as of September 4, 1997. They intent to rehabilitate the property and sell it.
There have been three summary abatements notices and the City has had to board the building.
The vacant building fees aze due and reai estate taYes are paid. The cost to repair is $30,000 and
the cost to demolish is about $6,500.
James Geske, attomey, stated this properiy was being sold as a contract to deed by TransAmerica
Financial Services. Fairbanks Capital has the property currenfly. Fairbanks would like
additional rime to make an assessment of the repairs.
Gerry Strathman recommended approval and amended the date for repair or removal to March 2,
1448 if the following are done by noon of September 10, 1997: a$2,000 bond is posted, a code
compliance inspection completed, and the vacant buiiding fee paid.

Chuck Votel reported tius building has been vacant since Mazch of 1997. It is curtentiy in the
AIJD disposition. A code compliance inspection was done. The cost to repair is $25,000 and the
cost to demolish is about $7,750.
Gerry Strathman stated he has a memo &om Sophie Hallauer from HUD who says the property is
valued at $52,000. Mr. Strathman stated he is reluctant to demolish a building with that value.
Chuck Votel stated he is fine with giving HUD time to sell the properry. Also, the properry is
fixable.

Chuck Votel stated he did not receive a green card on this property.
_ �ecily Dewing, Public Works, appeared and stated iliere was a problem with the sewer service
and the manhole that sits on the property next to her house. The sewer problem was repaired.
The house that sits d'uectly behind 743 Englewood is also serviced by this manhole. The part
that was repaired services the two houses. The assessment was made entirely against 743
Englewood Avenue.
Debra Shambo, owner, appeared and stated there were rats in the yazd which came from the
manhole. The manhole was patched. The assessment should be shared by both households.
Cecily Dewing stated the assessment is $755.63.
Gerry Strathman asked why the assessment was against one property. Cecily Dewing responded
the problem was on Debra Shambds properry and this problem with two properties has not
occurred before.
Gerry Strathman recommended reducing the assessment by half plus the administration fees.
Gerry Strathman adjourned the meeting at 10:32.

bags on the ground.
Calvin Burton, owner, appeazed and stated that ihey had switched trash companies and it was a
few days before everything was picked up.
Gerry Stratlunan stated that he felt the assessment of $207.00 was excessive for the amount of
� cleanup requ'ued. Mr. Wiliits and Chuck Votel concurred that this was not cieared by the regulaz
crew and that there were problems.
Mr. Stratiunan recommended that the assessment be deleted,

Neil Schwartz, owner, appeazed and stated that the sewer repair was complete. Dick Lippert,
Public Health, confirmed that this was the case. Mr. Schwartz added that this project proved to
be more extensive, and therefore more time consuming, due to the fact that there had been trolley
lines running through the azea.
Mr. St�atiunan recommended that the matter be closed.

James Geske, attomey for Countrywide Home Loans, Inc. appeazed, stating that Countrywide
has been the owner for nine days and is waiting for inshvctions from Fannie Mae with respect to
this properiy. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Sh�athman recoaunended to approve the order to repair or remove within 15 days.

Tim Nelson, a friend of Clazence Leaf, dr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the groperty for $29,085 just before it
was condemned.

Burton Murdock, owner, appeared, and advised he has owned this property since 1954 and
stated that he intends to rehabilitate tivs building by cottverting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays ihe vacant building fee, posts a
$2,000 bond and obtaius a code compliance inspection by noon, October 22°� , he be given 180
days to rehabilitate the building.

Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her funily and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
PuTP�ses oniy.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspection of 7uly 18'� was still vaiid. Gerry Strathman advised that if that is the case, she wi11
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary pemuts by noon, Oatober 22'�, she be given six months to
rehabilitate the building.
9. 1561 Jackson Street
Gerry Strathman advised that he has had a number of telephone conversatiotts with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22`� , Mr. StratUman recommended giving the
owner 180 days to complete the rehabilifation.

the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
frame dwelling with an attached, wood starage shed located on property hereinafter referred to as

described as follows, to wit:

with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public heazings; and

WHEREAS, a hearing was held before the L,egislative Hearing O�cer of the Saint Paul City
Council on Tuesday, September 2, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance with ail applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WFiEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
September 10, 1997 and the testimony and evidence including the action taken by the I.egislative
Hearing O�cer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1451 Sherburne Avenue:
1. That the Subject Property comprises a nuisance condition as defined in 3aint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Aousing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantJNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the foliowing order:
i. The above referenced interested or responsible parties shall make the Subject Property safe
and not deuimental to the gublic peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this siructure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicabie codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure musY be completed within�i€Eee�-{�-5} days after the

2. If the above corrective action is not completed within this period af time the Public Heaith,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapier 45 of the Saint Paul I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paui, all
personal property or fixtures of any kind which interfere with the demolition and removai
shall be zemoved from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ardered, that a copy of this resoluuon be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Chuck Votel reported there is a substantial medical assistance lien on the property. The deceased
owner's daughter has no interest in probating the estate to acquire the properry because the liens
aze substantiat enough that it is not worth their efforts to redeem it. The City has issued two
summary abatements and has boarded the building. The real estate taxes are unpaid. A code
compliance inspeciion was done in Mazch of 1997. The cost to repair is $20,000 and the cost to
demolish is $6,650.

Gerald Strathman asked was the medicallien from the State. Chuck Votel responded yes. Mr.
Strathman stated the $20,000 far repair is achievable and to go ahead with the demolition would
just create a vacant lot. Mr. Votel responded no one is assuming responsibility for taking caze of
the properry. The State could exercise their lien to gain control of the property, but Mr. Votel's
experience is they will not do that. The property needs new wiring, a new heating system,
probably a new plumbing system in addition to the normal weaz and tear associated with these
types of buildings. The $20,000 repair estimate may be optimistic.
Gerry Strathman recommended approvai of the Public Health order given the lack of a
responsible party.
701 Surrey Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votei reported the property has been condemned since 1995. The city has issued ten
suuimary abatement notices and one citation. The building was deciared to be a nuisance in
April 1996 and a code compliance inspecrion was done that month. A$2,000 bond was posted
and expires 3anuary 9, 1998. The cost to repair is $45,000 and the cost to demolish is $7,900.
Donald Ide, owner, appeared and stated there were 58 items on the list and all have been
completed except one or two. There was an inspecfion on August 29, 1997 with everyone
concerned with the property. Mr. Ide has put a substantial amount of money into this praperty,
but he has a lot of debt and no way of financing anything. The building is 95% completed.
Gerry Straflunan recommended the owner be given until the current bond expires on January 9,
1998 to complete the rehabilitation of the building.
9. 1451 Sherburne Avenue
Pictures from Public Health were shown to Gerry Strathman.
Chuck Votel reported the building was condemned in June of 1997. Counirs�wide Home Loans
is foreciosing on the mortgage. The Ciry has issued four sum.mary abatement notices and has
had to boazd it. Reai Estate taxes are paid. There has not been an application for a code

compliance inspection nor has a bond been posted. The cost to repair is $30,Q00 and the cost to
demolish is $4,600.
James Geske, attorney for Counhywide Home Loans, appeazed and stated Fannie Mae is the
investor on this account and has instructed Countrywide they wouid like a 30 day eatension to
__ allow Fannie Mae to make an assessment. Chuck Votel stated he is not opposed to this.
Gerry Strathman stated the house looks like it is in relatively good condition. Chuck Votel stated
the yard is now being maintained.
Gerry Strathman recommended laying over this matter to the October 7 Legislative Hearing with
the understanding that Countrywide will maintain the e�tterior of the building.
10. 452 Charles Avenue

Chuck Votel reported the building has been vacant since Mazch of 1997. Fairbanks Capital just
got the properry as of September 4, 1997. They intent to rehabilitate the property and sell it.
There have been three summary abatements notices and the City has had to board the building.
The vacant building fees aze due and reai estate taYes are paid. The cost to repair is $30,000 and
the cost to demolish is about $6,500.
James Geske, attomey, stated this properiy was being sold as a contract to deed by TransAmerica
Financial Services. Fairbanks Capital has the property currenfly. Fairbanks would like
additional rime to make an assessment of the repairs.
Gerry Strathman recommended approval and amended the date for repair or removal to March 2,
1448 if the following are done by noon of September 10, 1997: a$2,000 bond is posted, a code
compliance inspection completed, and the vacant buiiding fee paid.

Chuck Votel reported tius building has been vacant since Mazch of 1997. It is curtentiy in the
AIJD disposition. A code compliance inspection was done. The cost to repair is $25,000 and the
cost to demolish is about $7,750.
Gerry Strathman stated he has a memo &om Sophie Hallauer from HUD who says the property is
valued at $52,000. Mr. Strathman stated he is reluctant to demolish a building with that value.
Chuck Votel stated he is fine with giving HUD time to sell the properry. Also, the properry is
fixable.

Chuck Votel stated he did not receive a green card on this property.
_ �ecily Dewing, Public Works, appeared and stated iliere was a problem with the sewer service
and the manhole that sits on the property next to her house. The sewer problem was repaired.
The house that sits d'uectly behind 743 Englewood is also serviced by this manhole. The part
that was repaired services the two houses. The assessment was made entirely against 743
Englewood Avenue.
Debra Shambo, owner, appeared and stated there were rats in the yazd which came from the
manhole. The manhole was patched. The assessment should be shared by both households.
Cecily Dewing stated the assessment is $755.63.
Gerry Strathman asked why the assessment was against one property. Cecily Dewing responded
the problem was on Debra Shambds properry and this problem with two properties has not
occurred before.
Gerry Strathman recommended reducing the assessment by half plus the administration fees.

James Geske, attomey for Countrywide Home Loans, Inc. appeazed, stating that Countrywide
has been the owner for nine days and is waiting for inshvctions from Fannie Mae with respect to
this properiy. Mr. Geske added thaY, if necessary, it would be more economically feasible for
them to demolish the property themselves. They aze asking for a short extension of time to make
that determination.
Several neighbors spoke indicating that this property has been an eyesore for years, also noting
that there is no plumbing on site and that drug and gun use is taking place there. Beth Randali
from a local non-profit housing group in the community stated that something needs to happen
soon and supports aggressive action regarding this matter.
Mr. Sh�athman recoaunended to approve the order to repair or remove within 15 days.

Tim Nelson, a friend of Clazence Leaf, dr., the owner, stated that most of the repairs have been
made and that Sunset Realtor, Ken Lazson, had sold for the groperty for $29,085 just before it
was condemned.
� Mr. NeLson acknowledged the fact that he has a copy of an inspection report dated July 16`"
which indicates there are some needed repairs which would require pernuts.
Gerry Strathman recommended that the City Council give the owner six months to rehabilitate
the building, subject to the conditions that a$2,000 bond be posted and that all necessary pemuts

Burton Murdock, owner, appeared, and advised he has owned this property since 1954 and
stated that he intends to rehabilitate tivs building by cottverting it back into a single family
dwelling before selling it.
Gerry Strathman recommended that if Mr. Murdock pays ihe vacant building fee, posts a
$2,000 bond and obtaius a code compliance inspection by noon, October 22°� , he be given 180
days to rehabilitate the building.

Clodetta Pratt, the new owner, appeared, advising that she intends to occupy one apartment
upstairs with her funily and use the other as a lazge office area. She indicated that the downstairs
is, and would continue to be, used for dry storage - with no heat, very little lighting and no
plumbing. Ms. Pratt also stated that the rear portion of the building would be used for storage
PuTP�ses oniy.
Ms. Pratt stated that she had spoken with Phil Owens and understood that the fire department
inspection of 7uly 18'� was still vaiid. Gerry Strathman advised that if that is the case, she wi11
not have to have another inspection done.
Mr. Strathman recommended that if Ms. Pratt pays the vacant building fee of $200, posts a
$2,000 bond, and obtains necessary pemuts by noon, Oatober 22'�, she be given six months to
rehabilitate the building.

Gerry Strathman advised that he has had a number of telephone conversatiotts with Mr. Hoff, the
owner, during which it was indicated that he intends to rehabilitate the building. Betsy Kay
Hudecek appeared, stating that the property was purchased in May, 1995.
� Chuck Votel, Public Health, noted that the code compliance of May 16�' states that the building
is a gutted shell about as large as a two-car garage with no windows. Mr. Votel informed Ms.
Hudecek that new building code standards with azchitectural drawings and specifications would
be necessary.
If the $2,000 bond is posted by noon, October 22`� , Mr. StratUman recommended giving the
owner 180 days to complete the rehabilifation.
