We are in receipt of your letter dated December 17, 1996 concerning a sting
operation at our Smith Avenue location of EZ Stop Stores. It is important
I make you aware that your letter was not received in this office until today
and I will consider the five day response time from today. The letter was
not received in our store until December 19, 1996 with a Decenber 18, 1996
postmark.
We do not dispute the highlighted claim from your letter. F7e do, however,
need to see the decoy person at the city council meeting. We trust the
operation was given all the fairness required to show our employee would
have had to have had, without any doubt, substantial irresonsiblity in the
identification of the decoy person.
Please advise me of the City Council meeting we must attend. We are and have
always been a law-abiding organization and will continue to be so. All we
ask for is fairness and equal application.

Dear Sir/Madam:
The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your cigarette license held at the above-named
premises. This recommendation is based on the following:
On December 14, 1996, you or another employee sold
cigarettes to a minor under the age of 18 years in the
licensed premises. This is an offense under Mina. Stat.
§609.685 and Saint Paul Legislative Code §324.07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Council.
You wi11 have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imnosed.
If you do dispute the above facLS, a hearing will be set before an
Administrative Law �udge. At that hearing both you and the City
will be able to apoear and present witnesses, evidence and cross-
examine Che other's witnesses. The Council wi11 ultimately decided
the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, wit��a 5 days, and we will take the necessary steps

We are in receipt of your letter dated December 17, 1996 concerning a sting
operation at our Smith Avenue location of EZ Stop Stores. It is important
I make you aware that your letter was not received in this office until today
and I will consider the five day response time from today. The letter was
not received in our store until December 19, 1996 with a Decenber 18, 1996
postmark.
We do not dispute the highlighted claim from your letter. F7e do, however,
need to see the decoy person at the city council meeting. We trust the
operation was given all the fairness required to show our employee would
have had to have had, without any doubt, substantial irresonsiblity in the
identification of the decoy person.

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your cigarette license held at the above-named
premises. This recommendation is based on the following:
On December 14, 1996, you or another employee sold
cigarettes to a minor under the age of 18 years in the
licensed premises. This is an offense under Mina. Stat.
§609.685 and Saint Paul Legislative Code §324.07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Council.
You wi11 have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imnosed.
If you do dispute the above facLS, a hearing will be set before an
Administrative Law �udge. At that hearing both you and the City
will be able to apoear and present witnesses, evidence and cross-
examine Che other's witnesses. The Council wi11 ultimately decided
