97-1099Council File # 7— lO q q Green Sheet # 3�,� \� Presented Referred To Committee Date 1 WI�.REAS, on June 17, 1997, Frank Wallner, filed an appeal of the Board of Zoning Appeals decision in 2 Zoning File No. 97-192; and 3 WHEREAS, the decision of the Board of Zoning Appeals contained in Zoning File No. 97-192 included a 4 finding that the Burlington Northern Sante Fe Railway pazks, rather than stores, trailers on railway property east of 5 Snelling Avenue; and 6 WI IEREAS, the findings of the Board of Zoning Appeals in Zoning File No. 97-192 was based in part upon an 7 interpretation of the definition of the term "storage" as it appears Saint Paul Legislative Code § 60.219.5; and 8 WI�REAS, the Boazd of Zoning Appeals intexpreted Legislative Code § 60.219.5 to create a seven (7� day 9"bright line" between parking and storage such that the trailers at issue in Zoning File No. 97-192 were parked if the 10 trailers were located on railway property seven (7� days or less but stored if the remained on railway property eight 11 (8) or more days; and 12 WHEREAS, the Board of Zoning Appeals seven (� day "bright line" definition of parking is too long and 13 thereby creates situations which make enforcement of the City's zoning ordinances virtually impossible and creates 14 confusion on the part of property owners who must comply with the City's zoning ordinances as they relate to 15 storage and parking, all to the determent of public health, welfare and safety; NOW, THEREFORE, 16 BE IT RESOLVED, that the Council of the City of Saint Paul hereby requests the Ciry's Planning Commission 17 to review the present zoning ordinances governing "parking° and "storage" for the purpose of improving public 18 health, welfare and safety by clarifying the distinction between "parking" and "storage" and shonening the present 19 "bright line" time period for parking and storage to a time period which simplifies zoning enforcement and aids 20 zoning compliance, and report back to the City Council with recommendations on this issue by October 29, 1997.
