1 WIIEREAS the state legislature has recently amended the provisions of Minnesota
2 Statute §65A.50 to enable municipalities to escrow a greater portion of insurance settlement
3 proceeds for the purpose of securing, repairing or demolishing siructures significantly damaged
4 by fire; and

WHEREAS the statute requires a municipality to elect participation in the statutory
arrangement by formal resolution with notice to the state commissioner; and
WHEREAS the members of the City Council find that the statute provides a sound and
wise opportuuity to unprove the enforcement options of city o�cials who must take steps to
ensure that fire-damaged structures within the City aze secured, repaired or demolished as
quickly as possible; therefare
BE IT RESOLVED, that the Ciry of Saint Paul elects to participate in the withholding
provisions of Minnesota Statutes §65A.50. As required by the statute, the city treasurer has
established a hust ar escrow account to be used as prescribed by the statute. In addition, the City
of Saint Paul states its intention to apply uniformly the statute with respect to all properry within
the municipality. A copy of this resolution shall be forwarded to the commissioner of commerce
of the State of Minnesota so that the City may be placed on the appropriate list which is
distributed to the insurers required to eserow funds under the statute.

insurance settlement proceeds to cover city costs for securing, repairing or demolishing
fire damaged structures. The Statute requires a formal resolution for Saint Paul to take
advantage of this opportunity
ADVANTAGESIFAPPROVED:
Saint Paul will be able to escrow insurance settlement funds on fire damaged buil.dings iE
necessary to pay costs incurred by the City.
D{SADVA4ITAGES IF APPROYED.
A new budget code has to be created. This will increase the workload for Public Health
Enforcement personnel and the City Attorney's Office.
