RESOLVED, that the Liquor Off-Sale, Orignial Container, and Cigarette licenses
(License ID #91884) held by Family Liquor S Corporation d/b/a Capitol Wine and Spirits and
located at 531 Rice Street in Saint Paul aze hereby suspended for a period of fourteen (14)
days, two of the days to be stayed for a period of eighteen (18) months, commencing at 12:01
am. on Wednesday, September 3, 1997 for the violation of sale of alcohol to an underage
person. This fourteen day penalty includes two days which were suspended from a previous
violation of sale of alcohol to an underage person, under Council File 96-1267), as well as a
new penalty of Ywelve days for the current violation. Twelve days is recognized as an upward
departure from the presumptive penalty far this violation set forth in Saint Paul Legislative
Code §409.26.
FURTHER RESOLVED, that the grounds for the upward departure in this instance
are:
1. That the two violarions occurred within only ten months of each
other.
2. That the policy of enforcement by the Licensing Office which
treats a first violation as a warning means that there have been
multiple violations at this address.
3. That the police report indicates that the clerk who sold the
alcohol thought that one of the two individuals buying was too
young, but he sold to her companion anyway.

Dear Sir/Madam:
Please take notice that a hearing concerning the above-named
establishment has been scheduled for 4:30 p.m., Wednesday, August
13, 1997 in the City Council Chambers, Third Floor, Saint Paul City
Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the facts
contained in the report concerning the unlawful sale of alcohol
have not been disputed. You will have an opportunity at the
Council hearing to present oral and/or written remarks as to the
penalty, if any, to be imposed.
The recommendation of the license office will be for an eight day
suspension of all licenses. This penalty is composed of the
standard six-day suspension of all licenses for second violations,
plus the addition of the two days that were stayed for eighteen
months under C.F.96-1267 for the August 14, 1996 violation of Sale
of Alcohol to Underage Persons.

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your licenses based on the following information:
Oa 3une 25, 1997, employee Phann Soreth sold a six-pack
of Miller Lite beer to two underage females without
checking their identifications.
If you do not dispute the above facts, please send me a letter so
that the matter can be scheduled before the City Council for a
hearing on what penalty, if any, to impose. You will be allowed
to speak on your behalf at that hearing.
If you believe thaC the facts stated above are in error, you are
entitled to an evidentiary hearing before an administrative law
judge. in that event, you would receive a notice of hearing,
with the date, time and place of the hearing and the name of the
administrative law judge.

On 6-25-97 I, alang with Sgt. Wachal and Kris Schweinler of LIEP went to Capital Wine &
Spirit5located at 531 Itice Street to attempt to have the estab]ishment se11 an aicoholic beverage
to either of the two underage girla that we sent into thc establishment. Both of these young ladies _
were photographed and identified by their IvLnnesota Drivers Licenses in our office prior to
Ieaving �'or the liquor estabiishmenu we were to visit. They were boih under twen�y one yoars of �
age.
At 1449 hours, we sent them in with a pager bug that broadcast to the monitor in our van that
was parked outside. A. few mim�ces later they came out carrying a bag. They went in without
one. They relayed that they were able to purchase one six-pack of Miller Lite beer and Curned it
over to Sgt. Wachal who later placed it in the Property Room as evidence.
The decoy9 eald that they purehased the beer from an Asian msle weazing glasses. � went inside
with Ma. Schweinler and spoke to a party that matched the given descripdon. He was identified

Dear Sir/Madam:
Please take notice that a hearing concerning the above-named
establishment has been scheduled for 4:30 p.m., Wednesday, August
13, 1997 in the City Council Chambers, Third Floor, Saint Paul City
Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the facts
contained in the report concerning the unlawful sale of alcohol
have not been disputed. You will have an opportunity at the
Council hearing to present oral and/or written remarks as to the
penalty, if any, to be imposed.
The recommendation of the license office will be for an eight day
suspension of all licenses. This penalty is composed of the
standard six-day suspension of all licenses for second violations,
plus the addition of the two days that were stayed for eighteen
months under C.F.96-1267 for the August 14, 1996 violation of Sale
of Alcohol to Underage Persons.

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your licenses based on the following information:
Oa 3une 25, 1997, employee Phann Soreth sold a six-pack
of Miller Lite beer to two underage females without
checking their identifications.
If you do not dispute the above facts, please send me a letter so
that the matter can be scheduled before the City Council for a
hearing on what penalty, if any, to impose. You will be allowed
to speak on your behalf at that hearing.
If you believe thaC the facts stated above are in error, you are
entitled to an evidentiary hearing before an administrative law
judge. in that event, you would receive a notice of hearing,
with the date, time and place of the hearing and the name of the
administrative law judge.

On 6-25-97 I, alang with Sgt. Wachal and Kris Schweinler of LIEP went to Capital Wine &
Spirit5located at 531 Itice Street to attempt to have the estab]ishment se11 an aicoholic beverage
to either of the two underage girla that we sent into thc establishment. Both of these young ladies _
were photographed and identified by their IvLnnesota Drivers Licenses in our office prior to
Ieaving �'or the liquor estabiishmenu we were to visit. They were boih under twen�y one yoars of �
age.
At 1449 hours, we sent them in with a pager bug that broadcast to the monitor in our van that
was parked outside. A. few mim�ces later they came out carrying a bag. They went in without
one. They relayed that they were able to purchase one six-pack of Miller Lite beer and Curned it
over to Sgt. Wachal who later placed it in the Property Room as evidence.
The decoy9 eald that they purehased the beer from an Asian msle weazing glasses. � went inside
with Ma. Schweinler and spoke to a party that matched the given descripdon. He was identified

RESOLVED, that the Liquor Off-Sale, Orignial Container, and Cigarette licenses
(License ID #91884) held by Family Liquor S Corporation d/b/a Capitol Wine and Spirits and
located at 531 Rice Street in Saint Paul aze hereby suspended for a period of fourteen (14)
days, two of the days to be stayed for a period of eighteen (18) months, commencing at 12:01
am. on Wednesday, September 3, 1997 for the violation of sale of alcohol to an underage
person. This fourteen day penalty includes two days which were suspended from a previous
violation of sale of alcohol to an underage person, under Council File 96-1267), as well as a
new penalty of Ywelve days for the current violation. Twelve days is recognized as an upward
departure from the presumptive penalty far this violation set forth in Saint Paul Legislative
Code §409.26.
FURTHER RESOLVED, that the grounds for the upward departure in this instance
are:
1. That the two violarions occurred within only ten months of each
other.
2. That the policy of enforcement by the Licensing Office which
treats a first violation as a warning means that there have been
multiple violations at this address.
3. That the police report indicates that the clerk who sold the
alcohol thought that one of the two individuals buying was too
young, but he sold to her companion anyway.

On 6-25-97 I, alang with Sgt. Wachal and Kris Schweinler of LIEP went to Capital Wine &
Spirit5located at 531 Itice Street to attempt to have the estab]ishment se11 an aicoholic beverage
to either of the two underage girla that we sent into thc establishment. Both of these young ladies _
were photographed and identified by their IvLnnesota Drivers Licenses in our office prior to
Ieaving �'or the liquor estabiishmenu we were to visit. They were boih under twen�y one yoars of �
age.
At 1449 hours, we sent them in with a pager bug that broadcast to the monitor in our van that
was parked outside. A. few mim�ces later they came out carrying a bag. They went in without
one. They relayed that they were able to purchase one six-pack of Miller Lite beer and Curned it
over to Sgt. Wachal who later placed it in the Property Room as evidence.
The decoy9 eald that they purehased the beer from an Asian msle weazing glasses. � went inside
with Ma. Schweinler and spoke to a party that matched the given descripdon. He was identified

looked too young, but the other iooked to be 22 years old.
