Please take notice that a hearing concerning the above-named
establishment has been scheduled for 4:30 p.m., Wednesday, August
13, 1997 in the City Council Chambers, Third Floor, Saint Paul City
Aall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the facts
contained in the report concerning the unlawful sale of wine have
not been disputed. You will have an oppartunity at the Council
hearing to present oral and/or written remarks as to the penalty,
if any, to be imposed. The recommendation of the license office

Dear Sir/Madam:
The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against the on-sale wine license held by you at the above-
named premises. This recommendation is based on the following
information:
Cafe Latte has aa oa-sale wine licease.
Pursuant to Saint Paul Legislative Code �
409.15(a)(2), wiae may�oaly be sold with food
items. Oa May 22, 1997 officers from the Saiat
Paul Police Departmeat weat to Cafe I,atte ia
respoase to iaformation that the establiahment
was serviag wine ia violatioa of the oa-sale
wine license requiremeats. They were able to
purehase a glass of wiae without aay food.
The requested penalty will be for a one-day suspension of your on-
sale wine license, or an alternative £ine. This would not affect
your other licenses at that location.
If you do not dispute the above facts, please send me a letter
stating that they are true so that the matter can be scheduled
before the City Council for a hearing on the agpropriate penalty,
if any, for this violation. You will have a chance to appear and

make a statement before the Council on your behalf.
If you wish to dispute the facts, you are entitled to an
evidentiary hearing before an administrative law judge._If you wish
to have such a hearing, please send a letter stating that you are

administrative law judge, and an e�lanation of the procedures.

compliance check at 1630 hours on 5-22-97. �—
Upon entering the establishment, we observed many customers buying food from a cafeteria
style restaurant. We proceeded to the cashier at the end of the cafeteria line and asked for a glass of
Chazdonnay. I paid her $4.09 for it. 5gt. Polyak and I sat down. I sampled the contents ofthe glass. It
was wine.
I re-approached the cashier identified myself as a St. Paul police officer with my badge on my
neck and asked her to find someone to relieve her so I could speak to her for a few minutes. She did so
and sat down with Sgt. Polyak and me. c�.
She was verbally identified as DECKER. HEATHER dob 3-30-70 of417 Grand Ave. W(P
224-5687. I told her that she had soid wine to me w ithout selling me food along with it. She said she
knew she had to sell wine with food but had been there for nine hours so faz today. �
We had the owne� OUINN. PETER come over to speak to us. He said he had a wine license
that pertained to the percentage of sales of food to the sales of wine. He also wanted to know the
defrnition of food; whether it was a meal or a piece of candy. I told him to contact L.I.E.P. with his
questions.
The glass of Chazdonnay was left on the table �vhere we interviewed both people. It had virtually
all the wine still in it.

establishment has been scheduled for 4:30 p.m., Wednesday, August
13, 1997 in the City Council Chambers, Third Floor, Saint Paul City
Aall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against the on-sale wine license held by you at the above-
named premises. This recommendation is based on the following
information:
Cafe Latte has aa oa-sale wine licease.
Pursuant to Saint Paul Legislative Code �
409.15(a)(2), wiae may�oaly be sold with food
items. Oa May 22, 1997 officers from the Saiat
Paul Police Departmeat weat to Cafe I,atte ia
respoase to iaformation that the establiahment
was serviag wine ia violatioa of the oa-sale
wine license requiremeats. They were able to
purehase a glass of wiae without aay food.
The requested penalty will be for a one-day suspension of your on-
sale wine license, or an alternative £ine. This would not affect
your other licenses at that location.
If you do not dispute the above facts, please send me a letter
stating that they are true so that the matter can be scheduled
before the City Council for a hearing on the agpropriate penalty,
if any, for this violation. You will have a chance to appear and

If you wish to dispute the facts, you are entitled to an
evidentiary hearing before an administrative law judge._If you wish

compliance check at 1630 hours on 5-22-97. �—
Upon entering the establishment, we observed many customers buying food from a cafeteria
style restaurant. We proceeded to the cashier at the end of the cafeteria line and asked for a glass of
Chazdonnay. I paid her $4.09 for it. 5gt. Polyak and I sat down. I sampled the contents ofthe glass. It
was wine.
I re-approached the cashier identified myself as a St. Paul police officer with my badge on my
neck and asked her to find someone to relieve her so I could speak to her for a few minutes. She did so
and sat down with Sgt. Polyak and me. c�.
She was verbally identified as DECKER. HEATHER dob 3-30-70 of417 Grand Ave. W(P
224-5687. I told her that she had soid wine to me w ithout selling me food along with it. She said she
knew she had to sell wine with food but had been there for nine hours so faz today. �
We had the owne� OUINN. PETER come over to speak to us. He said he had a wine license
that pertained to the percentage of sales of food to the sales of wine. He also wanted to know the
defrnition of food; whether it was a meal or a piece of candy. I told him to contact L.I.E.P. with his
questions.
The glass of Chazdonnay was left on the table �vhere we interviewed both people. It had virtually
all the wine still in it.

establishment has been scheduled for 4:30 p.m., Wednesday, August
13, 1997 in the City Council Chambers, Third Floor, Saint Paul City

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against the on-sale wine license held by you at the above-
named premises. This recommendation is based on the following
information:

Pursuant to Saint Paul Legislative Code �
409.15(a)(2), wiae may�oaly be sold with food
items. Oa May 22, 1997 officers from the Saiat
Paul Police Departmeat weat to Cafe I,atte ia

was serviag wine ia violatioa of the oa-sale
wine license requiremeats. They were able to
purehase a glass of wiae without aay food.
The requested penalty will be for a one-day suspension of your on-
sale wine license, or an alternative £ine. This would not affect
your other licenses at that location.
If you do not dispute the above facts, please send me a letter
stating that they are true so that the matter can be scheduled
before the City Council for a hearing on the agpropriate penalty,
if any, for this violation. You will have a chance to appear and

compliance check at 1630 hours on 5-22-97. �—
Upon entering the establishment, we observed many customers buying food from a cafeteria
style restaurant. We proceeded to the cashier at the end of the cafeteria line and asked for a glass of
Chazdonnay. I paid her $4.09 for it. 5gt. Polyak and I sat down. I sampled the contents ofthe glass. It
was wine.
I re-approached the cashier identified myself as a St. Paul police officer with my badge on my
neck and asked her to find someone to relieve her so I could speak to her for a few minutes. She did so
and sat down with Sgt. Polyak and me. c�.
She was verbally identified as DECKER. HEATHER dob 3-30-70 of417 Grand Ave. W(P
224-5687. I told her that she had soid wine to me w ithout selling me food along with it. She said she
knew she had to sell wine with food but had been there for nine hours so faz today. �
We had the owne� OUINN. PETER come over to speak to us. He said he had a wine license
that pertained to the percentage of sales of food to the sales of wine. He also wanted to know the
defrnition of food; whether it was a meal or a piece of candy. I told him to contact L.I.E.P. with his
questions.
The glass of Chazdonnay was left on the table �vhere we interviewed both people. It had virtually
all the wine still in it.
