WHEREAS, based upon utility easement Certificates of Intended Non-Use filed voluntarily on behalf
of Northern States Power Company, The Water Utility, MCI Metro, Continental Cablevision and the
Department of Public Works, and made a part hereof by tlus reference and filed in the office of the
Ciry Clerk of Saint Paul, the City for itself and on behalf of these corporations and deparnnents,
waives the right to utility easements in the vacated areas as described in the certificates incorporated
herein.
NOW THEREFORE, BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul Legilative
Code and on behalf of the City of Saint Paul and those persons for whom the Ciry has reserved
easements, the Council of the City of Saint Paul does hereby waive and release the retained Utility
Easements in the vacated public properry as described above.
19 BE IT FURT'HER RESOLVED, that upon passage of this resolution, the City Clerk is hereby
20 authorized and directed to record a copy of this resoluuon in the office of the Registrar of Deeds,
21 Ramsey County, and that the City Clerk shall maintain a copy of all Certificates of Intended Non-Use
22 referenced in this resolution on file in the office of Citizen Services.

I represent Simon & Company, Inc., a Minnesota corporation, the owner of certain
property located at 1830 Como Avenue in St. Paul. I am enclosing a copy of the title
commitment for the property that it owns, the legal description of wluch is contained on
pages 1 and 2. On Schedule B, Section 2 of the commitment, there is shown as Item No.
4 the reservation of easements and rights reserved by Section 228 of the St. Paul Legislative
Code, formerly Ordinance No. 3394 as set forth in Document No. 199322 (a copy of which
is enclosed). Over the years my client has obtained building permits for additions to its
facility which aze now physically located on portions of the vacated alleys and streets. A
copy of the plat of the property is also enclosed for your review.
It is requested on behalf of Simon & Company, Inc. that the City release all of its
retained easements and rights in the vacated alleys and streets which aze part of the legal
description for this properry.
I realize that this make take some time so I would ask that in order to facilitate the
refinancing of the properiy the City provide Simon & Company, Inc. with a letter, which can
be addressed to me, indicating that none of tt►e reserved easements and rights would be
enforced so as to impair the value of the improvements built on the properry or would
require the removal of any of the improvements.

enclosing a survey of the property for your use in deciding wluch areas of the vacated streets
the City and the other utility companies will release their easements reserved pursuant to
Section 228 of the St. Paul Legislative Code. As you can see from the survey, the building
takes up most of the property and I would assume that the City and the utility companies
would not mind releasing their easements on the entire properry which is owned by Simon
