All that part of Douglas Street lying southerly of the westerly extension of the north line of Block 3, Samuel Leech's Addition to St. Paul, and northerly of a circular curve concave to the south having a radius of 33.00 feet, the center of said curve being on the centerline of said Douglas Street at a point 19.28 feet north from the intersection of the said centerline with the westerly extension of the South Line of the North one half of Lot 12, in the said Block 3; Parcel2. That the petitioner shall be responsible for all costs and eapenses, including but not 32 limited to pavement, curbing, sidewalks, boulevards, drainage structures and signage, 33 associated with the relocation of the Douglas Street cul-de-sac and conshuction of a turn- 34 around at the south end of the alley to be vacated. Said relocation and construction shall 35 be to City standards and specifications under an ordinance pernut issued by Public Works 36 Street Engineering Division, and sha11 be in accordance with an approved site plan to be 37 filed in the Office of License, Inspecrion and Environmental Protecrion. 38 39 12. That the peritioner sha11, at its own cost and espense, relocate the existing street light on 40 the west side of Douglas Street and installlighting conduit for future use, a11 as 41 prescribed in a permit to be issued by the Public Works Street Engineering Division. 42 43 13 44 45 That the petitioner shall indicate on a site plan, subject to the approval of the Public Works Sewers Division, how that part of the alley not subject to vacation will drain. �.°� °��-�4 1 14. The petirioner shall dedicate an alley turn-around at the south end of the proposed alley vacation. Said turn-around shall be subject to the approval of the Traffic Engineer. The dedicated area must be of sufficient dimensions for a trash truck (single unit design vehicie) to turn around (180 degrees) in five maneuvers. This is approacimately a 30' x 30` area added to the north end of the remainuig 16' wide alley. 2. The petitioner shall be responsible for all costs and expenses associated with the relocation of the Douglas Street cul-de-sac and construction of a turn-around at the north end of the ailey, including but not limited to, pavement, curbing, sidewalks, boulevards, drainage structures and signage, all of which shall be constructed to City standards and specifications under an ordinance pemut issued by Public Works Street Engineering and in accordance with an approved site plan on file in the Office of License, Inspection and Environmental Protection. 3. If so desired by the neighborhood, pedestrian access shall be maintained from the Douglas Street cul-de-sac to Grand Avenue via a sidewatk within a public easement. The location and cons�uction of said sidewalk shall be subject to Public Work's approval. The petitioner would be responsible for the construction, continued maintenance, repair and/or reconstrucrion of the sidewalk. 4. The exisring street light on the west side of Douglas shall be relocated at the petitioner's expense and in accordance with City specifications. Conduit shall be installed for future use from the cul-de-sac to Grand Avenue with easements being retained in vacated Dougias to protect said conduit. ��-�yc 5. In the proposed vacated area of Douglas St. there is an existing public sanitary sewer. The sewer is located approximately on the centerline of Douglas St. and is a sand rock sewer. A public subterranean easement shall be retained between City datum 50 to 75, for a width of 20 feet centered on the centerline of Douglas St. 6. The proposed alley vacarion may create a drainage problem for the remaining portion of public alley. The alley is relatively flat but appears to drain to the north. The petitioner will need to submit a proposal indicating how tt�e remaining portion of public altey will drain. They should call Dave Conley at 26b-6250 for further information. 7. The peritioner shall submit a site plan showing the proposed use of the vacated alley and street. The latest site plan submitted does not show why they need to vacate the ailey and how it would be used. 8. Ail property owners in Biock 3, Samuel Leech's Addirion should be notified of the public hearing, and the neighborhood district council should address the need for continued pedeshian access from Douglas to Grand. To provide for continued access to our facility the Utility requires that an easement be retained over all of the Douglas Street right-of- way being petitioned for vacation. Restrictions within the area are as follows: No buildings, structures or trees aze permitted within the easement azea, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes. 2. No change from the existing grade or change in surfacing within the easement area is perxnitted without written permission from the Water Utility. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of Water Utility operations, all removal, replacement or modification costs ro restore the petitioner's works shall be borne solely by the petitioner. 4. That the petitioner, its successors and assigns shall fully indemnify, defend and save hannless the Boazd of Water Commissioners, its officers, agents, employees and servants from all suits, actions or claims which shall azise from any injuries or damages received or sustained by any break in any service pipe, water main, or connection in said reserved easement, arising out of or resulting from any action or negligence of the petitioner, its employees, agents or business invitees. For the proposed vacation of part of the alley in Block 3, Saxnuel Leeche's Addition, the Water Utitity has no objection to this vacation.
