They had made other repairs to the property which cost approa�imately $2,000 and the estimate they had received to vent the plumbing system was $1,200. They could not afford this cost at this time and requested that they be allowed more time to make the necessary repairs to the plumbing system. Pat Fish, Fire Prevention, appeazed and stated that unvented plumbing was not legal and could pose a future problem with sewer gas. Mr. Strathman granted a one year e�ension to repair ventilation of the plumbing system. 1362 Westminster Street #301 Sheryl Wallace appeared with her attomey Royce Lawson, 5outhem Minnesota Regional Legal Services. Ms. Wallace stated that she had received a letter and according to the inspector, the problem had been corrected. Ms. Fish stated that since the condemnation order had heen appealed, they were precluded from further inspecting the property. The inspector had an appointment to reinspect the property on 7anuary 17 to determine whether the violations had been corrected. Mr. Strathman denied the appeal for condemnation. 499-501 Grotto Street North Evan Williams appeared on behalf of the property owner, Donald Herke. He presented a list of conection items for the property. He stated that the inspector had indicated to him that the eaterior items would not need correction at this time. He requested that he be given an ea�tension to July 31, 1996 to make those conections. With the issue of the basement doors, he had installed fire-proof doors and used screen door latches as closures. Regarding the water damage and peeling paint in the porch area, he requested he be allowed more time to repair this as this was an unheated azea and it would be difficult to repair at this time. Regazding the issue of overcrowding in one unit, according to his records, there were three adults and three young children occupying the unit. He believed this unit was not overcrowded and it would be a hardship to evict this family. In regazd to the broken storm door, it was removed and since each unit had two separate entry doors, he requested a variance for the installation of storm doors. Ms. Fish stated that she believed the building was in need of serious repair and maintenance and should be completed in a timely manner. On the issue of overcrowding of the one unit, the bedrooms would have to be over 150 square feet in order to accommodate three people in each bedroom. One of the bedrooms did not meet this requirement. He granted a variance allowing the sealed doors and a variance for the storm doors. He denied the variance for overcrowding of the apartment unit. 1918 Carroll Avenue Brenda Phillips appeared and requested they be ailowed to continue using a fire ladder out of window as a second exit for a third floor apaztment unit. The unit was not presently occupied but they were intending to rent it in the near future. Ms. Fish stated that the code does allow for acceptance of an existing fire escape ladder. The condition for this property was that the unit be rented only to a person physically capable of using the fire escape ladder. The report noted that the esit goes through an unfinished attic azea and the recommendation was to enclose this area for safe passage to the exit. Mr. Strathman granted an ea�tension to August 1, 1996 for enclosure of the fire escape route on the condition that the apartment unit be rented only to a physically capable person. He granted a variance for the fire escape ladder. 693 E. Arlinaton Avenue Elizabeth Seropian appeared and requested a variance to a11ow the rainleader on the east and west side of their house remain connected. The neighbor's yard slopes down to theirs and this causes a build up of water which seeps into the basement. 7uliet Seropian, daughter of property owners, appeared and stated that disconnecting the rainleaders would cause a safety concern for her parents as they were both elderly and suffered from physical medical conditions which could be life threatening if they were to fall. Pat Cahanes, Public Works, stated that the recommendation was to allow the rainleader on the east side of the building to continue, however, the rainleader on the west side should be disconnected with gutters running from the back of the property to the front. Mr. Stratlunan granted a variance for the rainleader on the east side of the building and a three year variance to disconnect the rainleader on the west side of the building. 1020 Carroll Avenue Gioria Favis appeared and stated that she purchased the property at a public auction in Aecember, 1995. She was in the process of rehabing the properiy and she believed that having to pay the vacant building fee was an unnecessary financial burden. She requested that the fee be waived. Carolyn Shepard, Public Health, stated that there were two recent summary abatement orders on the � �.Y� Property Code Enforcement Meeting 7anuary 16, 1996 Page - 3 - property; one for snow removal and one for Mr. Strathman denied the appeal to waive the vacant building fee. 2010 Marshall Avenue Dennis Eiynck appeared and stated that the issue concemed window egress in two basement apartments. He was previously ganted a variance for the window egress and sill. The inspector recommended that he apply for a variance allowing the specific window size. Ms. Fish stated that the windows did meet the minimum width and height requirements for window egress. Mr. Strathman granted a variance allowing the egress windows. 1035 Cumberland Street Susan and Gary Reinhazdt appeared and stated that the building was no longer vacant. They had completed all repairs listed in the code compliance and simply needed to have a final inspection of the property before it would be reoccupied. Mr. Strathman granted a two month waiver on payment of the vacant building fee on the condition the building be occupied within that time.
