WI�REAS, at the present time the Saint Paul Legislative Code permits cabazet
licenses to be issued to applicants without any accompanying license for the sale of food or
beverages; and
WHEREAS, no current licensed establishment in the City of Saint Paul has been
issued only a cabaret license; and
WHEREAS, The Council is concerned that there may be a need to limit the issuance
of cabazet licenses as ausiliary to other uses, in certain areas of the City; and
WHEREAS, a study is needed to determine whether a stand-alone cabaret license
would require higher volumes of patrons to be financially feasible than would be needed by a
business in which the license is auYiliary to another use, thereby negatively impacting the land
azeas and neighborhoods in which the cabaret business is located by increasing traffic, noise
and congestion; and
WIIEREAS, such high-density uses might be inappropriate land uses for certain areas
o£ the City; now therefore be it
RESOLVED, That the City Council does hereby request that the staff of the Planning
Division of the Department of Planning and Economic Development conduct a study or
studies involving establishments which have been issued cabaret licenses to determine
whether those uses require additional special consideration because of any adverse effects
that may be caused or related to those types of uses; that the Planning Commission review
those fmdings, conclusions and recommendations; and that the Council be presented with the
reports and advice of the Planning Division and the Planning Commission�-bei�
FURTHER RESOLVED, that the Office of License, Inspections and Environmental
Protection is hereby directed not to accept any new applications or fiirther process any
existing applications which have not already been referred to an administrative law judge for
the issuance of a cabaret license until the studies have been completed and the Council has
taken final action on changes to the Comprehensive Plan; and be it

provide@, however, that in the event that the Council passes and the Mayor approves
a substitute ordinance providing that cabaret licenses shall not be issued except
in conjunction with other Class III licenses, the foregoing study shall not be
necessary and the Council request for it shall be and is hereby withdrawn; and be it

FURTHER RESOLVED, that the Council Secretary shall forward a copy of this
resolution to the Office of LIEP and the Director of the Department of Plamung and
Economic Development.
