WHEREAS, the Council of the City of Saint Paul, by resolutions C.F.265969 appzoved September 2,
1975, C.F. 276540 approved March 20, 1981 and C.F. 87-708 approved May 20, 1987 vacated land
described as follows:
The easterly-westerly alley in Block 2 William's Rearrangement of Block 7 and gart of Block 4
Nelson's Addition.
WHEREAS, based upon utility easement Certificates of Intended Non-Use filed voluntarily on behalf
of the Water Utility,Continental Cablevision, U S West Communications, Inc., Notthem States
Power Company, MCI Metro, and the Department of Public Works, and made a part hereof by this
reference and filed in the off'ice of the City Clerk of Saint Paul, the Ciry for itself and on behalf of
these corporations and departments, waives the right to utility easements in the vacated areas as
described in the certificates incorporated herein.
NOW THEREFORE, BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul L,egislative
Code and on behalf of the City of Saint Paul and those persons for whom the Ciry has reserved
easements, the Council of the City of Saint Paul does hereby waive and release the retained Utility
Easements in the vacated public property as described above.
BE IT FURTHER RESOLVED, that upon passage of this resolution, the City Clerk is hereby
authorized and directed to record a copy of this resolution in the office of the Registraz of Deeds,
Ramsey County, and that the City Clerk shall maintain a copy of all Certificates of Intended Non-Use
referenced in this resoluuon on file in the office of Citizen Services.

PETITION TO RELEASE RETAINED EASEMENTS
The Petitioners, (See Exhibit A) do hereby petition the Council of the City of
St. Paul to release the retained easements located within the vacated alleys
described as follows:
That part of the vacated east and west alley originally platted in
Block 2 of WILLIAMS REARRANGEMENT OF BLOCK 7 AND PART OF BLOCK 4,
NELSON'S ADDITION TO THE CITY OF SAINT PAUL (now replatted as Lot
1, Block 1, ANDREW ADDITION), which lies adjaaent to Lots 8
through 34 inclusive, and adjacent to the west 13.00 feet of Lots
2 and 35, all in Block 2, said WILLIAMS REARRANGEMENT OF BLOCK 7
AND PART OF BLOCK 4, NELSON'S ADDITION TO THE CITY OF SAINT PAUL
(now replatted as Lot 1, Block 1, ANDREW ADDITION)
and
That part of the vacated east and west alley originally platted in
CHARLES WEIDE'S SQBDIVISION OF BLOCK 40 OF ARLINGTON HZLLS

described be and the same are hereby vacated and discontinued as public right-of-

cod3tied March 1, 1981 of the St. Paul Legislative Code, as amended. '
2. That a permunent water utility easement be retained on behalt of the City of
Saint Paul, Board �of Water Commisstoners over, under, and across the
westerly 310 feet of vacated Wells Street subject to the following restrictions:
a. No buildings, stn�ctures or trees are permitted within the easement area;
or any temporary structure, material, storage, fixture or other objects that
will prohiUit normal access to water facitities for maintenaace purposes.
U. No change !rom the existing grade is permitted without written
permisston from the Water Utility.

subject to lhe following conditions:

nor any temporary structure, materiul storage, fixture or other objects.

Its ofticers, agents, employees, and servants from all suits, actions or
claims which shall arise from any injuries or damages received or

4. . That a specitic easement be'retalned withln the vacated area of Wells Street
to protect the interest ot Northern States Power Company Electric Division.
5. That the petitioner, Mdrew Realty Corporation, shall be responsible for all ,
cost and expenses tn the closing off ot the vacated areas including but not
limited to costs�related to the construction of curbs, boulevards, sidewalks
and drainage facilities as deemed necessary by the Departpient of Public
Works.
G. That the petitioner, Andrew Realty Corporation shall pay to the City of Saint
Paul y11,232 as compenation for this vacation. Said compensation is due and
• payable within 60 days of the publication date of this resolution.
7. That the petltioner, Andrew Realty Corporation; its successors or assigns, by
acceplance of the terms and conditions of this vacation, agrees to indemnify,
de(end and save harmless the City of Saint Paul, its officers and employees
trom all suits, actions or claims of any character brought as a result of
injurles or damages recefved or sustained by any pexson, persons or property
on account of this vacation including but not limited to a claim brought
because ot any acl ot omission, neglect or misconduct of said pefitioner or
because ot any claims or liabllity arising from any violation of any law or
regulat(on made in accordance with the law whether by the petitioner or any
of its agents or employees. �
8. That the petttioners, Andrew Realty Corporation and Northern Malleable
Iron Company shall withln 80 days of the publication date of this resolution
file witl� the Ctty Clerk an acceptance in writing of the conditions of this
resolution and shall,within lhe period(s) specdfied in the terms and conditions
of this resolution comply in all respects with these terms and conditions.
