STAFF INVESTIGATION AND REPORT: DATE OF HEARING: May 22, 1996 between William Tell & Valley View ZONING CODE REFERENCE: DATE: May 13, 1995 BY: 67.405; 67.406 Mike Kraemer A. PURPOSE: To consider the preliminary and final plat application to allow property to be subdivided into 8 new lots foz single family homes. SITE & AREA CONDITIONS: The property is approximately 656.55 feet wide and 617.5 feet deep and 405,420 square feet or 9.3 acres in area. The property is currently vacant with mature trees around the area of the previous home and garage site with scattered trees and vegetation covering the rest of the site. The site rises from McKnight Road and has gentle slopes with a rolling terrain. The southwest corner of the property has a low area with water which the proposed development would not affect. Building inspection records indicate that a single family house was built on this property in 1926 and a demolition permit was taken to remove the house and garage on December 20, 1995. The permit indicates that demolition was completed by December 22, 1996. The adjacent properties are developed with single family homes including land east of McKnight Road within the City of Maplewood. BACKGROUND: The property was acquired by the applicant in May 1993 with the intent to develop it with residential housing. The applicant went to the District One Community Council in 1995 with a proposal to develop the property with 40 townhome units. This proposal was met with much opposition from the neighborhood and would have required a rezoning of the parcel from R-1 residential single family for a townhome use. The existing zoning of R-1 would allow single family homes to be developed with a minimum lot area of 9,600 square feet. Using this minimum lot area requirement, the property could accommidate approximately 25-30 lots for single family homes with new street improvements into the property. • The applicant and the community council worked together on an agreeable single family housing development for the site. In February 1996, the District One Community Council voted to support the subdivision of the property into 8 lots, each lot measuring approximately 82' X 617.55' and 50,600 square feet in lot area and all fronting on McKnight Road. No new street improvements are associated with this proposal. The applicant estimates that each house with lot will sell for around $240, 000. With the reduced density of the subdivision, the district council also voted to encourage the City to work with the applicant to reduce fee structures related the development of the property. The Department of Planning and Economic Development has no programs available towards reducing the fees or costs related to this development. -` �e-� 1�- • Mike Kennedy Plat Staff Report #96-062 May 13, 1996 Page Two D. DISTRICT COUNCIL RECOMMENDATION: On February 12, 1996, the District 1 Community Council Hearing Committee voted to support the plat for 8 lots £or single family homes with a 200' setback buffer along McKnight Road and a 50' setback at the rear of the property. District 1 also recommended that the developer work with the City on reducing fee structures such as building permits, water and sewer hook-up fees in exchange £or the reduced density of the development. E. REOUIRED FINDINGS 1. All the applicable provisions of the Legislative Code are complied with. City staff have reviewed the proposed plat and determined that it meets all requirements and standards of the City. 2. The proposed subdivision will not be detrimental to the present and potential surrounding Iand uses. The property is developed with uses compatible to the area. 3. The area surroundinq the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The surrounding area and the area of the proposed preliminary and final plat are compatible with respect to land uses. , 4. The subdivision is in confoxmance with the Comprehensive Plan. The property is in compliance with the comprehensive plan for this area of the city. 5. The subdivision preserves and incosporates the site's important existing natural features, whenever possible. Existing natural features have been preserved where possible in the plat. 6. All land intended for building sites can be used safely without endangering the residents by peril from floods, erosion, continuous2y .high water tabZe, severe soil conditions or other menace. The land can be safely developed. 7. The subdivision can be economically served with public faci2ities and services. The lots have access to municipal services located in McKnight Road. F. STAFF RECOMMENDATION: Based on the above findings, staff recommends approval of the preliminary and final plat for Skyline Overlook Addition by Mike Kennedy with no waivers or reductions in City fees relating to the development of the property. Staff has no objections to District One's endorsement for a proposed 200' front setback and the 50' rear setback for any buildings, but does not require them as a condition of the approval of • the preliminary and final plat. A fairly large number of residen[s who live beside or near tl�at property were also present. The Hearing Committee and neigl�bors were satisfied with your pian, and felt you had made a conceried eEfort to listen to the cotmm�nity people when yo� developed it, creating fewer lots, and leaving much of the land as it has been. The Hearing Committee passed the foilowing resolution that night: "To endorse the proposed 81ot development between William Tel( Road and Valley View Place, including Uie 20U ft. conservency buffer �long McKnight Road and 50 ft. back buffer, and td encourage the City of St. Paul to work creatively wuh Mc Kennedy on reduced fee struclures, to make this proposal economically viable." The Committee was referring to reductions or waivers oF fees sucli as buiiding pem�it fee, water and sewer hook-up fees, etc. The Dislrict 1 Board, at its February 26th meeting, endorsed your plan. We appreciate your efforts to develop a plan for the property that is acceptable to Q�e neighbors and the Council and one tiiat Eits into the guidelines of the Highwood Plan.
