Said suspension shall commence on �� �� \'l 1996 , unless prior to that time the licensee has shown satisfactory proof to the D'uector of License, Inspections and Environxnental Protection that the establishment has been voluntarily closed for business by the licensee for an equal rime period since the date of the violation. This Resolutaon and the action taken above aze based upon the facts contained in the Police Report CN 96-046-982, the facts of which are summazized in the April 30, 1996 letter to the licensee, and the admissions of the licensee that he does not dispute the facts stated in the Notice of Complaint letter, and such azguments as may have been presented to the Council at the public heazing. The basis for the adverse action is: "On or about April 6, 1996 at approximately 1:00 p.m., a narcotics seareh warrant was served on the licensed establishment. The bartender, Ms. Debra Otterson, was found to have suspected narcotics in her possession. Ms. Otterson was arrested and charged with possession of a controlled substance with the intent to distribute. An employer is responsible for the acts of his/her employees. Hoskin, FORCE LTnit, Squad 662), was in chazge of the seazch warrant executed by Officer S. Payne, at the Viaduct Bar, 1056 E. 7th, 1220 hours, 4/6/96. Information had been developed that the female bartender, (Otterson, Debra Jean, DOB 11 /28/54), had been selling bindles of cocaine that she kept in her black purse, behind tt�e baz. A previous controlled buy had been made. Officers Smalik and Panos sat in the baz in plain clothes, about a half hour prior to executing this warrant. They saw her go to her purse twice, but didn t observe her make any appazent transactions with any of the patrons. About twenty people were inside, most of which appeared to be a family gathering, at tables together, ordering lunch. Just prior to executing this warrant, Officer Payne attempted to make an agent buy from her, at the bar, but she declined, claiming that she doesn't do that. It was at that point that the rest of the FORCE unit officers entered the bar to secure the premises:( Officers Korus, Flaherty, Moriarty, and Trow.) I spoke with the owner, (Sirian, Lou Jerry, DOB 8/22/36) and his wife. He says he owns two other bazs, as well -"Joe and Stan's' in St.Paul, and "Lee's" in 1Vlinneapolis. I told him that we--- had a search warrant for the baz, and the bartender, for cocaine. He said that he had no idea that she was doing anything like that. He says he spends very little time at this baz, and that the baz is losing money because of it. I toid him that the business would be closed for todap, if cocaine was_ _ located behind the baz:_Iie agreed, and said he was considering closing the bar permanently next weekend, anyway. _ - — - - It was shortly after, that I was notified that suspect (Otterness), when confronted with the seazch wanant, admitted ttiat she had cocaine in her (black) purse, (which was located at the end of the bar), and agreedto show it to the o�cers. Several bindles of suspected_cocaine were then located inside her purse. (Along with her MN photo DL). I then announced ihat the baz was now closed for today. Tlie pa�rons were instructed to leave. She was handcuffed, and told that she did not have to talk to us. (By O�cer Korus) When she was escarted outside, i asked her which caz was hers. She pointed to a red Camazo. I asked if we could search it for drugs. She said yes and instructed officers to go back inside the baz and get het keys. She said we would find no cocaine in it, but would find a bag of mazijuana. In seazchin�-fi�ie-e�O�cefS�tolik did find a baggie of suspected marijuana.Otterness then admitted that she had more cocaine back at her address in Oakdale, (1522 Helmo), and agreed to sign a consent to search form, and accompany us there to recover it. She asked that we drive her caz back to her address for her, as long as we were going there anyway. Officer Moriariy did so. PA�JL RO(.ICE CONTINUATION bF: ( ORIGINAL REPORT qG-��y I called ahead and arranged for Oakdale PD Sergeant Keven Gorsuch to meet us at 1�22 Helmo. He signed the consent to seazch form as a wimess. Ottemess then brought officers upstairs to her bedroom and pointed out where to look for the rest of her drugs. Oakdale PD Ser�eant Gorsuch officially recovered the suspected controlled substances, (Oakdale CI�T96-035v50), and pazaphernalia, and riuned it over to FORCE Officers Korus/Payne. Officer Flaherty, meanwhile, had a conversation with Ottemess's boyfriend, who was also at 1522 Helmo at the time. The boyfriend made acknowledgments of Otterness using and selling cocaine. He denied selling himself, but admitted that his fingerprints might be on the bindles, because he helped her cut the bindles up and package it. See Flaherty's report. Ottemess's thirteen year old son was not home at the time. The boyfriend said that the son had no knowledge of drugs in Otterness's home. The bo� friend was not arrested. Officer Trow then transported Ottemess to HQ for interview and booking. Otterson had $1010 cash in her purse. Otterson told me that $200 of that cash was her grocery moaey and the rest of it belonged to the person she was selling cocaine for. I searched Ottersons vehicle, be£ore doing so Otterson told me that she had marijuana in her car, MN license 545 FPW, above the visor. 2 found a baggie of marijuana above the drivers side visor. After we were calied in by Officer Pa}�ne, the affiant, I stood by and watched the bar area. After the female bartender, OTTERSON, DEBRA was arrested she gave a signed consent seazch to Officer Payne for her house at 1�22 He1mo, Oakdale. Officer Trow and I drove her to this address with other FORCE Officers. With the consent search in hand we �tent into the unlocked house and woke the male that was sleeping in the bedroom. We broueht OTTERSON to the bedroom and I searched the bedroom. I recovered the following items that �� ere �� itness and signed off by Sgt. After the seazch was completed, We proceeded to 1522 Helmo in Oakdale where we conducted a consent to seazch on Ottersons townhouse. During the coutse of the seazch, I spoke to Ottersons boyfriend who was identified as Mauricio, Carl Anthony, DOB 7-23-�6 2447 W. Co. Rd. C#32L He told me that he has been dating Otterson for about a yeaz. He said that he doesn't judge people on what they do and whatever she does is her business. He said that he knows that she sells cocaine and just does it to make extra money. He said that she uses the cocaine herself a couple of times a day on the weekends but didn't think that she did it during the week. He said that she never sniffs the cocaine in front of her son. Mauricio said that his fingerprints may be on the bindles because he sometimes helps her cut it up and package it.
