Bill Wilcox, properiy owner, appeazed and stated that his buildings were inspected for the certificate of
occupancy and the inspector cited him for overcrowding in several units. He explained that the units were
one bedroom, 123 %z squaze feet, and the dimensions of the entire unit were 460 square feet. In the units cited
for overcrowding, there were two adults and a child in one and one adult and two children in the other. He
explained that it was very difficult to find good tenants and he did not want to evict these tenants.
Gerry Strathman, Legislative Hearing Officer, reviewed the code concerning required space in dwelling units
and sleeping rooms. Accoxding to the code, the dwelling units were large enough to accommodate three
individuals, however, the sleeping azea would have to be 150 squaze feet which it was not Considering that
the total dwelling unit was within the code, he granted a two yeaz vaziance.
628 Grand Avenue
Diana Allen, property manager, appeazed and stated that she was appealing the requirement to install an
additional outlet to each kitchen unit in the building. There were 27 units in the building which were basicaliy
rented to students attending nearby colleges. She stressed that they did not rent to any families where lazger
appliances would be required which may cause a safety hazard. In order to comply with the order, they would
need to rewire the entire electrical system in the building at a cost in excess of $15,000. They could not afford
this expense and would be unable to recover the cost to make those necessary improvements.
Mr. Strathman granted a two year variance and suggested that Ule owner explore any opportunities to improve
the electrical system which might be at a more reasonable cost.
1014 Euclid Street
Daniel Rohricht, property manager, appeazed and stated that he was appealing the 10 day timeframe to make
the necessary repairs as well as to remove a space heater in the home. He explained that he had installed
electric base-board heat in the house and tumed off the space heater as it was no longer needed as a source
for heat. To remove the space heater would be an inconvenience as it was located in the middle of a floor and
it would necessitate replacing the carpeting again. He also stated that a 10 day timeftame to replace windows
and frames was unreasonable as they would have to be measured, ordered and then installed.
Mr. Strathman reviewed the code concerning space heaters. The code required that they be able to perform
the function for which they were designed and also required proof of service by a licensed contractor along
with carbon monoxide testing.
Dick Lippert, Public Health, stated that Mr. Rohricht was the owner of record for the properiy. This properry
had been a continuance problem as the owner constantly delayed making the necessary repairs as ordered and
this was the basic reason why he was only given 10 days to make these repairs. He pointed out that the repairs
were ordered on May 6, 1996 and he had 30 days as of this date to make those repairs and nothing had been
done.
Mr. Strathman stated that given the fact that the owner had already had 30 days as of this date to make repairs
and had done nothing, he denied the request for an extension of time. He also denied the request that the
space heater remain inoperable.
