WHEREAS, the Council of the City of Saint Pau1, upon the petition of the Port Authority of
Saint Paul and the Minnesota Department of Transportation, as contained in Finance Department File
Numbered 12-1995 did, by that resolution stated in Council File Numbered 96-238, approve the
petition to vacate and discontinue as public property, that portion of Adrian Street abutting the
northwest side of Block 42, West End Addition; Lots 3& 4, Biock 43, West End Addition and
Lots 21 thru 25, Block 1, Park Addition to accommodate the development of the Crosby Lake
Business Pazk, and
WHEREAS, a portion of description was omitted from Council File Numbered 96-238; and
WHEREAS, the petitioner, the Department of Public Works and Department of Finance are awaze
ofthisomission; NOWTHEREFORE,
BE IT RESOLVED, that Council File Numbered 96-238 is hereby amended to the following:
.., that portion of Adrian Street abutting the northwest side of Block 42, West End Addition;
Lots 3& 4, Block 43, West End Addition; Lots 16 thru 25 and the southeasterly portion of
Lot 26, Block 1, Park Addition and a portion of the northwesterly side of Government
Lot 2, hereinafter referenced to as the legal description in Exhibit "A" ...

RESOLVED, that upon the perition of Port Authority of the City of Saint Paul and the
Minnesota Department of Transportation, per Finance File I`To. 12-1995, that portion of
Adrian Street abutting the northwest side of Block 42, West End Addition; Lots 3 and 4,
BIock 43, West End Addition and Lots 21 thru 25, Black 1, Park Addition, hereinafter
referenced to as the legal description in E�ibit "A", is hereby vacated and discontinued
as public property and that the easements within the said public property are also hereby
released; subject to the following conditions:
1. That this vacation shall be subject ta the terms and condition of Chapter 130,
codified March 1, 1981, of the Saint Paul Legislative Code as amended.
2. That the petitioner's, their successors and assigns shall permit the City of Saint Paul,
Department of Public Works to retain a 30 foot wide permanent subterranean
easement for the purpose of protecting an existing sand rock sewer tunnel; said
easement shall be centered on the centerline Adrian Street, located between City
elevations SO to 76 feet and be retained over the entue length of the above referenced
vacated area.
3. That the petitioner's, their successors and assigns shall permit Metropolitan
Council Wastewater Services, its successors and assigns, to retain a permanent access
easement over, under and across the southeasterly 30 feet of said vacated area, for
the purpose of maintaining ingress and egress to its e�sting sewer pipe.
4. That the petitioner's, their successors and assigns shall pemut US West
Communications retain a temporary easement over, under and across the entire
vacated area for the purpose relocating cable facilities e�sting along the south side of
said vacated area; said temporary easement will expire August 1, 1996.
5. That the petitioner's, their successors and assigns shall pay $500.00 as an
administrative fee for this vacation which is due and payable within 60 days
of the publication date of this resalution.
6. That the petitioners, their successors and assigns, shall within 60 days of the
publication date of this resolution file, with the City Clerk, written acceptance
of the conditions of this resolution and within the time specified, also, comply in
all respects with the terms and conditions mentioned in this resolution.

That the petitioner's, their successors and assigns, by acceptance of the terms and
condition of this resolution, agree to identify, defend and save harmless the
C�ty of Saint Paul, its officers and employees from all suits, actions or claims of any
character brought as a result of injuries or damages received or sustained by any
person, persons, or property on account of this vacation or petitioner's use of this
properry, including, but not limited to a claim brought because of any act of
omission, neglect, or misconduct of said petitioner or because of any claims of liability
arising from any violation of any law or regulation made in accordance with the law,
whether by the petitioner or any of iu agenu or employees.
