96-635C��I������� Presented By Referred To Committee: Date 2 3 4 5 6 7 8 9 i0 11 12 13 14 i5 16 17 18 i9 20 �1 2 � 3� �23 WHEREAS, The Ciiy of Saint Paul has requested that the Department of Transportation grant a variance from the State's standards for design of urban roadways for the reconstruction of CASE AVENUE from Forest Street to Duchess Street; and WHEREAS, The City of Saint Paul requested a variance to allow a 36 foot wide street with parking permitted on both sides of the street between 6:00 a.m. and 1:00 p.m. on Sundays, and parking on one side of the street at all other times on CASE AVENUE between Forest Street and Duchess Street, in lieu of the required 38 foot street with parking on both sides; and WHEREAS, The Commissioner of the Department of Transpor[ation has by letter notified the City that the request for a variance has been granted upon condition that the City Council of Saint Paul adopt a reso4ution indemnifying and holding harmless the State of Minnesota from any claims arising out of the granting of this variance; and WHEREAS, The City has no other option available to it to receive the variance requested unless it complies with the demand of the Commissioner of the Department of Transportation; now, therefore, be it RESOLVED, That as the sole condition to receiving a variance from the provisions of State Aid Ruies Section 8820.9935, the Council of the City of Saint Paul does hereby agree to indemnify, save and hold harmless the State of Minnesota and all of its agents and empioyees ot and from any and all claims, demands, aetions, or causes of action arising out of or by reason of, the�Qconstruction of Municipai State Aid Street 115 (Case Avenue) located between Forest Street and Duchess Street;�-�ih any other manner than as in accordance with Minnesota Rules 8820.9935 and further agrees to defend at their sole cost and expense any action or proceeding commenced Sor the purpose of asserting any claim of whatsoever character arising as a result of the granting of this variance. g'Mr<.+� t .�`— f,.u� u(��`�(,. acci..v�eR S<� G:000,.w.. cs4 1'�sa �..+.. Now, Mn/DOT wants indemnification before signs can be installed. ADVANTAGESIFAPPROVED: The congregation of Holy Trinity Orthodox Church will be allowed to park (7 spots) on the south side of Case Ave. between Forest St. and Duchess St. on Sundays between 6AM and 1 PM.
