RESOLVED, that, upon execuuon and delivery of a release in full to the City of Saint Paul,
the proper Ciry officers are hereby authorized and directed to pay from the Tort Liability
Fund, 09081-0511, to American Family Insurance Company as subrogee for Dung Phan, the
sum of $3,478.50 in full settlement of their subrogation claim for damages sustained on
November 28, 1995 as a result of an accident with a City-owned vehicle at or near Munster
Avenue and West Seventh Street.

On November 28, 1995 a City of Saint Pau1 plow truck, driven by Timothy King, was
attempting to clear the intersection of Munster Ave. and West Seventh St. of snow, and
was struck by a 1989 Cadillac Fleetwood owned and driven by Dung Phan. Mr. Phan was
proceeding through the intersection with a green light. As a result of the collision,
the vehicle owned by Mr. Phan was a total loss. A settlement was reached with Mr. Phan's
insurance carrier in the amount of $3,478.50.
