On August 26, 1994, while the St. Paul Police were pursuinq Guy
Harvey Baker, the home of Robert Hill was teargassed. The gas
caused damage to Hill's dwelling, personal property and
necessitated additional livinq expenses, because the house was
uninhabitable. As a result Mr. Hill suffered a loss in the amount
of $60,047.01. That claim was submitted to his insurance company,
ADVANTqGES IP APPROVED'.
Allied has brought a claim in subrogation against the City of St.
Paul demanding that the City reimburse them for the losses caused
by the police. Under Minnesota law, when an innocent party's
property is damaged by the police during the course of apprehending
a suspect, the innocent party in entitled to compensation for the
loss from the municipality.
