Mr. Singer dces not contest that he has a conviction for criminal sexual conduct in the fourth degree. However, he dces contest revocation of his license and wishes a hearing before the City Council. As I mentioned, George Singer's license renewal date is April 1, 1996, and he has paid his renewal fee and filed the applicadon. You mentioned is license is vatid until the hearing and/or any adverse result in renewing or revoking the license. Although the conviction was for a felony, Mr. Singer received a stay of imposition of sentence. Upon successful completion of probation, the chazge will be reduced to a misdemeanor. At the time he plead to the charge, Mr. Singer had the option of pleading to an amended charge as a gross misdemeanor but declined such for various reasons. I will be forwazding material to you on Mr. Singer's behalf to show his license should not be revoked. This information is expected to include reports from several counselors, ueatment facilities, doctors, his proba6on officer and possible other sources. I expect that obtaining this information will take some time. We had talked about the hearing taldng place the beginning of May. However, I will be in trial on a murder case which begins on April 15, 1996 day certain. It may last a couple weeks and I will be preparing for that case in the weeks prior to the trial date. Therefore, I request the hearing be set for the end of May, either May 22, 1996 or May 29, 1996. By then I should be abie to obtain all the necessary information for the councils considerafion. Singer 1283 Edmund Avenue Saint Paul, Minnesota 55104 Re: Renewal Application for Taxicab Driver's License Dear Mr. Singer: The Office of License, Inspections and Environmental Protection is recommending revocation of your current taxi driver's license and denial of your renewal application for your taxi driver's license. This action is based on the following: On July 6, 1995, you pled guilty to Criminal Sexual Conduct in the 4th Degree. The above conduct is a felony violation of law, and constitutes grounds under Section 376.16(e)(4) of the Saint Paul Legislative Code for revocation of your curreat taxicab driver's license and denial of your renewal application for a taxi driver's licease. Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to a person having a felony conviction within the past five years. Section 310.06 of the Legislative Code also allows denial of a license when such matters indicate a lack of good moral character or fitness to engage in the licensed activity. Under state law, Minn. Stat. ch. 364, the City of Saint Paul must inform you of certain matters: First, the grounds and reasons for the denial of the license. These grounds and reasons are set forth above. PAGE 1 �IC-4(..3 Second, any complaints or grievances that you may have will be processed and adjudicated in accordance with the procedures set forth in section 310.05 of the Saint Paul Legislative'Code. These procedures are substantially similar to those required by the state administrative procedures act, Minn. Stat. §§14.57-.69. Third, the earliest date on wnicn you may reapply for a taxi driver's license will be one year from the later of the following two dates: (1) the date of your successful completion of supervised probation, with a copy of the department of corrections discharge order and other documents showing compliance with all terms and conditions of probation; or (2) the date, pursuant to section 310.02 of the Legislative Code, your license is denied by the City of Saint Paul. Future reception of a reapplication does not guarantee that there will be sufficient evidence of rehabilitation, nor that a license will issue at that time. Fourth, if you reapply, the City of Saint Paul will consider all competent evidence of rehabilitation that you wish to present. Examples of the type of evidence that will be considered are set forth in section 364.03 of the state law. Since the proposed revocation of your current taxi driver's license and denial of your renewal application for a license are adverse actions, you are entitled to the hearing procedures established in sections 310.05 and 310.06 of the Saint Paul Legislative Code. You or your attorney will have to make a written reguest for a hearing if you wish to contest the revocation or denial of your renewal application. If you do contest the facts stated above in bold type, a hearing on the facts will be heard before an administrative law judge, whose findings and recommendations will be given to the St. Paul City Council for a final determination. If you choose to exercise your right to a hearing, the Office of License, Inspections and Environmental Protection may submit a recommendation to the judge to recover the cost of the hearing. You may then be held responsible for the cost of the administrative hearing. If you do not wish to contest the facts stated above in bold type and wish to continue to operate as a taxicab driver with licensure by the City of St. Paul, you will need to admit to the facts in writing. In such cases, the matter will then be heard by the St. Paul City Council during a public hearing. The St. Paul City Council will then make the final determination regarding the status of your taxicab driver's license. PAGE 2 �iC-4t3 If you do not wish to contest the facts stated above in bold type and do not wish to continue to operate as a taxicab driver within the City of St.'Paul, you may surrender your taxicab driver's license to the license division and request to withdraw your renewal application.
