Presented By
WHEREAS, RBP Realty has submitted the attached Registered Land Survey for City Council approval; and
WIIEREAS, the appropziate city departments haue reviewed the Registered Land Survey and found it to
meet the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of the public hearing before the City Council was duly published in the official
newspaper of the city and notices were mailed to each owner of affected property and property situated
wholly of partly within 350 feet of the subject property; and
WHEREAS, a public heazing before the City Council was held on April 24, 1996 at which all interested
parties were heard, the Council having considered all the facts and recommendations concerning the
Registered Land Survey;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached
Registered Land Survey by RBP Realty, subject to the condition that the applicant record with the approved
Registered Land Survey, the declaration concerning utility, access and parking easements as filed with the
application.

A. PIIRPOSB: To consider a Registered Land Survey ("R.L.S.") request by RBP
Realty which will create 3 separate tax parcels on which each of the 3
existing buildings is sited. The existing buildings are currently all
within a single tax parcel. The applicant is requesting the subdivision
in order to secure separate financing on the individual buildings.
Subdivision of the property allows documents to be recorded with each
building they pertain to. This R.L.S. is required by Ramsey County to
allow the recording of the requested subdivision. This subdivision meets
requirements for approval by a simple administrative lotsplit without the
need for City Council action, but since Ramsey County is requiring a new
R.L.S. to record any subdivision of the property, City Council action is
required prior to recording any new R.L.S. Without City Council approval,
recording the subdivision is not possible. Utilities, access, and the
parking for the buildings will remain unchanged. A declaration concerning
easements of these issues was provided with the application and will be
required to be recorded with the new R.L.S. No new development is
associated with this subdivision request.
B. SITE & ARfiA CONDITIONS: The site is bounded by office/warehouse uses to
the north and soutlz, Lafayette Freeway to the west and Che St. Paul
Downtown Airport to the east. The property is zoned I-1 (industrial)
which allows officejindustrial park types of uses. The site is occupied
by 3 office/warehouse buildings used by multiple Cenants.
C. SACRGROIIND: The site was developed as part of the Riverview Industrial
Park by the Saint Paul Port Authority. The site plan for the 3 existing
buildings was approved in March 1981. RBP realty has purchased the
property on a Contract for Deed £rom the Port Authority in February 1996
and will continue to lease to multiple Cenants.

City staff have reviewed the proposed Registered Land Survey and
determined that it meets all requirements and standards of the City.
2. The proposed subdivision wil2 not be detrimental to the present an@
potential surrounding land uses.

3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision.
The surrovnding area and tfie area of the proposed Registered Land Survey
are compatible with respect to land uses.
4. The subdivision is in conformance with the Comprehensive Plan.
The property is in compliance with the comprehensive plan for this area of
the City.
5. The subdivision preserves and incorporates the site's important
existing natural features, whenever possib.Ze.
Existing natural features have been preserved where possible in the
development.
6. A11 land intended for building sites can be used safel.y without
endangering the residents by peril from �loods, erosion,
continuously high water table, severe soi2 conditions or oCher
menace.
The land has been safely developed.
7. The subdivision can be economically served with public facilities
and services.
The property is now served by public facilities and services.
E. STAPF RSCO1�mfENDATION: Based on the above findings, staff recommends
approval of the Registered Land Survey for RBP Realty with the condition
that the declaration concerning utility, access and parking easements
filed with the application be recorded with the Registered Land Survey.
