1 Wf3EREAS, The State of Minnesota Department of Natural Resources, Office of
2 Planning has funding available to increase and enhance outdoor recreation facilities through the
3 Land & Water Conservation Fund, and
4 WHEREAS, the City of Saint Paul is an eligibie applicant and desires to submit an
5 application for the Carty Park renovation project;
6 NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul act as legal sponsor
7 for the Carty Park renovation project contained in the Outdoor Recreation Grant Application to
8 be submitted on May 1, 1996 and that the Mayor and proper city officials are hearby authorized
9 to apply to the Department of Natural Resources for funding of this project on behalf of the City
10 of Saint Paul, and
11 BE IT FURTHER RESOLVED, that the City of Saint Paul has the legal authority to
12 apply for financial assistance, and the institutional, managerial, and financial capability to ensure
13 adequate construction, operation, maintenance and replacement of the proposed project for its
14 design life, and

BE IT FURTHER RESOLVED, that the City of Saint Paul has not incurred any costs, has
not entered into any written agreements to purchase property, and
17 BE IT FURTHER RESOLVED, that the City of Saint Paul has not violated any Federal,
18 State, or Local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or
19 other unlawful or corrupt practice, and
2 0 BE IT FURTHER RESOLVED, that upon approval of its application by the state, the
21 City of Saint Pau( may enter into an agreement with the State of Minnesota for the above-
22 referenced project, and that the City of Saint Paul certifies that it will comply with all applicable
23 laws and regulations as stated in the contract agreement and described in the Compliances section
24 ofthe Outdoor Recreation Grant Program Application, and

26 BE IT FINALLY RESOLVED, that the Mayor and proper city officials ofthe City of
27 5aint Paul are hearby authorized to execute such agreements as are necessary to implement the
2 8 project on behalf of the City.
