R'HEREAS, on April 12, 1967, the CouncIl approved CF# 232966, a resolurion to vacate the following
public sueet:
Wakefield Avenue between the westerly line of White Bear Avenue and a]ine drawn from the
northwest corner of Lot 3, Block 4, Grodes & Licha Addition; and
WHEREAS, said resolution was subject to conditions including the following Pazagraph 6:
6. That the petitioner pay to the City the sum of $4,000 as compensation for the vacation and
provide the City with a bond in the amount of $2,000; and
WHEREAS, all conditions having been sarisfied by the petitioner, the said vacation was duly filed in the
Ramsey County Recorder's Office; and
WHEREAS, the required $2,000 bond has now expired; and
WHEREAS, administrative changes involving vacation procedures now allow the petitioner to indeim�ify
the City rather than provide a bond;
THEREFORE BE TT RESOLVED, that Councfl File# 232966 is hereby amended as follows:
Paragraph 6. of the conditions and reservations shall read:

6. That the petitioner pay to the City the sum of $4,000 as compensation for the vacation;

BE TT FURTHER RESOLVED, that the following paragraph be appended the the said Council File#

That, the petitioner, its successors, and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers, and employees from all suits, actions, or
claims of any cbaracter hrought as a result of injuries or damages received or sustained by
any person, persons, or properiy on account of this vacarion or petirioner's use of this
properiy, including but not limited to a claim brought because of any act of omission,
neglect, or misconduct of said petitioner or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioner or any af its agents or employees.
BE TT FiJRTSER RESOLVED, thzt all other terms, conditions and reservations of the said Council
File# 232966 shall remain in full force and effect.
