CITY Presented By Referred To RESOLUTION Green Sheet # ��OS� SAINT PAUL, MINNESOTA Committee : Date �� WHEREAS, the Councfl of the City of Saint Paul adopted an amendment to Chapter 45 of the Saint Paul Legislative Code, which declared unwanted graffiti a nuisance; and WHEREAS, the amendment requires property owners to remove unwanted graffiti; and WHEREAS, the Council of the City of Saint Paul recognizes that property owners may be victims of unwanted graffiti; 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 NOW, THEREFORE, BE IT RESOLVED, that the intent of the amendment is not to penalize property owners, but to encourage the quick removal of unwanted graffiti in order to discourage the proliferation of additional unwanted graffiti; AND BE TT F'URTSER RESOLVED, that the Council of the City of Saint Paul requests the Mayor and the Director of Public Health to adopt the following procedures for eliminating graffiti: 1. When a complaint is received by the Citizen Service Office, Police or other city agency which alleges the presence of graffiti, a representative from Saint Paul Public Health will contact the property owner, manager, agent or responsible party to advise them of the need to remove the graffiti and will inform the property owners in removal techniques and graffiti prevention strategies. The representative from Public Health will also advise the property owners of available resources to help the owners remove the a affiti, and provide the owner with literature describing available resources. The representative from Public Heaith will also determine a reasonable period of time for the removal of the graffiti and so notify the properry owner, management agent or responsible party. 2. If the property owner fails to remove the graffiti in that period of time, or if a responsible property owner cannot be located, Public Health shall abate the graffiti in accordance with the provisions of Chapter 45 which establish an appeal process to the City Council. Public Health sha11 provide a minimum time period often (10) days for the property owner to comply with the abatement notice. 3. ff an appeal to the Abatement order is filed by the property owner to the City Council, the Council wiil consides the merits of the appeal subject to Chapter 45. � �������.E�� �_33� '�Nb°BE fT' F[3�ZTEER RESOLVED, that the Chief of Police, Director of Public Heaith and the Citizen Service Office submit an annual report to the City Council so that the City Council may analyze the effectiveness of the amendment to Chapter 45. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 ANA BE TT FINALLY RESOLVED, that the City of Saint Paul supports the developmem and implementation of procedures for obtaining restitution from persons convicted of uxlawfully placing graffiti on the property of another, and requested the City Attorney to work with the Ramsey County District Court and the Rauisey County Attorney's O�ice to develop and implement procedures for obtainuig restitution from persons convicted of unlawfully placing graffiti on the properry of another. When, Where, Why): The process currently used to ensure the removal of graffiti can not keep up with the demand for inspection. It is the opinion of the Citizen Service Office, Police Department, Department of Public Health and Administraeion that the procedure would be more efficient if switched from Police to Public Health. This is in the spirit of City Council Ordinance, unde Chapter 45, regarding nuisances. The resolution formerly adopted by the Council requires reliance on NAO's and volunteers to resolve graffiti complaints and the process is very bureaucratic and slow. This proposed procedure will place the complaint ca11s directly to Public Health for faster resolution and removal.
