WHEREAS, the City of Saint Paul, acting through its Valuation Engineer, has secured an
agreement for the purchase of property described as follows:
The Northerly 39.45 feet of Lots 16 and 17, Smith°s
Subdivision of Block 12, Stinson's Division of St. Paul.
WFIEREAS, the property described is necessary for widening and improvement of Dale
Street North. Said properry was Fina1 Ordered for acquisition on September 20, 1988 with
Council File Numbered 88-1522. The value at which this property may be purchased is in the
amount of Forty-Three Thousand Dollars ($43,000), this being a fair and reasonable value as
determined by an independent appraiser; and
WHEREAS, the Valuation Engineer has recommended the purchase of said property at
the recommended value;
SO Tf�REFORE BE TT RESOLVED, that the proper City officials are hereby
authorized and dzrected to pay Gre o�yr T. Ryan the sum of $43,000.
Said sum to be charged to Activity Code: C42-2G006-0788-0000.

' 10. Closing shall occur within 60 days of the signing of this agreement by the seller. Buyer shall
pay a11 closing costs. Seller shall give possession of the property to the Buyer at closing.
11. Sellez shall be responsible for getting a final reading from all utilities.
12. Selier sha11 give notice to the tennant to vacate the premisis by March 31, 1996. Seller shall
bring a copy of such nofice to the closing.
13. Seller shall provide an affidavit on the date of closing, indicating that the Seller has not used or
permitted the use of the subject property as a hazardous waste disposal facility as defined in
section 115A.03 Subd. 10 of Chapter 121 of the Laws of Minnesota of 1983, and that there is
no basis to conclude that this property has been subject to or contaminated by the release of any
hazardous substance, hazardous waste, pollutants of contaminants as defined in Section 115B.02
of the Minnesota Statutes.
14. All wananties and representations made in this Purchase Agreement shall survive the closing and
the conveyance of title to the property. This Purchase Agreement and all obligations provided
shall, to the extent not fully satisfied and performed by or through the Closing, survive the
closing and the conveyance of title to the property.
