That this vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the Saint Paul L.egislative Code as amended. I� � 2. That the petirioner's, their successors and assigns shall permit the City of Saint Paul, Department af Public Works to retain a 30 foot wide permanent subterranean easemexrt for the purpose of protecting an existing sand rock sewer tunnel; said easement shall be centered on the centerline Adrian Street, located between City elevations 50 to 76 feet and be retained over the entire length of the above referenced vacated azea. 3. That the petitioner's, their successors and assigns shall permit Metropolitan Council Wastewater Services, its successors and assigns, to retain a permanent access easement over, under and across the southeasterly 30 feet of said vacated area, for the purpose of maintauung ingress and egress to its existing sewer pipe. 4. That the petitioner's, their successors and assigns shall permit US West Communications retain a temporary easement over, under and across the entire vacated azea for the purpose relocating cable facilities existing along the souW side of said vacated area; said temporary easement will expire August 1, 1996. 5. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for tlus vacaxion which is due and payable within 60 days of the publication date of this resolution. 6. That the petitioner's, their successors and assigns, by acceptance of the terms and condition of this resolution, agree to identify, defend and save harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter brought as a result of injuries or damages received or sustained by any person, persons, or property on account of this vacation or petitioner's use of this property, including, but not limited to a claim brought becanse of any act of omission, neglect, or misconduct of said petitioner or because of any claims of liability arising from any violation of any law or regulation made in accordance with the law, whether by the petirioner or any of its agents or employees.
