WHEREAS, the City of Saint Paul, on January 10, 1995, received a Notice of Tax
Liability from the State of Minnesota stating that Marjorie Anne Navarro owed delinquent
tases to the Staxe of Minnesota, and;
WHEREAS, Marjorie Anne Navarro, DBA the Bourbon Baz, 691 N. Dale Street,
holds the following licenses at that location: Entertaimnent, Class A, Restaurant C, Sunday
On-Sale Liquor and Liquor On-Sale, 100 seats or less, C, and;
WHEREAS, Minn. Stat. §270.72, subd.l (1994) requires the revocation of any license
for the conduct of a profession, occupation, trade or business held by an applicant who owes
$500 or more in delinquent ta��es or has not filed retluns, and;
WHEREAS, under said statute the State of Minnesota must notify the applicant of the
intent to require revocation of such license, and of their right to a heazing, and;
WHEREAS, a hearing under tlus state statute is expressly provided to be in lieu of any
other hearings or proceedings required by law, which would include the hearing provisions of
St. Paul Leg. Code § 310.05, and;
WHEREAS, the City has agreed with the Department of Revenue that the definition of
"revoke" as used in the statute is procedurally the same as the process used by the City of
Saint Paul for a license suspension, and;
WHEREAS, the license suspension must be implemented within thiriy (30) days of
receipt of the Notice of T� Liability, and is in effect until the commissioner issues a taaf
cleazance certificate, and;

WHEREAS, no tas ciearance certificate has been forwazded to the City of Saint Paul,
Office of LIEP, by either the applicant or the Commissioner of the Mivuesota Depaztment of
Revenue,
NOW THEREFORE BE IT RESOLVED, that the licenses held by Marjorie Anne
Navarro and/or M A N Inc., DBA the Bourbon Bar, 641 N. Dale Street, to wit: Entertaiment
Class A, Restaurant C, Sunday On-Sale Liquor and Liquor On-Sa1e, 100 seats or less, C, be
and hereby aze suspended effective ; tA�G�-f t� t�� and will not be reinstated until such
tnne as the City of Saint Paul has received a taY cleazance certificate from the Commissioner
of the Minuesota Department of Revenue.
