WHEREAS, the consolidation of MC'TO bus routes through downtown Saint Paul has
concentrated routes on Fifth, Sixth, Cedar and Minnesota Streets, creating transit hubs; and,

WI-IEREAS, to accommodate the increased usage at the Fifth and Minnesota bus stop, the
MCI'O has uparaded the stop with bus shelters and heated waiting azeas, and plans to increase
the size of the bus stop and sidewaik azea by the acquisition of a 12.00 foot easement to be
conveyed to the City for right of way purposes; and,
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul,
Minnesota(HRA), acquired a vacant lot at Fifth and Minnesota Streets which was the site of
the former First Minnesota Building; and,
WHEREAS, the First Minnesota Building has been demolished and the site improvements of
bus shelters and heated waiting areas have been completed and the HRA would like to
complete the project by conveyance of the right of way easement for sidewalk to the City; and,
WHEREAS, the HRA Boazd has authorized the execution of a Deed of Dedication of
Easement for Right of Way Purposes attacHed hereto as E�ibit B and made a part herein by
reference;
NOW, THEREFORE BE IT RESOLVED that the City Council of the Ciry of Saint Paul
approves the acceptance of said Deed of Dedication of Easement for Right of Way Purposes.

The Housin� and Redevelopment Authority of the City of Saint Paut, Minnesota, a public body,
corporate and politic, organized and existing under the la�vs of the State of Minnesota, Grantor, for
good and valuable consideration, to it in hand paid and the receipt of which is hereby acknowled�ed,
does hereby Grant, Bazaain, Sell and Convey to the City of Saint Paul, a municipaI corporation of the
State of Minnesota, its successors, and assigns, as Gnntee, a permanent easement for ri�ht of way
purposes on, over, under and acro'ss the followin� tract of Iand being in the County of Rzmsey, State
of Minnesota, described on attached Exhibit A. To have and to hold the same forever. The Grantor
does covenant that it is well seized in fee of the land and premises zforesaid, and has good riaht to
sell and convey the same free of all encumbrances.
7hat Grantor also covenants that the above granted easement is in the quiet and peaceable possession
of the Grantee. The Grantor will warrant and defend against alI penons la�vfully claimin� the whoIe
or any pazt thereof, subject to encumbrances, if any, hereinbefore mentioned. It is intended and
agreed that this agreement shall be a covenazit running with the land and shall be bindin� fo the fullest
extent of the law and equity for the benefit of the public. It is further intended and agreed that tbis
a�reement and covenant shall remain in effect without limitation as to time_ This easement shalI be
subject to the followina conditions:
