1 WHEREAS, the Saint Paul Ciiy council is exlxemely concerned about the current gun control policies that are not
2 adequately enforced throughout the State of Minnesota; and
3 WHEREAS, it is a felony to use a fireann in the commission of a felony (Minnesota Statues Section 609.11); and
4 to intentionally dischazge a firearm that endangers the safety of another (Minnesota Statute Section 606.66); and
5 to steal a fireann (Mimiesota Statutes Section 609.52); and to furnish, in a municipality, a minar with a firearm or
6 air gun without prior parental consent (Minnesota Statute Section 606.66); and
7 WHEREAS, it is a gross misdemeanor to recklessly handle or use a fireann so as to endanger the safety of another
8 in a public housing zone, a school zone, or a park zone (Minnesota Statutes Section 609.66; and to intentionally
9 point a firearxn at or toward another in a public housing zone, a school zone, or a park zone (Minnesota Statutes
10 Section 609.66); and
11 WHEREAS, these and other serious offenses aze routinely neglected by the criminal justice system through plea
12 bazgains and negotiations; and
13 WHEREAS, no offender would be seriously deterred by the implementation of new misdemeanors (the penalties
14 that may be implemented by a municipality) to restrict their inappropriate handling of firearms;

The legislature preempts all authority of a home rule charter or statutory city
including a city of the first class, county, town, municipal corporation, or other govem-
mental subdivision, or any of their instrumentalities, to regulate firearms, ammunition,
or their respective components to the complete exclusion of any order, ordinance or
regulation by them except that:
(a) a governmental subdivision may regulate the discharge of firearms; and
(b) a govemmental subdivision may adopt regulations identical to state law.
Local regulation inconsistent with this section is void.

For purposes of section 471.633, the terms "municipal corporation° azid "govem-
mental subdivision," or instrumentality thereof, do not include school districts and

471.635 ZONIRTG ORDINANCES.
Notwithstanding section 471.633, a govemmentai subdivision may regulate by
reasonable, nondiscriminatory, and nonarbitrary zbning ordinances, the location of
businesses where firearms are soid by a firearms dealer. For the purposes of this section,
a fireazms dealer is a person who is federally licensed to se115rearms and a govemmen-
tal subdivision is an entity described in sections 471.633 and 471.634.

Subdivision 1. Any county, city, town, school district, or other politicai subdivi-
sion of the state may enter into any contract with the United States of America or with
any agency thereof, any state agency, or with any other political subdivision of the state
for the purchase, lease, sale, or other acquisition or disposition of equipment, supplies,
materials, or other property, including real property, without regard to statutory or

My effort to rescind the state law to allow cities the right to adopt stronger restrictions on
handguns is predicated on the belief that ciry officials need more powerful tools to
prevent violent crime. I hope you will join me in this effort to change state control to local
control.

Number of Homicides in Saint Paul rose 200% since 1991, from six to eighteen.
Number of homicides in Minneapolis 1960: 7, 1995: 97.
Number of robberies with firearms in Saint Paul rose 130°/a since 1991, from 244
to 366.
In Ramsey County, from 1993 to 1994, for people age 10 to 18, weapons
violations grew from 81 to 121, an increase of 50%.
According to Ramsey County Corrections Department, Juvenile Division, the
number of homicide/manslaughter offenses in juveniles rose 367% from 1989 to
1995.
In a list of health issues in Ramsey County there is a high incidence of suicide and
homicide among 15 to 24 year olds.
The Report on Adolescent Health in Minnesota states in the1993-94 school year
there were a substantial number of weapons in school...872 weapons
incidents...19% were guns.
Between 1990 and 1994 there were 1,438 gunshot deaths of persons under age 24
in Minnesota. 40% were suicide; 21 % were homicide.
Adolescents are most likely to be victims of crime by other adolescents.
In a national survey, 78% of the people survey favor stronger measures to control
gun violence.
According to the FBI, an estimated 2 million to 4 million acts of domestic
violence are committed each year nationally. These acts cause 1,500 deaths a
year, 65% of them with guns.

I am writing each member of the St. Paul City Council to urge you to support Councilmember
Megard's resolution to rescind the City's fuearm's pre-emption. This item is on the City
Council Agenda for November 13, 1996.
I am a member of the Ramsey County Gun Violence Action Team and am involved with the
development of policies aimed at reducing violence in our communities. One of the policy
objectives that would move us in this direction is State legislation that would remove State pre-
emption of the City of St. PauP s authority to enact tighter laws contxolling firearms and
ammunition, pursuant to Minnesota Statutes Chapter 471.633- 471.635. It would be helpful
to the St. Paul and Ramsey County legislative delegations to have the City of St. Paul on
record in support of this legislation as we bring this before the 1997 Legislature.
You and I know ali too well the extent of gun vioience in St. Faul neighborhoods, so I know it
is not necessary to recite the statistics of death and injury that exist or make more than this
mention of the fearful environment created when residents know the ease with which firearms
and ammunition move about our neighborhoods. What I do want to emphasize, however, is
that pre-emption is a controversial issue at the L.egislature and the o�cial action of cities
throughout the state is nnperative to convince the Legislature that cities are unified on this
issue. Minnesota's big ciues, like St. Paul, need to make it quite clear to legislators that they
need the tools to deal with both the real crime problems associated with fuearms and the
environment of fear that is created from l�owing how ever present firearms are within our
community. As an issue of local control, you in the City Council I�ow better than someone
from rural Minnesota how to solve these problems, and deserve a chance to try creative
solutions at the local level.

Thank you for your letter urging the legislature to rescind the preemption of local authorities to
regulate the possession of firearms and ammunition. I agree with your position entirely.
Unfortunately, a majority of the legislature does not.
The danger that arises in trying to enact legislation to rescind the preemption is that something
worse than that, like guaranteeing the right to carry a pistol, znay pass instead. ThaY s what
happened last year when a majority of the House, including two St. Paul state representatives
voted for a"shall issue a pernuP' mandate. The consequences of that type of legislation becoming
law would have been deadly.
So while I support your position and have even tried to enact a repeal of the preemption law in
previous sessions, I don't want to try it again until we are certain that we haue the votes. That
includes hauing the support of the entire St. Paul House delegation.

fuearms (gun control). As a police officer with sixteen years of service on the streets of Minneapolis
and as a police officer who, in 1973, had two 45's go through his right leg, I can asswe you that the
need for control of firearms is as good as it has ever been in the history of our country.
I wish you a lot of luck Roberta, but I can tell you that the gun lobby is going to come charging at this
fuli bore. As a long time advocate of gun control I am finding that more and more police officers are
realizing the need to get guns out of the hands of criminals, especially young criminais who aze shooting
each other in major American cities at a rate that makes me think I am back in Korea on the front line.

Public safety is the most important issue facing our cities
today. The city of St. Paul has some innovative ideas that would
help them reduce their homicide rate. These would include
tightening control of hand quns. They are stymied by Minnesota
Statutes Chapter 471.633-471.635 that limits any requlation of
hand quns to the State's control at a level approved in 1985.
Times do change and communities should be allowed to make their
own judgments in these matters.
Please support the needs of cities to direct their own safety and
remove this legislative preemption. We need to find new ways to
curb violence and should not be frozen by a twenty year old
statute.

I am in receipt of your request for support to rescind the law which
preempts local authority from regulatina the possession of firearms and
ammunition (MSA Chapter 471). I can certainly appreciate and do support
your�initiative, however, I do so from different points of view.
As a member of the Minnesota.Women in City Government, and thinking
globally, I would offer unqualified support in an attempt to return local
governments to the authority they enjoy in regard to almost every other law,
and that is that local ordinances may be more restrictive, but not less
restrictive than state statute. The larger cities, with gun problems growing
every year, feel this is a must.

guns have not become a major concern to our law enforcement officials and
therefore, would be supportive mostly in a cooperative vein. In a
community where the urban and rural interests literally meet, I represent
citizens on both sides of the gun control issue. This leads me to my third
point of view - that of the political reality.
My Chief of Police, Da�e Martens, points to the successes of very
restrictive local gun ordinances which appear to have made significant
differences in at least five states across the country. But he also points out
that wherever legislators have enjoyed successes, there has almost always
been the "equal and opposite reaction." My close friend, State

Representaxive Bill Mackiin, suffered through this this past year. He
amended a bill that would have returned some of the powers taken away
from local officials in regard to gun permits. The reaction from the anti-gun
control lobby was significant and damaging - and they did it all by
misinterpreting his intentions. I do not say this to dampen your attempt, but
to prepare you for the likely response, as I saw so clearly when it happened
here.
Good luck. The rising use of firearms in crimes in Saint Paul and some
other cities would certainly speak to the need for more local control.

The St. Paul Police Federation Executive Board has discussed this issue at great length. The
Board brought the issue to the Membership at our regular monthly meeting on October 1, 1996,

regulating the possession of firearms and ammunition.
Unfortuna.tely, I am not in a posirion to join you in this effort as my Boazd of Directors has on many
occasions reviewed identical proposals and each time voted not to support such 2egislative efforts.
Although there is no question that you aze accurate when you taik about the increase of gun violence,
frankly it is a concern that is not limited to the Ciry of Saint Paul. My Board, all of whom aze police
professionals, feel that any such efforts should be on behaif of legislation that would apply uniformiy
throughout Minnesota. Regulations pertaining to firearms aze an issue that our friends in the
legislateu�e shouid realiy deai witn and untii tney aze wiliing io adnress tnese issues, it does litt.e :f
any good to create misdemeanor or gross misdemeanors in certain jurisdictions.
Our organization serves as the legislative voice for the overwhelming majority of police officers in
Minnesota and we do not share your views in this regard.

Dear Bobbi,
On Tuesday, September 3rd the District 6 Planning Councii held their monthly meeting.
At this meeting there was a great deal of discussion regarding your resolution that
requests the Sfate of Minnesota to ailow Minnesota cities to impose restrictions on
certain firearms and ammunifion in excess of State regulations.
The motion was made, seconded, and passed to oppose this current resolution.
However, the Board of the District 6 Planning Council would like to recommend that a
lobbying efFort at the State level begin to uniformly regulate guns in large cities at
different leveis than State wide as needed.
Bobbi, we truly appreciate all the hard work you do fo help make the City of St. Paul a
stronger, safer, and economicaily better place to live.
