95-942A]"��N'p�� $lq las C�RI�I��!�� Council File i 9s Ordinance i Green Sheet # ���� RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred To �on¢¢iccee: uaLe �? 1 WI�REAS, Chapter 293 of the Saint Paul Legislaflve Code was enacted to regulate noise levels in the 2 City of Saint Paul; and 3 4 WI�REAS, section 293.11 of the Legislative Code authorizes the City Council to grant variances from 5 sound level restrictions in section 293.09 upon finding that fiill compliance with the requirements of the 6 ordinance would constitute an unreasonable hazdship on the applicant, on other persons, or in the 7 communiry; and 8 9 WHEREAS, the St. Paul Saints Baseball Club, has proposed that music concerts be staged at Midway 10 Stadium at 1771 Energy Pazk Drive on August 16, 17, and 19 from 12:00 noon to 8:00 p.m., and has 11 requested a variance from the restricfions in sec6on 293.11 of the Legislative Code; and 12 13 WFIEREAS, the Council of the City of Saint Paul conducted a public hearing on said matter on August 14 9, 1995; now therefore be it 15 16 RESOLVED, that the Council of the Ciry of Saint Paul hereby grants a variance from the noise level 17 restrictions in section 293.09 of the I.egislative Code to the St. Paul Saints Baseball Club for the concerts 18 to be staged at Midway Stadium at 1771 Energy Pazk Drive on August 16, 17, and 19, 1995, upon the 19 following express condidons: 5:3o p.m. until 10:00 p.m. on August 16 ana i7 1995 20 21 22 23 24 25 26 27 28 29 30 31 and 3:00 p.m. until 8:00 p.m. on August 19, 1995, l. The sound level at the stage shall not exceed� dBA (slow response) measured at the sound mix position. The 5t. Paul Saints Baseball Club shall maintain continuous sound level monitoring throughout the period of the variance, and shall pernut City environmental staff to have access to and ffie ability to inspecC such monitoring equipment and the readings registered on such equipment. 1 4.
