Thank you for taking the time to meet ith me this week regarding this incident. I reviewed the lice report with Mr. Mao, and he acknowledges that he sold the beer to the person. Mr. Mao advises me that he did no know his customer was intoxicated, and that the customer did nothing in his store which would alert his attention to the stat of intoxication. After the customer was arrested by the polic , the police brought Mr. Mao outside the store, at which time r. Mao then•observed that the customer was obviously intoxicated I have explained to Mr. Mao that he is under a duty to make s me investigation to see if his customers are intoxicated before he sells any alcohol to them. I believe he now understa ds this concept. Since Mr. Mao do s not dispute the facts, he hereby waives his right to a hea ing before an independent hearing examiner. When you do p esent this matter to the St. Paul City Council, I would apprecia e it if would also present this letter to the Council to explain Mr. Mao's position that he did not wilfully violate the term of his license.
